1956年，评剧电影《刘巧儿》在全国放映引发巨大轰动。剧中，刘巧儿反对封建包办婚姻、争取婚姻自由的故事，感染和影响了一代人。“刘巧儿”的生活原型为封捧儿（后改名封芝琴）。“刘巧儿案”源自1943年陕甘宁边区陇东分区专员、边区高等法院陇东分庭庭长马锡五主审的“封捧儿婚姻案”，是推广和弘扬马锡五审判方式的活教材。
陕甘宁边区时期，一些县形成了“婚姻成立以交付彩礼为准”“交钱（彩礼）才有亲，无钱无亲事”的习惯，甚或“普遍实行买卖婚姻”。家住甘肃华池县的封彦贵，于1928年将其女封捧儿（5岁）与张金才的次子张柏定为“娃娃亲”。1942年5月，封彦贵将女儿换取高价彩礼许诺给张宪芝之子为妻，后经张金才告发被华池县政府撤销。1943年3月，封彦贵又将女儿换� ....
