Seattle officer who forgot stun gun, fatally shot volatile woman is still facing lawsuit

SEATTLE (Legal Newsline) – Officers who shot and killed a Washington State woman they say came at them with a knife will still have to face claims from the ensuing lawsuit.
That’s because the Washington Court of Appeals ruled Feb. 16 that there remain open questions surrounding the liability of officers Jason Anderson and Steven McNew over the death of Charleena Lyles.
Lyles frequently called Seattle police to her apartment building and had begun acting erratically, according to her sister. She once held a pair of metal shears when officers were at her apartment and told them they wouldn’t be leaving and that she wanted to morph into a wolf and clone her daughter. ....

U.S.A. –-(AmmoLand.com)- A Washington State Appeals Court panel has unanimously held that a so-called “safe storage” ordinance adopted by the City of Edmonds and challenged by the Second Amendment Foundation, National Rifle Association and three private citizens violates the state’s 36-year-old model preemption law.
The ruling is a “significant victory for Evergreen State gun and privacy rights,” said SAF founder and Executive Vice President Alan M. Gottlieb. The case is known as Bass v. City of Edmonds. ....

Appeals court rules Charleena Lyles wrongful-death suit against Seattle police can proceed

A wrongful-death lawsuit over the 2017 killing of Charleena Lyles by two Seattle police officers can move forward again, after a state Court of Appeals opinion published Tuesday reversed a judge’s earlier ruling to dismiss the lawsuit’s negligence claims.
In the opinion, a three-judge appellate panel also reversed King County Superior Court Judge Julie Spector’s January 2019 ruling that barred declarations from three experts two police use-of-force experts and a forensic psychologist retained by attorneys representing Lyles’ estate, and said there were genuine issues of material fact best left to a jury to decide. ....
