Just before 7:15 in the morning on Saturday, September 3rd, Galesburg Police responded to the 1000 block of Garden Lane for a well-being check. A caller told dispatch a vehicle parked in the roadway had a male subject slumped down in the driver's seat. Police arrived and located the vehicle which was still running, in gear, with its headlights on. Officers woke the driver, 44-year-old Zachary Theobald of Galesburg, and officers observed a glass bottle inside a brown bag on the passenger's seat. Theobald told police he drank "several hours ago" according to police reports, and consented to a field sobriety test. At one point, Theobald told police he couldn't perform the test "even if he was sober" and that his blood alcohol content won't be below .08.
