CNN New Day With John Berman and Brianna Keilar July 7, 2024

oath keepers to stay on the outside and stay fully armed and prepared to go in armed if they have to. if it kicks off, you rock and roll. that was oath keepers founder stuart rhodes. you hear that audio, why have prosecutors introduced that? what do they think it proves? this audio is damming according to the doj s case here, these are conversations between the group that sound like they re specifically planning violence in response to political transfer of power and that s obviously the crux of the government s case in this trial. but i think on the defense side, there are obviously going to be some holes that can be poked in that audio and that s going to be the question here, whether the prosecutors can reach that proof beyond a reasonable doubt when there are questions about the vagueness of some of the comments in there. we ll talk about the defense in a second. there s also sound of them talking about weapons. listen. pepper spray is legal, tasers are lega ....

MSNBC Andrea Mitchell Reports June 4, 2024 16:04:00

Count of illegal retention of national defense information, count 32, is in some ways the most important in that the bedminster tape that we all knew about and that you referenced, andrea, is now not just described in the indictment, but in this new superseing indictment, that is the actual charge, meaning that the government now has a tape recording of the former president admitting the fact he had this document and that it was classified. he says, it is secret and that he could have declassified it if he was still the president but cannot. every prosecutor would love to have a tape recording of the defendant on tape admitting to the crime. that is what the government now has with this new superseding indictment. it s not just other crimes evidence, background evidence, it s actually the it s ....

MSNBC The Beat With Ari Melber June 4, 2024 22:17:00

This indictment clears that up. because they say that that indictment, although it was in bed minister for some time, was also in florida. in other words, the illegal retention was in florida. that may be something new that they discovered and were able to pin down after bringing the initial indictment, so they then had the ability to add it to the florida case. but why is it so important? before we get to sort of why they did it now, it is so important because that tape recording is now going to substantiate an actual charge. it s not just background evidence or other crimes evidence. that tape recording is something that the jury can hear and be told, that tape is with respect to this charge. if you re a prosecutor, you have the defendant on tape talking about the crime. can t get any better than that. so that s why i think it s a really important addition to ....

CNN New Day With John Berman and Brianna Keilar June 4, 2024 11:04:00

Get this and go through and not be charged. when you hear the background evidence, i think the jury is going to be very alarmed and apalled by the significant amount of planning and conversations that went into this. the defense, i believe this is the case, these recordings are about getting the oath keepers to washington not for january 6th, for an event in november. so how much does that matter and what else will the defense lean into? that s right. whenever you have a prosecution case, it s very strong on their opening statement and then the defense s job is to poke holes and put any sort of reasonable doubt into context, dates, specifics, language that s used. if they can convince the jury there s some question about the intent, the date, or what the plan was, that s difficult to secure the conviction on those charges. does the date matter? does it have to be in regards to a specific date? that date doesn t matter on its face, but it plays into the ....

Do we think that even people who see those images are not going to be moved to back this military strike? we ve already seen video images of people suffering under chemical gas attacks. i think the issue is how much and how credible is the evidence linking this to assad directly? there s an interesting op ed today in today s new york times by alan grayson. and he said he has no real way of assessing the quality of the evidence both the public evidence and the background evidence that he s unable to share with other people. he s calling for the administration to do a better job of saying where the sources of the information he says the evidence is not persuasive. he needs to be able to check it more. so video is not enough. and that s the problem. the intelligence community will say, we have intelligence. then the next question is, as ....
