Apple Loses Copyright Claims in Lawsuit Against Corellium

Corellium, a mobile device company that supports iOS, this week won a significant victory in its legal battle against Apple. Apple last year sued Corellium for copyright infringement because the Corellium software is designed to replicate iOS to allow security researchers to locate bugs and security flaws.

The Washington Post, a Florida judge threw out Apple s claims that Corellium had violated copyright law with its software. The judge said that Corellium successfully demonstrated that it operates under fair use terms.
Weighing all the necessary factors, the Court finds that Corellium has met its burden of establishing fair use, Judge Smith wrote Tuesday s order. Thus, its use of iOS in connection with the Corellium Product is permissible. ....

Corellium, a start-up co-founded by husband and wife, Amanda Gorton and Chris Wade, made it possible to run ‘virtual iPhones’ on desktop computers and were pulled in a legal battle with Apple last year. Fast forward towards the end of 2020, a Florida judge has ruled that the start-up’s business practices were in fair use, giving Corellium a sigh of relief, for now.

Last year Apple sued Corellium for offering an iOS simulator. Corellium’s software helps developers and security researchers discover bugs and vulnerabilities on iOS. Apple sued the company citing copyright infringement. Apple has lost the claims as the court allows Corellium to continue operation.
Apple claimed Corellium had infringed upon its copyright. However, the Florida judge was not convinced by Apple’s claims. The judge says, “Corellium has met its burden of establishing fair use.” In other words, Corellium has successfully demonstrated that it is using the resources without violating the fair usage policy. ....

Apple’s lawsuit against Corellium has been partly thrown out
Back in August of last year Apple filed a lawsuit against the virtualization software company Corellium, arguing that the product infringed its copyright and later adding claims that Corellium’s product violates the DMCA.
While the DMCA claims will still need to be settled in court, a judge in Florida has tossed out Apple’s copyright claims.
So what is Corellium? To over simplify it, Corellium allows security researchers to spin up a virtualized ARM device (including iOS devices) in a browser and take a
