State Judge Carolyn B. Kuhl will reportedly allow lawsuits in California that allege that social media companies’ negligence causes harm. Bloomberg writes that the judge ruled that neither free speech laws nor Section 230 shield the companies from negligence claims using the premise that the platforms’ design features, rather than their content, harmed the plaintiffs. Judge Kuhl referred to the harms as “forseeable and substantial.”
