that breaking news. the democrat, doug jones, defeats roy moore in the deep red state of alabama and, guys, make no mistake about it. may have been in the state of alaba alabama but it will play out all across the country. >> jones saying last night we have swn that we can be unified but still no concession speech from roy moore. >> the final vote, we must say, was extremely close. it appears that women played a crucial role. they made the difference for jones over moore. >> more fallout for the me too movement and tom llamas in montgomery with the latest. good morning, tom. >> reporter: george, good morning to you. let me set the scene. it was 9:30 local last night when the moore came room suddenly fell silent. the campaign knew they were in trouble and the campaign manager asking everyone to pray but it wasn't enough. those accusations and doug jones' tireless campaigning put moore away. this morning for the first time in 25 years, alabama is sending a democrat to the u.s. senate. >> we have been at crossroads in the past, and, unfortunately, we have usually taken the wrong tonight, ladies and gentlemen, you took the right road. >> reporter: doug jones beating republican roy moore in one of the most conservative states. >> we have shown not just around the state of alabama, but we have shown the country the way that we can be unified. >> reporter: moore unable to recover from accusations he molested two teenage girls when he was in his 30s. accusations he denied but blamed for for not coming out on top. >> part of the problem with this campaign is we've been painted in an unfavorable and unfaithful light. we've been put in a hole. >> reporter: moore refusing to concede telling his supporters the race wasn't over. >> realize when the vote is this close that it's not over. >> reporter: signaling he would favor an automatic recount in jones' margin of victory is less than half of 1%. currently that margin is 1.5% with over a million of the ballots counted. >> we'll take it on tomorrow. >> reporter: his biggest supporter, president trump, accepting defeat tweets congratulations to doug jones on a hard fought victory and the alabama gop putting out this statement saying now that this race has ended may this holiday season of peace, love and hope resonate with everyone regardless of one's political affiliation. and as of last night, the secretary of state here in alabama said a recount would not be likely. now, the president weighing in just moments ago again. he just tweeted this. let's put it up on the screen, sounds like the president may have buyer's remorse. the reason i originally endorsed luther strange and his numbers went up mightily is that i said roy moore will not be able to win the general election. i was right. roy worked hard but the deck was stacked against him. luther strange's numbers did not go up mightily after that. i should point out. matthew dowd, our chief white house correspondent jonathan karl and senior congressional correspondent mary bruce. so many ramifications. your biggest? >> i have to say what the president said sounds like the guy that cheats off another guy on a test and gets it wrong and blames the guy for the wrong answer on the test. 2018, new jersey, virginia, canary in a coal mine. a bunch of sick miners. but for the elections in 2018 it soaps the door for the democrats. it's a realistic opportunity. >> jon, the ramifications for president trump, he won the state of alabama by 28 points last time around. last night the state was divided over whether or not they favored him. >> reporter: george, this is a spectacular defeat for the president, and when you think about it, alabama is one of the most republican, deepest red states in the entire country. the president is now 0-2 in this senate race. he supported the losing candidate in the primary. now the losing candidate in judge moore in the general election. and the key worry here at the white house is that this will be a harbinger for the midterm elections, that this could mean that the president will face spectacular losses in the house, maybe even lose control of the senate in the midterms. that's what one top adviser to the president said to me was their fear here this morning. >> immediate consequences on capitol hill. the senate republican majority will drop by one on a ballot january 3rd and won't impact the tax likely but will affect everything next year. >> reporter: with jones' victory the republican majority in the senate dwindles to one vote. li republicans harder to get done and could put pressure on mitch mcconnell to work more with democrats. in the short term republicans are hoping this doesn't impact their big fight on tax reform and are optimistic they can get it done before christmas and doug jones is not expected to join the senate until next year but that's still not a done deal yet. >> you talk about the canaries in the coal mine for next year, one of the big things we saw was wind, especially moderate suburban, some republicans switching sides voting against roy moore. >> developing phenomenon and started in the aftermath of the election of the women's march that came on and now stronger. republicans are in a deep, deep, terrible position among women voters and among young voters and voters of all colors and sets up a coalition for the democrats of a possibility to win a lot of victories across the country. >> okay, and, jon karl, this is going to increase the pressure on the president. you've seen democrats resignation. many call on capitol hill for his issues, the allegations that women lodged against him to be investigated. >> reporter: imagine what that looks like if democrats control the congress. if the republicans can lose in alabama, george, they can lose anywhere. if the democrats were now in control, those investigates would be front and center, investigations of the president. >> thanks very much. amy, you have more on that now. >> we move on to the other big political story, the growing feud between president trump and new york senator kirsten gillibrand after she called on him to resign over accusations of sexual misconduct. the president tweeting, she would do anything for a campaign contribution. the senator firing back calling it a sexist smear. cecilia vega has the very latest on all of that, good morning to you, cecilia. >> reporter: hey, amy, good morning to you. yeah, the white house says that isn't about sexism. in fact, aides here say if you read the president's comments as a sexual attack, you're the one with a sick mind. the reaction swift and fierce. >> it was shameful. >> low-life behavior. >> a disgraceful, sexist slur. >> nasty, unbecoming of a president. >> reporter: democrats going on the attack in the face of president trump's tweet about new york senator kirsten gillibrand. the president calling her a lightweight and someone who would come to my office begging for campaign contributions not so long ago and would do anything for them. outrage from gillibrand. >> it was a sexist smear attempting to silence my voice, and i will not be silenced on this issue. >> reporter: to the nation's most widely circulated newspaper. this morning "usa today" out with a scathing editorial saying trump is not fit for office and, quote, a president who would all by call senator kirsten gillibrand a whore is not fit to clean the toilets in the barack obama presidential library or to shine the shoes of george w. bush. press secreta s was not sexual. >> many, many people see this as a sexual innuendo. what is the president suggesting? >> i think that the president is very obvious. this is the same sentiment that the president has expressed many times before when he has exposed the corruption of the entire political system. >> reporter: what is he alleging would happen behind closed doors with her? >> he's not alleging anything. there's no way that this is sexist at all. >> reporter: now six democratic senators calling for his resignation and in the house, more than 100 democratic representatives all signing on to a letter saying we cannot ignore the multiple of women who have come forward with accusations against mr. trump. now, the president, of course, has said that all of these women, these accusers are lying. the republican who would decide if an investigation moves forward, trey gowdy says that is not happening and the house oversight committee will not investigate those claims and says he's for an investigation, amy, back to the department of justice where, of course, the president's attorney general would decide. >> all right, cecilia vega, thanks so much. george. we move on to new developments in the russia investigation. this morning we're getting our first look at some of the text messages sent by the veteran fbi agent removed from mueller's team calling the president an idiot and pierre thomas in washington with details. good morning, pierre. >> reporter: these new text messages are embarrassing for the fbi showing senior officials trashing then candidate donald trump. and while it's unclear if their comments had any impact on the special counsel's russia probe, republicans will likely seize upon them as evidence of partisanship within the fbi. this morning, questions about the politics of two former members of special counsel bob mueller's team. abc news reviewed 375 text messages between fbi agent peter strzok and fbi attorney lisa pa unprofessional and candidate donald trump was often the target of their ire. god, trump is a loathsome human page texted march 4th, 2016 the day after the republican primary debate. strzok responded he may win. on the same day strzok texted would he be a worse president than senator cruz. page responded, trump, yes, i think so. >> i'm not sure. strzok, omg, he's an idiot. then page says he's awful. 12 days later page texted, i cannot believe donald trump is likely to be an actual, serious candidate for president. may 4th, 2016 she write, holy expletive, cruz just dropped out of the race. it's going to be a clinton/trump race. unbelievable. in june of 2016 strzok referred to, quote, the absolute bigoted nonsense of trump. republicans on capitol hill have been clamoring for these bias within the fbi. and that it affected the hillary clinton e-mail probe and perhaps tainted mueller's investigation. >> we recently learned that one of those supposedly unbiased investigators on mueller's team was peter strzok. it turns out strzok was sending out anti-trump, pro-clinton messages so he you will got canned. >> reporter: with bob mueller removing him from his team immediately learning of these texts according to his spokesman and page was only on the team a brief period. democrats claim there is no evidence that strzok and page's political views affected the special counsel investigation or the probe of hillary clinton's 345i8s. >> i predicted these attacks on the fbi will grow louder and more brazen as the special counsel does its work and the walls close in around the president. >> reporter: in numerous text messages page and strzok struck democrat oh, god, holder, turn it off, turn it off, turn it off. page responded, yeah, i saw him yesterday and booed at the tv. the year before page wrote, i just saw my first bernie sanders bumper sticker. made me want to key the car. the fbi is now in the crosshairs of a hot political debate. last week the president tweeting the fbi's reputation is, quote, in tatters but fbi director chris ray strongly defended his agent's integrity on capitol hill. >> pierre, the president not only attacking the fbi in tweets, you've got his legal team calling for a new special counsel to look into the investigators. >> reporter: that's right, some republicans and trump's legal team are pressing for another special counsel to investigate this and other potential conflicts of interest. the attorney general has his staff studying the issue but to be clear, george, no one has alleged the fbi agents have committed any crimes. >> okay, pierre thomas, thanks very much. >> all female schumer staffer detailing allegations of sexual harassment. now, i spoke with the former staffer mentioned in these alleged documents and she insists she never experienced any misconduct, never filed a complaint and has, quote, nothing but the fondest memories of her time working with chuck schumer. >> the senator has gone to the police, the victim is going to the police as well about this forgery. several news organizations as you said got these forged documents. do we have any idea who is behind it? >> reporter: no one has any idea who is behind these documents. i've asked that to chuck schumer's office, also to the former staffer mentioned in these documents. they don't know where they came from or >> mary, thanks very much. now to those new allegations of sexual misconduct rocking the food industry. another prominent restaurant entrepreneur is facing claims of harassment as more accusations emergence mario batali. abc's linsey davis is here with the very latest. good morning. >> reporter: good morning, amy. more women and more allegations against mario batali and now the accusations are escalating. it's more than grabbing and groping. some of his accusers allege heavy drinking on his part which they say led to abusive behavior and unwanted advances from a man known for indulging in the kitchen and allegedly beyond. more fallout this morning for mario batali. a man known for cooking pasta to perfection now in hot water himself as "the washington post" details new accusations of unwanted touching and inappropriate behavior at a party in to 10. >> she was a special events coordinator for mario's restaurant in l.a. and she had been bent over a high top table intimate, very uncomfortable way. >> reporter: another woman at the party says a very drunk batali demanded she get into a car and, quote, make out with him. >> it felt like a situation that i was responsible for getting myself out of as quickly as possible. >> reporter: batali gave this statement to "the post" saying i apologize profoundly to the people i have mistreated and hurt. the entire day of events surround the party i was the personification of idiocy, a drunken and idiotic fool. that behavior was horribly wrong, shameful and degrading and there are no excuses. in a "new york times" reports about sexual harassment accusations against the owner of the spotted pig a former manager told "the times" she saw available video of a drunk batali who was drunk groping and kissing a woman who appeared unconscious. this is after he stepped away from his allegations were revealed. abc released a estimating asking him to step away from "the chew" while they review allegations. tuesday his co-hosts addressed his absence. >> we want you to know we take she's seriously and are committed to a safe work environment. >> batali's bad behavior was just about as well known in the restaurant world as his cooking prowess. >> sexual misconduct happens. it's rampant in every tri and the culinary industry is no different. it was finally time and people are able to find their voices and speak up and feel like there won't be repercussions. >> reporter: batali doled out advice on how to combat sexual harassment in the restaurant industry. >> do you think there is a reck reckoning. >> i think it's coming across the board. >> reporter: the chain where batali is part owner removed all his cookbooks and products including his signature sauces with his face on the label and the food network announced it's putting its plans on hold revamp its show "molto mario". >> let's bring in dan abrams for more on this, dan, could mario batali be facing criminal charges with some of these? >> look, in theory, yes, because as we've talked about before, even an unwanted touching can be considered criminal. but you've got two issues here, number one is the possible statute of limitations. we've talked about that before as well as to when these things happen and, number two, whether they've got the desire, the resolve, the information to move forward with possible criminal charges. i think it's very unlikely, the more serious concern for him are civil lawsuits. >> speaking to that because in a statement regarding some of these allegations batali says, acknowledges that some of this behavior occurred and so that the question then is is he opening himself up for civil lawsuits. >> as a sort of moral matter, what he said is the right thing to say. he took responsibility. said it's unacceptable. he doesn't have excuses and as a business. meaning he's now given a statement to a plaintiff's lawyer to say, you see, he's basically admitting that not only has he done this one time, in this was a pattern because he's not even responding specifically to an individual. he is sort of saying as a blanket matter, yeah, you know, this kind of sounds like me but, again, with a civil lawsuit you will face the same question we talked about which is statute of limitations and for this sort of stuff, for example, in new york would range from one to three years depending on what the exact allegation was. >> and not that this is any excuse whatsoever, but talk a little about the environment in which some occurred, the restaurant stress, a testosterone-driven world some may say. >> why i don't think this has come to light. it is an unstructured environment. there's typically not unless you're working forego a major, major department at individual restaurants. and so single people have enormous power and influence and as a result, it can make it harder to michael. the last full day of what had been an epic honeymoon in the bahamas. the carrolls enjoyed the sun and water and swimming with sharks. they loved it so much they decided to do one more shark swim but this time one shark got a lot closer than planned. a romantic caribbean honeymoon ending with this terrifying shark attack. >> pretty much felt like my worst fear was coming true. >> reporter: sarah and evan carroll were celebrating their vows deciding to swim with sharks and evan recording excursion. you see her swimming in the water. her arm extends and then you can hear the shark clamp down on her arm. >> i thought maybe it was evan playing a prank on me. >> reporter: very quickly she realized this was no joke. >> i was able to turn my head and just kind of look in the actual direction and saw that it was the shark and that's when it starred to really hurt and i just tried to break my arm down and swim away. >> reporter: after getting free from the shark you see evan help sarah get back to the dock and out of the water. sarah posting pictures of her arm showing the swollen teeth marks then showing it bandaged up. >> bite marks are like razor cut, very clean and very sharp so made for a quick heal. >> reporter: nurse sharks are known to be easy-going, not aggressive. the couch potato of the shark world. but while nurse shark attacks are very unheard of. >> even though you're just swim ago long and these, you know, sharks typically don't behave that way, you can always appear like food and there's always room for misunderstanding when we're we're in their home. luckily it was our last day and would like to try it again. >> despite that the couple says this won't keep them from swimming with sharks again. they are home now from their honeymoon. their main concern making sure her arm doesn't get infected but totally plan to do it again. >> what did they learn from it. >> i think it's the arm towards the shark that may have felt she was food. >> would you do it? >> no, and if it happened once i definitely would not do it again. >> originally they swam close to a dock so i think probably that might factor in. >> i took my kids swimming with sharks and it's like nurse shark, it's not a problem and always had a i thought i was conquering my fear but i am not going to do it again. >> it's their home. >> i'm literally afraid to go on "shark tank." [ applause ] >> thank you, lara. we have a warning now from the better business bureau about computer caps where people pose as tech support and convince you to pay to fix a problem you don't have and rebecca jarvis is back using deceptive pop-up alerts and phone calls. >> they have exploded in prevalence costing consumers hundred, sometimes thousands of dollars and the worst part is the tactics these criminals are using. they make it look like your computer has a legitimate problem, a virus, malware when really there's no problem at all. you've got your fire wall and anti-virus protection on your computer. so you're safe, right? well, not quite. a new report from the better business bureau says there's been an alarming uptick in people victimized by computer tech scams. thieves posing as technicians claiming they can fix computers when, in fa to fix. their scare tactics make people believe they have to act immediately and anyone is a target. >> come on. >> reporter: 29-year-old amy sowell fell victim to the scam on her microsoft pc a month ago, a pop-up claimed her computer was infected with a virus. >> if i exited out of the pop-up, i would lose all of my data on my hard drive so i called the number which said they were a microsoft partner so i didn't think twice about calling the number. >> reporter: she then gave them permission to gain control of her computer and soon the fake technician on the line convinced her to pay $150 to fix the problem. >> i had this gut feeling that something just wasn't quite right. so i googled microsoft partner and i found out that they were a scam. >> reporter: the better business bureau says pop-up e-mails similar to this are sent to victims. >> this is so common i think it's a whether we'll be contacted by a tech support fraud but when. >> reporter: steve baker is lead investigator on the better business bureau report on tech scams. >> a lot of victims never complain to law enforcement. a lot of people dope even know they've been ripped off. >> reporter: microsoft reports receiving 12,000 complaints every month telling abc news whenever you receive an unsoliciteded phone call or see a pop-up on your computer, don't take the risk, just hang up or close your browser. if you need tech support reach out to our technical support experts at the microsoft answer desk? so that's some advice right there but as he said this is super common. how do we protect ourselves. >> microsoft says they're never going to reach out to you with an e-mail or a pop-up or a phone call to say you have a virus. the best thing you can do if you spot a pop-up on your computer do not click on it. if your screen freezes on your computer rather than clicking around or trying to fix it, shut the computer dow to, if you think there is a scam reach out immediately, record the complaint with the better business bureau, ftc or microsoft and if there is really a problem with your computer, rather than dealing with somebody online go to a store. you could go to a best buy or a microsoft store, microsoft even has a support side, support.microsoft..com where you can ask legitimate questions of legitimate people. >> all right. good advice, thank you. >> thank you, rebecca. and, you know, now to that new health alert about holiday baking. the fda warning that raw cookie dough can make you sick. even if it has no eggs and diane macedo is here with the details. hey, diane. >> just what we didn't need. another reason not to eat raw cookie dough but unfortunatelily this is for real and the fda saysette not only the eggs but the flour and sometimes just handling it can be dangerous. there's nothing like making holiday cookies or even better sneaking cookie dough in the process. even tailor swift can't shake off a cookie dough craving. >> now she's rummaging through the mini fridge and sees some cookie dough and now she's eating some cookie dough. >> reporter: but this holiday season it may be time to ditch the dough. the fda says it isn't just the raw eggs that can make you sick but the flour. >> the concern is that the specific flour that comes from a grain that was contaminated with a bacteria, e. coli, and that has the potential to cause unanimous illness. >> reporter: they linked an e. coli out break to flour. others just handled it. 10 million pounds were recalled. >> look at any flour you have in the house and see if it was on the fda's list of recalled flour. if it was, i would throw that flour away. if you have flour that you've subsequently put out of that bag and into a different container and don't know probably the safest thing go ahead and throw that away. >> reporter: the bottom line, raw dough is a risk but there is good news, experts say there is a way to make it edible but only if you take important step, one, skip the eggs altogether and two, bake the dry flour in the oven before adding it to the batter and then enjoy. all right. i'm glad we were able to end on a good note and have another one for lovers of cookie dough ice cream. most use pasteurized eggs and treated flour so those are okay, too and on that note, happy holidays, everybody. >> enjoy that.
