position sometimes change their mind? yes. nothing could sort of focus the mind quite like an indictment. i ve seen people who swore they would never flip and cooperate but they did. but the optimal time, best time for weisselberg and prosecutors has already passed. you re of more assistance to prosecutors the earlier you come in. we re already now into the charging phase. so people can and do cooperate after they ve been charged, after they ve been convicted, after they ve been sentenced. but the chances in the benefits just decline with time. eli, thank you, laura, as well. good to have you both. still to come, president biden will arrive in surfside, florida, this hour and we re expecting a briefing from the fools there on the latest on the deadly collapse. we ll take you live to surfside next. and bill cosby waking up a free man this morning after his conviction was over turned. we ll speak to a woman accusing

wants to testify. he wants to tell his story and i don t think it would be very favorable for the president. barbara, is it bolton, or are there any other cards that democrats can play in the senate that could change this dynamic? i think we need to keep in mind there s two phases here, right? the senate is where the trial is. are we ready to vote on articles of impeachment? i think yes. this is like the charging phase in a criminal case, grand jury. all you need is probable cause to believe that you are advancing to the next phase. so, in the next phase, that s where you can have additional witnesses like a john bolton come testify. so there with a subpoena, perhaps, he could be a powerful witness. but i don t think they need him at this phase. i think the time has come to call to question, as you would say in parliamentary procedure, a vote on the articles of impeachment. there s probable cause to believe that the president has committed an impeachable offense, be impeached.

i find it such a cynical ploy. it s taking advantage of the public s certain knowledge of rights and twisting them that they apply in the impeachment process this is akin to the charging phase in the criminal case. constitution provides certain rights in a criminal case. it s not applicable in impeachment. even if it were, it s not applicable in the charging phase, only in the trial phase. he will get his trial if there s an impeachment before the senate at a different stage. the idea that he has a right to confront witnesses or call his own witnesses is just not accurate. and so claiming that he is not getting his due process rights and attacking the process is what people do when they don t have a good defense on the substance of the charges, and i see that as what s going on here. former u.s. attorney barbara mcquaid, thank you.
