Le tribunal s’est penché, lundi, sur la demande des avocats de M. Kinsella de déclarer la poursuite de Maxime Bernier abusive et de simplement la rejeter. Le chef du Parti populaire du Canada a intenté une poursuite contre M. Kinsella pour les propos qu il a tenus à son encontre, lui réclamant 325 000 $ en dommages. Le mois dernier, Me David Shiller, représentant M. Kinsella, a fait valoir devant le juge Calum MacLeod que la poursuite de M. Bernier n était ni plus ni moins qu une poursuite-bâillon, aussi connue sous l acronyme anglais de SLAPP (strategic lawsuit against public participation), dont l objectif était de brimer la liberté d expression de son client.
