What does that mean? there is two forms of there is two issues when you have a defendant who is charged with a criminal offense. one is are they psychologically competent to stand trial and aid in their own defense and understand the charges against them. that is different from an insanity defense. the judge sends him for a competency exam and the doctors say he can t assist in his own defense, he is crazy and has amental illness and cognitive disorder. that doesn t justify his release. if you can t assist in your defense i understand that and get that but to indicate you are not a danger to the community, i don t know how they got that. judge jeanine: i m trying to have the viewers understand the guy first is held in a hospital for being incompetent meaning not able to assist in his defense. and then and guys we have a lot o of years between us here in law enforcement. all of us have been in law enforcement, right? the shrink says he will never be competent, judge, he has to ....
