For many years, the Jacksonville Sheriff’s Office and our courts have struggled with how to handle individuals charged with non-violent misdemeanors who also suffer from severe and persistent mental illness. These individuals are often arrested for minor “nuisance” offenses such as trespassing, breach of peace, sleeping in public or the open consumption of alcohol.
They are booked into the jail as the result of their arrest, but due to a lack of community alternatives their mental illness is never fully addressed. As a result, some are released after being sentenced to the time they have served, and others remain in jail for weeks until it is recognized that their offenses are largely due to their mental illness. Over time, it was common for those with mental illnesses to cycle in-and-out of our jails for repeated nuisance offenses our jail system developed the undesired reputation of be ....

Ex-Jacksonville public defender Matt Shirk disciplined for ethics lapses


Jacksonville s former public defender may lose his right to practice law for the next six months after filing a voluntary guilty plea for ethics violations committed when he held the job as revealed in a Times-Union investigation.
The Florida Bar said Shirk agreed to the suspension in a conditional plea in an 11-page document, which will be presented to the Florida Supreme Court for a final decision. If he is suspended from practicing law, he must have  proof of rehabilitation prior to his reinstatement. He also is required to pay for the disciplinary costs.
Shirk is a private attorney in Jacksonville, handling criminal defense and immigration law. He could not be reached for comment following a text message and call. ....

JACKSONVILLE, Fla. – Because of a surge in reported COVID-19 cases during the holidays, the presiding judge of the Fourth Judicial Circuit has suspended jury trials and in-person court proceedings until Feb. 22.
The Fourth Judicial Circuit includes Duval, Clay and Nassau counties. Any jury trial scheduled for Feb. 22 or after may remain scheduled pending further notice, according to an email.
During the suspension, there will be no in-person proceedings in any courthouse facility. This means families waiting to get justice or find closure will have to wait even longer. ....

The ex-wife of a former Jacksonville Sheriff’s Office detective accused of murder is scheduled for an expected plea deal Friday.

JACKSONVILLE, Fla A plea deal may be imminent in the case of a former Jacksonville Sheriff’s Office detective and his wife charged in the murder of a convenience store owner in the late 1990s.  
According to a new court filing in the case, Melissa Jo Schafer the ex-wife of retired JSO Det. William “Billy” Baer is scheduled for a “disposition” Friday. The case had been scheduled for a routine pre-trial hearing on Wednesday, but was moved Tuesday and slated for formal resolution, which is called a “disposition.”  ....
