"action news" has learned that a correctional officer pulled his gun, on a newly released inmate. chopper six over the house of corrections on state road in bustleton just after 11:00. police say 26 year-old jamal bennet tried to carjack the officer right after his release from that correctional facility. the pair struggled, the 66 year-old officer was then to the ground. he reportedly pulled out his own, private weapon and fired one shot hitting bennet in the chest. >> it seems like he was starting crime over again within minutes being released attempt to go carjack this off-duty correctional officer. it is somewhat bizarre but the correctional officer is in stable condition and at this time it appears that the 26 year-old who was shot, although he is critical it appears he will survive. >> police say bennet had been in and out of the philadelphia prison system seven times, he had just released after serving time for a probation violation. new information to tell but this morning a burn victim is being treated at temple university hospital after an incident in the cities juniata section. according to medics the man had second degree burns over nearly half of his body, but when fire fighters arrived on the 4200 block of palmetto street, there was no sign of a working fire and this morning, investigators are still trying to figure out how that man was burn. president donald trump is speaking out about rob porter his former aid now at center of the domestic abuse allegations. while another man close to the president his chief of staff, is offering to resign, abc's tara palmer has more. >> reporter: president trump defended his top aid rob porter who resigned as staff secretary after allegations of spousal abuse by two ex-wife's became public. president trump wished him well despite evidence of domestic violence including photos and police report. >> he said very strongly yesterday that he is innocent, so you'll have to talk to him about that but we absolutely wish him well. >> reporter: president made no mention of the women accusing porter of domestic abuse but commented on porter's state of mind. >> he is also very sad. >> reporter: chief of staff john kelly under fire about what he knew and when he knew it, earlier this week kelly called porter a man of true integrity and honor but after photo surfaced of porter's first ex-wife with the black eye kelly distanced himself. abc news is the president is furious over how crisis was handled so much so he is considering replacing his chief of staff, in the past 24 hours sources say kelly is willing to resign but white house spokesperson denied that and said kelly's here to stay. porter's second ex-wife suggested that the white house may have known all along. she said she told fbi everything. >> i was, very candid, and frank, and detailed with them, about my marriage. >> reporter: there are new questions over how rob porter was able to do his duty as staff secretary with a interim security clearance. white house says fbi is looking into it but he is not only white house staffer with a temporary security clearance , our sources say jared kushner is also using a interim security clearance. tara palmeri, abc news, washington. meanwhile president trump has given republicans an edge in the refusing to declassify memorandum he written by democrats on the house intelligence committee. document is intended to rebuck claims of the surveillance abuse by fbi as alleged in a memo written by republican members of that committee. trump argues the g.o.p. memo cheers him in connection with the russia investigation. 5:06. pennsylvania top republican lawmakers handed over newly drawn congressional maps to governor tom wolf, the districts were ruled un constitutional for overtly favoring republicans. governor wolf has until thursday to inform state supreme court when accepts the state legislator's new map, if not, justices have indicated that they will create their own. here's what we are told about the new lines, it keeps nearly 70 percent of residents in their current district, 62 cities and counties that are now split up, have been stitched back together, the sprawling seventh district which now contains part of the delaware county, chester county, montgomery county, bucks county and lancaster county of been made far more compact, and montgomery county would be divide add monk four districts rather than five like it is currently. map maintains one district in philadelphia where minority voters make up majority and increases minority population in a second, city district. all right. the area is slowly, recovering from that incredible eagles super bowl parade and today more of the players will be meeting the fans. >> corry graham, rodney mc cloud, goode and others will be appearing at the plymouth meeting mall. >> they will be on hand at sports until 10:30 to noon. >> jason kelce, spoke about his epic rant at the super bowl parade.
