reporter: cnn has not been able to confirm where the officer is but as locke begins to stand, three shots. the officer had to make a split-second decision to assess the circumstances and determine whether he felt like there was an articulable threat. that the threat was of imminent harm. reporter: locke s family said he was in legal possession of a firearm when he was shot. the family and their attorney criticized police procedure. no lawful gun owner could have survived this situation. this is the definition of no-knock. seven seconds. seven seconds. that s it. and amir had no choice. reporter: it s unclear if this particular breach was originally designated as a no-knock warrant but attorneys also took issue with the timing before the shooting. police, search warrant! there s no announcement prior to entering that threshold. and they give amir no time to save his own life.
