Feds sue Delaware over pollution at Fort DuPont State Park


WILMINGTON, Del. (Legal Newsline) – The United States is suing Delaware under the federal Superfund law over hazardous substances at a landfill.
The lawsuit, filed Dec. 16 in Delaware federal court, seeks compensation for the response costs paid by the U.S. to address the release or threatened release of toxic substances at the Governor Bacon Health Center/Fort DuPont State Park in New Castle County.
The property at issue is a dump area for Fort DuPont owned by Delaware since 1947. Beginning in 1985, after a fire, a series of investigations found lead contamination, the suit says.
The feds say they have paid almost $4 million to remediate the property. ....

The Environmental Protection Agency announced that the U.S. Department of Defense and the state of Delaware have agreed to reimburse EPA $3,590,985 for its cleanup of a former landfill at the Governor Bacon Health Center/Fort DuPont State Park near Delaware City.
The U.S. Army owned and operated the Fort DuPont military base from the 1860s to 1947. Fort DuPont served as a Civil War gun battery, a World War I era field training, proving ground, target practice site, and a World War II artillery base and prisoner of war camp. The Army also operated an incinerator adjacent to the landfill. ....

U.S. Files Environmental Suit Against Delaware Regarding State-Owned Military Plot

In a District of Delaware complaint, filed on Wednesday, the United States alleged that the State of Delaware has not fulfilled its obligations under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and asked that the state be required to pay response costs incurred by the country to clean up the release of hazardous waste in an area owned by the state. 
The location of the release is Landfill Area #1, which is in the Fort DuPont State Park, and more specifically in a 10 to 20 acres area within the Governor Bacon Health Center. The area has reportedly been owned by the defendant since 1947. The Delaware River as well as the Chesapeake and Delaware Canal border the land; they allegedly could be contaminated by the waste if the clean-up efforts did not occur.  ....
