Defendant is asking to be reversed. it is simply a potential defendant coming in saying, hey, if you let this go forward, it will cause me harm. and so it is an unusual posture for the supreme court to take these kind of faces up. there are some constitutional questions that they raise in their motion. i think they are probably appropriately raised, at least. but i really think what you are seeing is an effort to make a very clear and very thorough record of proceedings in the courts below. because this case is going to wind its way through a rear appellate court system between here and washington d.c.. and so that is really what i think the purpose of the motion is. do you think one of the reasons that the judge has not ruled on it is because it might be, i don t know, poppycock? it very well could be. but that ought to be a pretty easy to deny the motion as opposed to letting something sit. and judges, they don t like to let things linger. and they usually are pretty ....
