children at all times. you have to take measures to make sure that a child that age isn't able to leave the residence without you knowing it. >> i just wanted to find out how she got out of the house. >> why do you want to know? >> reporter: the toddler's parents were confrontational when we showed up this morning. sources tell nbc 10 investigators found evidence of heroin and marijuana inside the house. were you using drugs? he did not answer the question and we can't air his response on television. authorities are still investigating what led to the child's death. sources say both parents could face charges, as could their neighbor, because the toddler was able to get to the pool after wandering away from her own home. >> this wasn't here last night. >> reporter: when did that go up? >> 1:00 in the morning. >> those people who own pools have to take every measure possible to assure that small children can't gain access to the pool. >> reporter: we went to that neighbor's house as well. people appeared to be inside but did not answer the door. live in berkeley township, ted greenberg, nbc 10 news. now to your first alert weather. this just in from the national weather service. tropical storm danny has now formed in the atlantic. >> meteorologist sheena parveen is tracking the latest developments for us. >> we do have a new tropical storm just a little while ago, we were saying it was a depression but expecting it to strengthen and it has. tropical storm danny is well far away from the united states. it's right off the coast of the cape verde islands off the coast of africa. you can see how far away it is. it's in the tropical atlantic, maximum sustained winds are 40 miles an hour. it's moving to the west at 12 miles an hour so it's on its way to the caribbean. computer models are pretty much in agreement that it will keep heading west in that direction. as we go through the weekend, the models here, this is the official track from the hurricane center, is forecasting it to possibly become a category 2 hurricane over the weekend as it approaches the lesser antilles which could possibly put it in the caribbean. of course we will be watching for further developments from this tropical storm, further strengthening. over the weekend we will have a much better idea of where this storm may be going. more locally, we need some rain to cool us off from the heat wave we have been in. we have still been in the heat wave. today we have been at 91 degrees so far. tomorrow, we expect to be around 90 but by thursday and friday, we will be seeing a nice break from the heat. that will also come with some showers and storms in the forecast. coming up we will talk more about that and the cooler temperatures ahead as we go into part of your weekend. that's coming up. a prisoner who escaped from a police van in burks county is back in custody. police say the 38-year-old man kicked out a back window, ran into the woods. police found him hiding in a tree about an hour later. the man was in court on burglary and theft charges. he was also wanted in michigan. sexual abuse allegations bring a $5 million lawsuit against a germantown boys and girls club. the mother of a 12-year-old boy filed the lawsuit this week. a counselor at the club is accused of sexually abusing the boy during a field trip to the kimmel center back in may. percy outland was the counselor. the boys and girls club say he's been removed from his position. we spoke to the boy's mother a short time ago. >> i'm very angry and very upset about what happened and that they would allow someone to work in the company and not do a thorough investigation on him to see what he would qualify for. because if they did this would have never happened. >> the lawsuit alleges the counselor was drinking during the field trip and offered children marijuana. the boys and girls club is cooperating fully with the investigation. a dramatic rescue this morning in south jersey. crews had to pull a pair of drivers from their vehicles after a tractor trailer crashed into two cars. skyforce 10 was over the scene on route 322 in logan township. police say the tractor trailer driver lost control, crashed into oncoming traffic and hit the two other cars. the road was closed for more than five hours. it is back open this afternoon. police have recovered the body of a man who drowned in a northampton county quarry. they say 19-year-old jonathan botch was swimming in the martin creek quarry in lower mt. bethel when it happened. this is the second death to occur at the quarry in the township in about two months. back in june, another man also drowned. just this weekend, emergency crews rescued a man at the bangor quarry, which is also in northampton county. eople from jumping into quarries across the lehigh valley. the dangerous dives are illegal in most cases. in june, we told you about police arresting more than ten people for jumping into a quarry in bangor. last month, nbc 10's ted greenberg got app clon up close at the dangers of quarries. unlike lakes, quarries don't become deeper gradually. they will have steep drop-offs of 40 to 60 feet. many of them are also in remote areas with rugged terrain which makes it harder for rescuers to reach. not guilty. that's the plea from congressman chaka fattah today as he appeared in court for the first time since the indictment was handed down. fattah is charged with bribery, money laundering and conspiracy. the indictment alleges the congressman misused campaign money and taxpayer dollars. fattah told a judge today he is innocent and told reporters he will fight the charges. >> i fully expect that when we vet these allegations, that we are going to get to a point in which they will no longer represent any cloud on my very good reputation. >> two of fattah's associates also faced a judge today. robert brand and karen nicholas are both charged in the indictment. they pleaded not guilty. so have bonnie bowser and herbert weederman. congressman fattah is married to nbc 10 anchor renee chenault-fattah, who is referenced in the criminal complaint against her husband. she is labeled as person e and an affiliate of the fattah enterprise. the feds allege renee participated in a scheme to fraudulently sell a car in order to pay closing costs on a vacation home. she is not charged and denies any wrongdoing. renee is on leave from nbc 10. new information on thursday's rascal flatts show on the atlantic city beach. those who paid for their preferred seating will have two separate entrances from the general admission area. this stems from some concert goers voicing frustrations about crowd control issues. and not getting the seats they paid for at sunday's maroon 5 show. a 7 week old budget stalemate continues in harrisburg. pennsylvania governor tom wolf offered a compromise on how to cut long term public pension costs. republicans say wolf's offer false well short of what they want. one of the top budget negotiations is ending traditional pension benefits for most future public school and state employees. republicans want to move them into a 401(k) retirement plan. as pennsylvania's budget standoff drags on, local school officials are calling on lawmakers to get a deal done. delaware county school district leaders gathered today to express an urgent need for lawmakers to approve a budget. the school year is quickly approaching and districts say without a budget, they have no idea just how much money they will get or when they will receive it. tonight a zoning board in montgomery county will discuss if a domestic violence shelter can move into the community. the laurel house shelter would relocate from norristown to east n n norriton. some oppose the plan claiming it will reduce property values. laurel house says it needs an updated facility with more space. a south philadelphia health clinic for the poor will receive $500 and a community impact award. the catholic foundation of greater philadelphia selected the facility to receive that award. the money will help the organization buy equipment and vaccines for their utility clinic. the free clinic in south philadelphia offers lab testing, vaccinations and routine checkups to the poor. because walk-ins are welcome, patients don't have to wait for an appointment. breaking details in to nbc 10, wilmington police have made an arrest in the shooting of a 10-year-old boy. we are getting an update right now from investigators. we will bring you the newest details coming up at 5:00. also, a mystery solved. a tombstone found at a new jersey bus station. police have figured out who it belongs to. plus the government asked for help and two new jersey workers came to the rescue. how they are helping us hang up on those annoying robocalls. the white house hired its first openly transgender staff member. it's a move being hailed as an important step for the lgbt community. today the obama administration announced the appointment to the outreach and recruitment director for presidential personnel. she previously served as a policy advisor for the national center for administration. a second democratic senator has come out in opposition to the iran nuclear deal. today, senator bob menendez from new jersey announced he is rejecting the agreement in his home state. the senior member of the senate foreign relations committee said he's opposed to it because iran has violated a number of u.n. security council resolutions while advancing its nuclear program. senator menendez added that this is not an issue of whether he supports or opposes president obama. you might recall chuck schumer of new york was the first democratic senator to come out against the deal. he said it has too many flaws. president obama has pledged to veto a congressional resolution of this approval should it happen. eliminating those annoying robocalls. two middlesex county men are getting national attention for an app they created. they won a competition put together by the federal trade commission. they developed an app to block robocalls. the calls are made to cell phones and land lines to defraud customers or steal their information. the app is called robokiller and identifies automated voices and allows the receiver to block the call and report it to police. the two men received $25,000 to go toward developing that app. this saturday it's the battle of the birds in philadelphia. the eagles take on the ravens in their next preseason game. >> tomorrow we will get a 90 degrees for most of the area. so the heat wave continues with our temperatures hitting 90 today. storms return in the forecast so as we go into the next few days rain chances are going to be increasing. when you see the rain, that will at least help cool your temperatures down. we are also watching the tropics. we have a new tropical storm pretty far away but still, it's one of the named storms, one of the few so far this hurricane season. i will show you that in just a minute. mostly cloudy in philadelphia, clouds will keep increasing overnight tonight. patchy fog, too, more clouds around tomorrow. temperatures are still pretty hot, around 88 degrees, feeling more like the low 90s across the area with the humidity. it's 90 degrees in allentown, 87 reading, 89 in pottstown, 86 wilmington, mid 80s for much of new jersey. also delaware. still pretty hot and humid. tonight is going to be warm and humid, too. that will really help with the fog that we expect at least through part of the area. right now we are clear but we do have showers and storms off to our west. most of these storms appear to be moving straight from south to north so i think we will miss a lot of this. the best chance would be in our extreme western counties like lancaster, possibly near berks county. most of the area will be staying dry for the rest of tonight. lot of moisture around the northeast and also off to the west around chicago. that's rain we can expect as we go from thursday into friday. i think that will be the best rain chance across this week. we look way down in the atlantic. this is tropical storm danny. this is far away, right off the western coast of the cape verde islands which is right off the coast of africa. it hasn't even entered the caribbean yet. it's still in what we consider the tropical atlantic. max winds are 40 miles an hour, barely making it a tropical storm. it's moving to the west at 12 miles an hour. it's moving in the direction of the caribbean right now. over the weekend, we could easily see it heading into the caribbean as well. now the national hurricane center track here continues moving it west saturday and sunday, possibly strengthening it to a category 2 hurricane. as of now, conditions could be pretty favorable for this tropical storm to develop but of course, over the weekend, still very far away from the united states even. we'll have a much better idea as we get closer on that. here's a look at future weather. locally with our rain, we don't expect much as we go into the overnight hours tonight, but by tomorrow morning, 8:00 a.m., pretty different than what we have around now. more clouds moving in. we could see some morning showers for part of the morning commute and then through the afternoon, we will still have those rain chances but they could be mostly west of the philadelphia area. that's by 5:00. i don't think we will have widespread rain tomorrow. then we go into thursday, rain chances are still going to be around, especially later in the day thursday and we could have a line of heavier showers and storms move in as we go into friday. so once that rain actually gets here thursday and friday, our temperatures will start to drop down into the 80s so our heat wave will get broken. the cooler temperatures are coming and until that rain moves by it will still stay humid outside. tonight, warm and humid, patchy fog late tonight. mid 70s for the low in philadelphia, upper 60s north and west. tomorrow, it will be another humid day. hot and humid, chance of some thunderstorms in the morning hours, we could see some, too. temperatures still around 90 degrees. it's still going to be pretty hot through part of the afternoon hours but if we do hit 90, we will still be in the heat wave. thursday and friday, we expect to be out of the heat wave. temperatures in the mid 80s into the weekend, looks great for the eagles saturday. less humidity, temperatures in the mid 80s. saturday will be really nice. by sunday, the humidity comes right back and it stays around as we go into next week. preparing for the pope and all of the visitors who come with him. how one town in delaware county is stocking up on a medical device to keep those visitors safe. plus, hitchbot didn't make it through philadelphia. but what about popebot? who is behind this new machine and where it's been spotted around the city. a delaware county township is installing life-saving equipment all over town. automated external defibrillators are used in the case of cardiac arrest. ten of the machines will be placed throughout the township in case visitors and residents should need them. the machines will also be available to the hundreds of thousands of people attending the upcoming papal visit. consider it a shot at redemption. the demise of hitchbot in philadelphia was the black eye for the city of brotherly love. now thanks to radio station wmmr, a second chance. it's a holy father inspired robot. hitchhiking its way across the delaware valley. the goal? to prove to the vatican it is safe for the leader of the catholic church to visit the region. so far, pope-bot has been spotted in manayunk, malvern and exton. he was last spotted in levittown around 4:00. hitch-bot was a similar robot built by two canadian professors. strangers picked it up, took it for a ride, posted pictures with it. it made its way across three countries and landed in new york city. its final ride was to philadelphia where unfortunately, it was found in pieces. >> hope this will do much better. relief in sight? >> yes, there is relief in sight from the 90s because we are still in the heat wave. it's not today. today we still feel like the low 90s when you factor in the humidity. right now we are at 88 degrees in philadelphia, 89 northeast philly. 90 degrees in allentown. fu want some relief, you have to head to the shore. wildwood is coming in at 82 degrees. even interior sections of new jersey like millville coming in at 83, dover coming in at 83 degrees, too. some areas have managed to get down into the low 80s this afternoon but overall it is still hot and humid outside. tomorrow it's still going to be humid but we will be dealing with our increase in rain chances which will hopefully help cool you down. today we got to the low 90s so we are still in the heat wave. tomorrow we could still be around 90 degrees. thursday and friday, temperatures will start to drop down a bit more to where they should be this time of year, and a lot of that will be because of some rain we expect to hold the temperatures down. locally we haven't seen much in the way of rain, just some clouds passing by. the rain's off to the west. a lot of these showers and storms are moving straight up to the north so i think we will just stay dry through this evening, too. tomorrow, we see a little more in the way of showers and storms across the area. we will talk about the timing coming up. as for the rest of the evening, by 6:00 p.m., mid 80s, still hot and humid outside. more clouds as we go overnight tonight. by 8:00 p.m., low 80s, warm and humid. by 10:00, temperatures in the upper 70s. we could be looking at late patchy fog developing. then the rain chances start to increase as we go through the next few days. finally we will see a break from the humidity. also we have a new tropical storm in the atlantic. we will talk about all that coming up. new information on the investigation into a 14-year-old boy who officers shot in trenton earlier this month. investigators announced several charges against that boy today. they say he pointed a gun at officers as they chased him near calhoun street back on august 7th. a state trooper and county sheriff's deputy shot and wounded the boy. the charges the boy now face include aggravated assault and unlawful possession of a gun. the attorney general's office is investigating the shooting. a woman is behind bars in atlantic county accused of stealing more than $106,000 in patient co-pays from her workplace. police say elizabeth emberg stole the co-pays over two years from her employer in egg harbor township. she was responsible for depositing patient co-pays but authorities say she took the money for herself. also in egg harbor township, police need your help tracking down vandals who damaged a hockey court at veterans memorial park. they pulled apart the plastic floor decking that covers the entire port and left behind tire marks. a witness says he saw a group of kids on bikes near the court sunday night but did not see anyone vandalizing it. a petition is circulating to bring passenger rail service to residents across the lehigh valley. the petition is on change.org and has almost 1500 signatures. the mayors of allentown, bethlehem, easton and phillipsburg have been talking about the possibility of a train dedicated to that area. they do acknowledge if there's an agreement it will be a long time before it actually happens. right now the first [ inaudible ] are rolling down the production line. the former company president was involved with tasting the first flavors. the first orders are expected in stores next week and include black cherry, birch beer, cream, grapefruit and diet cream. rowan college at burlington county has a new look. the former burlington county college rebranded itself this summer. this is its new logo. a new partnership with rowan university makes it possible to earn a university degree on the mt. laurel campus and conditional acceptance into rowan university. we are learning more about a tombstone found at a north jersey bus terminal earlier this month. at first, detectives thought they had stumbled on to a child. we now know it belongs to an 8-year-old rottweiler named max. a maintenance worker found the tombstone at a bus depot in essex county. we don't know how it ended up at that bus terminal. an apology from a former pennsylvania beauty queen accused of faking cancer and she is promising to pay all the money back. brandi weaver-gates waived her preliminary hearing today. weaver-gates is from just outside state college. she was the latest miss pennsylvania u.s. international winner before she was stripped of her crown last week. police say she lied about having leukemia for more than two years so that she could raise thousands of dollars for herself. brand new details on the shooting of a 10-year-old boy. that boy was shot in the head at his own home in wilmington. >> nbc 10 has learned that police have made an arrest in that case. nbc 10's delaware bureau reporter tim furlong has the latest on the investigation. >> reporter: in the last few minutes we learned police made an arrest in the shooting of a boy who lives in this house in wilmington's southbridge neighborhood. the boy was shot in the head inside his own house. he is out of surgery but remains in critical but stable condition. police were here investigating for hours today. they now tell us they have arrested 24-year-old jalil goldsborough. no word on the relationship to the boy or the boy's family. he is now charged with possession of a firearm by a person prohibited, causing injury or death to another person. at 5:00, a swarm of police officers showed up. they came to a house a few doors down from where the boy was shot, entered, some with guns drawn. they took out a man and put him in a police car in handcuffs. we are working to learn more about this latest phase of the investigation, see if and how it's all connected. we will keep you posted on air, online and on the nbc 10 app. i'm tim furlong, nbc 10 news. swimmers aren't the only people afraid of sharks. seals e%déare, too. tonight a close encounter is caught on video. see how one seal managed to escape a shark's grasp. talk about a close call. a seal narrowly escaped a shark off the coast of cape cod, massachusetts yesterday. the entire incident was caught on camera by the atlantic white shark conservancy. the shark jumped out of the water trying to catch its prey but somehow the seal manages to get away. researchers say videos like this are important to their study of great white sharks in the atlantic ocean. last week two beaches closed after visitors spotted a great white shark killing a seal in cape cod. earlier this month, researchers say they spotted 17 sharks in just one day off the massachusetts coast. researchers believe the seal population may be what's attracting more sharks to the area. trouble on the site of a photo shoot in detroit. >> a crew was taking pictures of a tiger, a bobcat and two wolves in an abandoned warehouse. the problem started when the tiger sat down in a stairwell and refused to move. the crew tried scaring the large cat with a tarp and the sound of a weed whacker. neither worked. eventually the trainer coaxed the animal into its cage and the shoot had to be canceled. we have heard of tornadoes but what about a firenado? we are still in a heat wave. temperatures still in the low 90s today. we have rain in the forecast so the temperatures will start to cool down. also, a new tropical storm in the atlantic. some of the pope's dearest friends hope to make the trip to see him next month in philadelphia. >> nbc 10's jim rosenfield met them when he was the first local news reporter on the ground in the pope's homeland of argentina. >> we learned insightful and surprising things about pope francis from some of his close friends. can you imagine working for the guy who ends up becoming pope and you know him just as a normal everyday man or in this case, archbishop? well, two of the men who worked with him knew him simply as father jorge. he was their boss at the television station run by the church. this video was shared with us. we know the pope does not watch tv but he still believed in the power of the medium and had his own tv show and interfaith program. one of the most surprising insights, he rarely smiled. father jorge was known as a rather stern down-to-business kind of guy. >> now when he smiles all the time we say wow, he didn't do that in argentina. how is it. and i had the privilege to be with him in october 2013 and i asked come on, you didn't smile that way when we were with you, and he said well, if you had asked me a year ago that i would be doing this, i would say me, no, and here i am. >> there he is. she really believes the pope will address the sex abuse scandal when he's here in philadelphia. she says he was very hurt by it and as a priest, he just simply could not understand it. >> she worked very closely with the pope. what was he like as a boss? >> we asked her about that. she told me tough, organized, brilliant man. a great communicator, she said, and benevolent. he does have a good sense of humor even though he didn't smile a lot when they were working with him. they told a story about how julio who actually runs the station got so upset one morning, he was arguing with father jorge that later that day, the man who would later become pope came back to administer the last rites to julio. they all got a good laugh out of that. they also told us that pope francis was convinced that the day he was heading to rome for the election, the conclave, he was convinced he would be coming back to argentina, he was not going to be elected pope. boy, was he wrong as we now know. >> so many interesting stories that came out. for people who missed the special when it originally aired, really looking forward to that. >> nbc 10. across the west, more than 95 wild fires continue to burn out of control. the situation has gotten so bad, 200 active duty military troops have been called in to help the national guard and firefighters on the ground. this is the first time that's happened since 2006. in washington, about 75 homes have already been destroyed. take a look at this. you have seen a tornado before but what about a firenado? firefighters shot this video of one in boise, idaho saturday. he says it was shooting flames 100 feet into the air while dropping hot dirt and ash on firefighters' helmets. with those fire tornadoes, it's really the heat that creates the wind that creates that fire tornado so it's kind of a vicious cycle at that point. more locally we are still in a heat wave across the area. we hit 92 degrees today in philadelphia so the heat wave continues. if you were outside, i'm sure you could tell the humidity made it feel hotter, too. but the storms will be returning in the forecast. that means our temperatures will start to cool off so we will finally get back into the 80s, breaking the heat wave. we are also watching the tropics. it's been a quiet hurricane season but now we have a new tropical storm out in the atlantic. don't worry, it's really far away. i will show you that in just a minute. 90 degrees in allentown. 89 degrees in pottstown. 88 philadelphia. 89 in bensalem. we still have hot spots right now but some cooler areas are in new jersey and delaware. 83 in dover and millville. also atlantic city. if you are along the shore in cape may, this is one area where temperatures are closer to 80 degrees so here's a live look. you can tell it's gotten a little cloudier. we will see an increase in cloud cover as we go through the overnight hours, also into tomorrow. that's when our rain chances go up. right now we are nice and dry on radar. any showers and storms are just to our west. i think they will just stay to our west. they are mostly moving from the national hurricane center. traveling to the west as we go into saturday and sunday, possibly a category 2 hurricane by then. we have to pay very close attention as we go through the next 24 to 48 hours to see what the intensity looks like by then. but a lot of computer models are trying to intensify this thing. by sunday it will still be very far away from the united states. of course, we will be having more updates by then as well. a look at future weather, we stay mostly dry tonight with patchy fog late. by tomorrow morning, 9:00 a.m., we could be seeing some showers across the area. for the morning commute, keep that in mind. through the afternoon, still a slight chance of some showers, mostly west of philadelphia. then we go into thursday. temperatures could be more into the mid 80s on thursday, breaking a heat wave. but notice the clouds around. still a chance for scattered showers through thursday afternoon and then by friday. we could have a line of heavier showers move through and this will of course bring temperatures down into the 80s again, and the humidity will still be here but then once that rain passes, the humidity is going to drop off and the perfect timing is it will be here to start your weekend. for tonight, warm and humid, patchy fog late, mid 70s for the low in philadelphia, upper 60s north and west. then tomorrow, we will see another hot and humid day. could still be around 90 degrees. chance of some thunderstorms in the morning hours, could see some in the afternoon, too. by thursday, and going into early friday, through the afternoon, we have showers and storms still in the forecast. the humidity sticks around but then the humidity drops off for saturday, so saturday looks pretty good. looks good for the eagles, mid 80s, even on sunday. then the humidity comes back. family and friends gathered this morning to remember a fallen philadelphia police officer on the third anniversary of his death. the sound of bagpipes echoed outside the 22nd police district in north philadelphia. dozens gathered there to remember officer moses walker, jr. they wrote messages on balloons and released them into the sky. officer walker was shot and killed as he walked to the bus stop after finishing his shift. he was a 19-year veteran of the force. >> he enjoyed life and you know, we don't want to think about the reality of it. we miss moses. we miss moses every day. every day. but we have wonderful memories of him. that hold our family together. >> earlier this year, a judge sentenced officer walker's killer, rafael jones, to life in prison without the chance of parole. the military is about to put more eyes in the skies. the pentagon said today it plans to increase its use of drones by about 50% over the next several years. it decided to add army and civilian operated missions to the mix because the air force had been running about 65 combat air patrol missions a day. but it asked to decrease that number to 60 to reduce stress on the force. for the first time ever, two women have successfully completed the army's elite rangers school. their identities have not been released. we do know they have defeated one of the toughest combat training courses in the world. only 96 of the 400 original soldiers completed this course. army officials say the trainees made it through grueling conditions, limited meals and sleep deprivation all while hauling a 60 pound sack. the woman believed to be the nation's oldest veteran has died. emma didlake of michigan passed away sunday at the age of 110. just last month, she flew to washington, d.c. and met president obama. she signed up for the women's army auxiliary corps. the president released a statement calling her a trailblazer. a moment in the spotlight. 5-year-old haley dawson got to throw out the first pitch at a baltimore orioles game. she was born with a rare condition that left her with an underdeveloped right hand. she threw the ball using her 3d printed orioles themed robotic hand. orioles star manny machado gave her a fist bump and hug afterwards and even signed her hand. it will be a hot one tonight as the phillies take on toronto at citizens bank park. >> it's a challenge from the padres that got them soaking wet. take a look. members of the phillies organization took part in the als ice bucket challenge. after they were iced down they passed the bucket to the oakland a"s. throughout the month of august, major league baseball's 30 clubs will host their own challenge and challenge then another team. the goal, to raise money, awareness and critics point out its potentially serious side effects like fainting and low blood pressure. in clinical trials, it increased the number of sexually satisfying events by one per month. katherine reporter: unable to get ahold of him for an hour after his field trip with the boys and girls club to the kimmel center in may, miller says her 12-year-old ran to her. >> you know your child's voice.
