Brody I. Murbarger appeared in Wayne County Court on Friday. In front of packed courtroom Defense Attorney Christian Baril moved for a Motion for a Judgment of Acquittal or a new trial; stating that his client was unable to receive a fair and impartial verdict in Wayne County. Among the several reasons for the motion, Baril cited local and national media coverage, social media, and rumor; claiming Murbarger was convicted of murder in the public eye prior to jury selection. Other reasons included witness testimony being hearsay evidence, causing a bias among the jury. The defense also argued that text messages read in court held no relevance to the case, serving only to further bias the jury. Appearing in court for the State of Illinois, Michael Falagario, along with Myra Yelle-Clark, argued that jury selection was properly handled by the judge, stating that out of over 50 potential jurors interviewed 14 impartial jurors were selected. Fairfield Water Dept employees will be flushing hydrants throughout the city through Friday, October 7. This is done each spring and fall to test the hydrants and help keep your water supply clean and pure. The City of Fairfield is required by ILL EPA to inform residents of the possible lead content in the water supply during hydrant flushing. While flushing the hydrants, you may notice that your water may be temporarily discolored. While flushing occurs, you may also experience a dip in water pressure, and it might affect the lead plumbing in and outside your home, if your home is equipped with lead plumbing. If your water is discolored, it does not mean it is unsafe to drink. It just means there is a temporary increase in the concentration of iron within the water. While lines are being flushed, residents are urged to check for discoloration of your water before doing laundry or similar activities. Wayne County Circuit Judge Michael Molt has taken under advisement two motions filed by the attorney representing first degree murder suspect Brodey I. Murbarger. Murbarger is awaiting trial on multiple charges related to the disappearance and murder of 15-year-old Megan Nichols of Fairfield. On Tuesday, Murbarger's attorney, Christian Baril argued a motion to move his client's trial out of Wayne County because of too much pretrial publicity. He also filed a motion to sever charges in the case. Murbarger faces multiple charges related to the alleged murder as well as a number of criminal sexual abuse and home invasion charges. Murbarger's attorney wants a jury to decide those charges separately. The motion to sever charges will be argued during a hearing set for August 25. In support of his motion for a change of venue, Murbarger's attorney submitted five separate exhibits to the court for its consideration.
