Ago here in the neighborhood of penn north. you will see behind me here there is a couple protesters on one side directly across the street here from the cvs which is where all the looting took place. you see it boarded up. four blocks up the road that s where freddie gray was picked up back in april of 2015. you see the crowd just behind me% disperse, but there are more police officers out here trying to just simmer down the tensions because it feels very similar to april. people out here are are angry. they feel that justice wasn t served. when we speak to these folks out here they say tonight is not the night. if anything is going to happen in baltimore is when the state s attorney office marilyn mosby decides whether, in fact, they are going to retry the case. and everyone here is just walking on pens and pins and needles waiting to hear if porter will go back on trial. greta? thank you. we will take you back there ....

To me, that it the states attorney is going to try this case again. allóa right. well, she may want to rethink this one out. now, i assume and tell me what the docket is like there because you try cases there. there is no likelihood that this case will now be the next one up in line? they will go to one of the other officers, right? this will probably be put at the back of the line? i don t really know, greta, because both sides are prepared to try this case again immediately because they know everything. and they learned a lot during the trial and i think the prosecution will make adjustments and the defense will make adjustments so that the next trial will be significantly different in terms it ofyysé what evidence gets presented and how it gets presented. all right. why did the prosecution fail to meet its burden of proof to all those jurors? what was the failing, do you think? well, we would have to speculate about that. and unless we were sitting there and listening to a ....

Here to cover the freddie gray trial. leland, thank you. and right now the lawyer for the freddie gray family billy murphy joins us to go on the record. good evening, sir. hi, greta. how are you? i m very well. have you spoken to the prosecutor tonight? no, i haven t. what are your thoughts on the mistrial?wb mistrials happen in about 5% of the cases that are tried in the united states. it s not at all unusual for highly contested cases to result in mistrials. and in about 70 % of the time when a case is tried again, after a mistrial, there is conviction. and thatç all goes well for justice in this case. well, i don t know if i agree. in fact i don t agree with that because i don t think we try statistics. the fact that you say 70% i don t know if that s a true story or not. i would be very worried if i were the prosecutor tonight ....

Find in some jurisdictions there are higher and in some jurisdictions there are less and in some jurisdictions there are more. this is an individual case. and it s going to be tried in front of a fresh jury. that jury will have its own view of the evidence and the law. and that s how it should be. what we usually say to prosecutors after they keep trying failed cases give it a rest you don t have the evidence and the community is telling you in the form of the jury. we will see, billy. it will probably be retried. maybe it will turn out differently. i wouldn t feel good if i were the prosecutor tonight but i do appreciate you coming on and joining us tonight. thank you, greta. back out at the streets of baltimore,ño fox 5 dc reporter marina morocco is there. where are you and what is going on? greta, we re right at the epicenter where it all started nearly eight months ....

Mean a second jury won t agree. billy, i tried cases for 12 years down here in d.c. i have seen all sorts of juries. and when a prosecution gets a hung jury after the prosecution has stood up and said we can prove this case yard and then it falls apart and they walk out of the courtroom with a deadlocked jury and a mistrial, that is a loss forj and there is no nobody that claims that one is aq!h win for the prosecution. well, i don t think either side won or lost. i think that given that this case is going to be retried, it s going to be on a clean slate. there are going to be 12 different jurors. and you don t know any more than i to react to this case. bill, have you tried criminal cases. come on. billy, be honest about this one. billy, be honest about this. hey, greta, i m never going to accuse you of being dishonest and i don t think you ought to accuse me of being dishonest. the figures are pretty clear. i did some research before ....
