CTA allows BIR to pursue P29-M tax case vs. Ayala Land subsidiary

MANILA - The Court of Tax Appeals (CA) has allowed the government to pursue its formal demand for deficiency taxes in the amount of PHP29.23 million against Ayala Land International Sales, Inc. (ALISI) for 2009. In a 21-page decision dated Oct. 19 and written by Associate Justice Erlinda P. Uy, the tax court en banc granted the petition filed by the Bureau of Internal Revenue (BIR) to set aside the ruling of the CTA's Special ThirdDivision in 2018 and said the BIR's right to assess for deficiency taxes has not yet prescribed when it issued a formal letter of demand (FLD) in 2014. The CTA en banc also remanded the case to the division to determine the merits of the ALISI's petition seeking the cancellation of the deficiency tax assessments for the calendar year 2009 for income tax, value-added tax, expanded withholding tax, withholding tax on compensation and documentary stamp tax totaling PHP29.23 million.
