A Renewed Focus on Telehealth in New Jersey | McDermott Will & Emery


OVERVIEW
New Jersey governing boards for dentistry, counseling, respiratory care and occupational therapy have introduced regulations to address licensure requirements for telehealth encounters, consistent with previous regulations adopted by governing boards of other health professionals in New Jersey. The New Jersey legislature is also considering a bill to expand reimbursement for covered services provided via telehealth and allow for new flexibilities, including on type of encounter, location and distance requirements and reimbursement parity. Comments for the four regulations from the governing bodies are due by May 14, 2021.

Below are the most recent health care related regulatory developments as published in the New Jersey Register in February and March 2021:
On February 16, 2021 at 53 N.J.R. 195(a), the Commissioner of Health adopted a temporary rule waiver/modification of the requirements governing the expiration and renewal of certificates for Certified Medication Aides (CMAs) at N.J.A.C. 8:36-9.2. Section 6 of EO 103 that modifies the expiration dates and recertification requirements for CMAs as follows:
CMA certifications that expire between March 1, 2020 and December 31, 2020, are automatically extended until March 19, 2021; and
Any CMA whose certification expires between March 1, 2020 and December 31, 2020, are permitted to renew his or her certification outside of the two-year renewal window, up to and including March 19, 2021; and ....
