Former accused wins more money as judge laments underfunded Justice system

A civil judge has cautioned that the justice system is underfunded and significantly under-resourced and will continue to face “embarrassing” situations if action is not taken to fix the problem.Justice Cecil McCarthy raised his concern on Wednesday as he awarded another $60 000 in compensation to former murder accused Pedro Deroy Ellis whose constitutional rights were breached, and also praised his lawyer for taking on the State in such matters.He further suggested that Ellis’ victory in this matter and other cases against the State should spur the powers that be to address “a very difficult phase in terms of the administration of justice”.The quantum of the award to be paid to Ellis was handed down just under two weeks after Justice McCarthy ruled that the former accused’s right to a fair hearing within a reasonable time as well as his right to bail had been breached. ....

Long trial delays unacceptable - Barbados Today

President of the Barbados Bar Association Rosalind Smith-Millar has joined the chorus of calls for court cases to be dealt with in a timely manner. However, she warned, all cases are different and cannot be held to the same timeline.Speaking on the recent decision by Justice Cicely-Chase to award murder accused Larry Patrick Agard $95 000 in compensation for the 14-year delay in having his matter heard, Smith-Millar agreed that such a significant delay was unacceptable.She told Barbados TODAY, the justice system needed to be more efficient.However, she suggested that all cases were different and therefore to attach a timeline might be difficult.“I think we need guidelines but I don’t think it could be feasible to have hard and fast rules because every case is going to be different, every investigation is going to have its own path and require its own timeline, but I do think that there must be a greater effort to ensure that accused persons have their trials in a timely manner… ....
