A Washington state judge who made racist comments about a young Black man killed by police says he plans to retire.
Clark County District Court Judge Darvin Zimmerman made his remarks in March about Kevin Peterson Jr., a 21-year-old Camas man shot by deputies after he ran from a drug sting with a gun.
Zimmerman didn’t realize his conversation in an empty courtroom was being broadcast on Youtube, The Oregonian/OregonLive reported. He called Peterson “dumb” and “the Black guy they are trying to make an angel out of.”
He also suggested that the next day Peterson’s father woke up “with dollar signs in his eyes and George Floyd’s attorneys,” referring to the Black man whose murder by Minneapolis police last year prompted a national reckoning about racial justice and policing. ....

The Washington State Commission on Judicial Conduct met Friday, but it was unknown if Clark County District Court Judge Darvin Zimmerman was among the topics of discussion.
Investigations and initial proceedings are confidential, but attorney Josephine Townsend, who’s representing Zimmerman, told The Columbian on Monday that her team had been given a case number.
The commission has also requested that her team not discuss the case while it’s being investigated, Townsend said. ....

The Columbian has printed several articles and letters about Judge Darvin Zimmerman’s live mic conversation with Court Commissioner Abbie Bartlett. Comments Zimmerman made have been criticized as racist or racially biased by judges, lawyers, politicians and others.
I didn’t see anything obviously racist in the excerpts of Zimmerman’s comments that were quoted in the articles. I wondered if racism was seen too readily. With this in mind, I read the transcript of the conversation published by The Columbian on March 16. I still don’t see anything clearly showing racial bias. ....
