The 80s. it was the defining version of this story in the sense that this was the one time, this one time that a lawyer went into court and proved that the police were lying and that this really was a police killing. and it was it was like a lightening strike because it s not like people were successfully going into court after that and doing it again. right, yeah. i feel like this has parallels to the walter scott case. i want to read a little about the description here. this is before the fleeing felon rule. what is shocking is how little has changed except for the new public and political awareness which is a problem. the walter scott was a man who was fleeing. it was one of the rare cases that had justice in the case. without video there wouldn t have been a jury. without video, the story would have been he turned in a threatening manner as if to ....

Tooth comb. isolate and contain, cover and concealment. when you re in broad daylight and you have the opportunity to take cover behind whatever kind of vehicle, you take all the time necessary. because that s what helps you make that split second decision if this person should be shot or not. i know he was mentioning that the fleeing felon rule. i mean, i don t even see the fleeing felon room coming into play. they could have held off on it if they took the proper tactics to make sure that they were able to get that extra couple of seconds that they need eed befo they needed to fire their guns. we re working on new video angles that are coming in. we ll have those turned around. ari, you wanted to say? mentioned the fleeing felon rule. this is the point that just because someone may be a criminal or even a fugitive does not mean that under the rules, that means they should face consequences, but that doesn t mean they face the consequence of shooting to kill or execution ....

They have to use necessary force to make the arrest. in the u.k. we have a standard of proportionality which we don t have here. we just have self-defense on use of force. we don t have proportionality. if we had that law i think there would be less daylight between the way our legal system is set up to protect and not protect certain kmuns andcommunities and the way our values are protected. i have to disagree. we have two components of use of force. a necessary component and proportionality component. you can t shoot and kill a jaywalker but if they re coming at you with a knife or a gun. but you wouldn t be shooting and killing them disproportionally due to what they re doing to you. which is the fleeing felon rule. you can t chase someone down and use deadly force unless there is the threat to you and the community. that s correct. officer ham in baltimore, i ....

The tape if you keep going, you see the second officer comes up. there is an interaction between the other officer, so you wonder what did that second officer see, what did that other officer report happened? there is the question of whether or not the officer in question dropped or put something down near the body. there are a lot of questions that this videotape at least appears to begin to answer. and in terms of the rebutting of the case that stood for four days with the officers then attorney the officer s actions were warranted because he felt threatened has there been any rebuttal other than this videotape? any other witnesses come forward? do the family have any reason to rebut that. there wasn t any other independent evidence. when i saw the tape whey thought about was the question of this fleeing felon rule. these old laws that used to be on the book that allowed an officer to use deadly force because a suspect was fleeing. whether or not they pose a threat. so i c ....

The shooting of michael brown, which there is no video and different judgmentsered about what happened there. the key thing is it could be possible that he did grab for the taser at some point. and that also, what happened subsequently was not justifiable. i would be interested in knowing what the fleeing felony rule was. i believe those laws have been done away with largely throughout the country. there used to be a fleeing felon rule that allowed an officer to fire if you were running away from them. that is not the case in most states. i think even if something happened and there was an altercation, when they were close together and could have posed a threat to the officer, once he is that distance away and fleeing, there would be the question if there is a fleeing felony rule in place. ....
