Brazil: Federal Senate Approves Inter-American Convention Against Racism, Racial Discrimination, and Related Forms of Intolerance
According to article 1 of the convention, acts of racial discrimination may be based on race, color, lineage, or national or ethnic origin and are defined as any distinction, exclusion, restriction or preference, in any area of public or private life, with the purpose or effect of canceling or restricting the recognition, enjoyment or exercise, under conditions of equality, of one or more human rights and fundamental freedoms enshrined in international instruments applicable to the party states.
As the legislative decree concerns an international agreement on human rights and article 5 (§ 3) of the Federal Constitution states that international treaties and conventions on human rights are equivalent to constitutional amendments, it does not require presidential approval and will be promulgated shortly.
