Earl Martin files Article 78 against Seneca County over sewer segmentation

Earl Martin has filed an Article 78 proceeding against Seneca County.
It has to do with the County’s decision to segment Sewer District No. 2.
He’s the owner of the former Hillside property, which was purchased from the Seneca County Industrial Development Agency.
The purchase itself, as was the case when he bought another large portion of the former depot, was viewed as controversial to some board members and members of the community.
At a meeting in December the Board of Supervisors agreed to decommission the wastewater treatment plant that served Hillside and First Light Technologies; hike the number of equivalent dwelling units charged to Martin from one to 54.5; and increase the sewer rate charged per EDU from $30 to $454. ....

Seneca County supervisors approve Sewer District No. 2 segmentation


WATERLOO — The Seneca County Board of Supervisors voted unanimously Tuesday to segment county Sewer District No. 2 into two separate service areas, and to increase the cost to the two remaining users of a wastewater treatment plant on the former Hillside Children’s Center property by over 1,000%.
There was considerable discussion during public comment, but the 13-0 vote itself occurred without discussion. Jim Cleere of Waterloo was the only board member not in attendance.
David Cook, an attorney representing Earl Martin and his businesses, objected to the segmentation and fee increase. He said it was “arbitrary and capricious” and could lead to an Article 78 proceeding if approved. ....
