BREAKING NEWS: The New Chinese Patent Law Was Finally Announced After 12 Years - Intellectual Property

After 12 years waiting, the 4th version of the Chinese
Patent Law with an aim of further motivating innovations and
improving the mechanism for cracking down patent infringements was
finally passed by China s top legislature on October 17, 2020.
The amended Chinese patent law will take effect on
June
1, 2021. We outline some of important changes

The new Chinese Civil Code (the “Code”) has been passed by the 13th National People’s Congress on 28 May 2020 and is due to come into force on 1 January 2021. The Code has maintained the structure and main concepts of existing PRC laws, but seeks to enhance existing PRC laws by providing further clarification by way of the detailed articles drafted. The Code consists of 1,260 articles and seeks to regulate the various aspects of civil society, including contracts, torts, private property, etc.

To nurture a more protective and encouraging environment for innovation which is key to economic transformation and development, on November 11 2020, China promulgated the amended Copyright Law [2020 amendment], which will become effective on June 1 2021. The first Copyright Law was enacted in 1990 and was subsequently revised respectively in 2001 and 2010.
To accommodate new forms of works generated from frequent technology advances and innovation, Article 3 of the 2020 amendment incorporates a catch-all provision – other intellectual creations that satisfy the characteristics of works. This will allow courts in individual cases to determine new forms of protected works.
