holmes in the first degree murder. his defense team is trying to convince jurors to spare his life. holmes pleaded not guilty by reason of insanity. >> and as we continue our news i'm jacqueline london i'm jim rosenfeld. a girl attacked on a trip to the beach. the search is on for a man who groped a 12-year-old girl underwater in atlantic city. >> police released this sketch of a man they're looking for. as nbc 10s keith jones reports the crime has left beach-goers unnerved. roichl beach-goers we talked to think of predators in the ocean they thing of sharks. when the 12-year-old girl walked right here in the shadow of the casinos. police say she felt a stranger's hand. not once but twice police say. >> make me scared for my own kids for other people's kids. >> she looks after three boys in nearly the same spot here at annapolis avenue the 12-year-old girl was allege lead groped. >> surreal. >> makes me keep a closer watch on my kids at the beach. >> reporter: like today the beach wasn't crowded the 12-year-old swimming with a friend caught a grown man staring at him. detectives think he looks like this. he inched closer closer closer and to the girls and he grabbed passed since the alleged predator struck. police say he was last seen walking south. parents we spoke with fear this guy will strike again. if you recognize this guy, these little girls need you to call detectives at the atlantic city police department. annapolis drive, at the beach. keith jones, nbc 10 news. fire consumes parts of at least two houses in camden county. sky force 10 over colonial square drive and lindenwold. 7:00 this evening. flames tearing through the top floors. no one was hurt. the red cross is helping at least four families now out of their homes. fire officials are still looking for a cause. >> tie up. sexually assaulted. robbed. what a young woman says happened at a southwest philadelphia hotel. she told police it happened in her guest room at the microtel hotel near the airport. the victim says a man sexually assaulted her at gun point. then she says he tied her up with a telephone cord. stole $500 and her cell phone and then took off. the woman told police she met the man through social media. >> tonight, major questions still linger after neighbors found a deceased woman on a children's slide at a popular playground in wilmington. >> police rushed to the park late this morning. this evening. nbc 10s george spencer found answers are slow in coming. >> gliding under swings tonight these kids seemed right at home on the park playground. for parents and neighbors, uneasiness remains. after the discovery of a woman's body atop this children's slide, a suspicious death according to police. >> i mean i take my doshgs i never think about it. you hope you don't seep it. a lot of crazy stuff. nothing like this. >> we watched as investigators searched the crime scene with metal detectors. neighbors tell us some of the dead woman's clothes had been pulled down around her ankles. several residents had seen her last night, sitting with the man, on one of these benches on the other side of the park. >> this playground is hardly isolated, a row of homes really, an entire neighborhood just steps away. and busy union street just up past the edge of the parking lot. >> you typically feel safe here? >> i do. >> but she says this death makes her think twice. although the park is filled with walkers, runners and families by day. regular visitors tell us it is pitch black after sunset. >> i don't want to be in the park in the dark. >> you stay out of there. >> it gets too dark. there is no light. you can't see anything. >> we watched as fire crews scrubbed the scene clean this evening. an autopsy will deter men how the woman died as park regulars get over their shock. >> i was surprised. i haven't. we haven't had an incident like this happen here. especially here in the park. since i have lived here. >> reporting in wilmington. george spencer, nbc 10 news. >> we have new information about a police incident caught on tape in chester delaware county. prosecutors say the video does not show what escalated the use of force by police. >> the cell phone video shows an arrest by officers from chester city and chester township sunday. delaware county district attorney says the video does not show him punching two officers as they tried to remove a gun from the waistband. he contends the taser did not work. officers had to use the force seen in the video. nbc 10 received the police criminal complaint. in it the officer who pulled him over. said i observed his heart bait racing which i observed from outside of the t-shirt. and then the officer adds that mote reached towards his waistband two more times then the officer called for backup. >> in this case yes, they used -- sufficient force, and they didn't exceed that force, but we're still looking at it. from my review at this point in time. i dent see excessive force in that video. >> prosecutors say walter mote has 13 prior convictions dating back to 1985. many for violent offenses. nbc 10 spoke with mote's mother who says she does not believe the da's claim. >> new life for an apartment complex in philadelphia's winfield heights section. this event tonight marking the grand opening of presidential city and its $100 million makeover. the washington tower opened today at the sight of the presidential apartments. the first of four towers to welcome residents. the towers are still works in progress. >> a new push tonight to stop certain tractor trailers from driving in pennsylvania and new jersey. we're talking about trucks with two trailers instead of one. they're about 20 feet longer than rigs. takes them longer to stop. banned in pennsylvania and new jersey. >> new at 11:00, guilty plea from the teenager accused in a hit-and-run that left a temple university student injured. the 1-year-old pleaded guilty to all charges including leaving the scene of an accident. police say roberts had only a learner's permit when he ran over rachel hall in april. the temple student riding her book near campus in north philadelphia. a star lacrosse player. still in a rehab center recovering from a brain injury. roberts faces sentencing in october. >> a former pto president is due in court next month charged with stealing money that was supposed to help children. the township police say that she stole nearly $20,000 from the elementary student teacher organization. prosecutors say she spent money on everything from groceries to eyeglasses to international travel. >> prison officials say pope francis will be kept safe when he visits the facility where an inmate stab aid guard last night in philadelphia. pope francis plans to visit the current correctional facility here during his visit coming up in september. police say last night, an inmate used a make shift nail to stab a corrections officer several times. doctors treat the the officer at a hospital he is back home tonight. today, prison officials insist they'd will have no problem keeping the pope out of danger during his visit. and with 76 days until that visit you can expect new construction to clog up traffic center city this weekend. a second phase of work will begin on major roads throughout city. expect closures. the street department says the road will need a fresh layer of black top. repairs won't wrap up until the end of the month. >> continuing to follow breaking news. the death toll has now reached three after a movie theater shooting in lafayette, louisiana. police say the suspected gunman is among the dead. as many as nine people were injured. and george spencer is gathering new information he will have an update in two minutes. updating our breaking news a mass shooting at a movie theater in lafayette, louisiana. >> nbc 10s jormggeorge spencer, gathering the information. we know the death toll has risen since the top of the hour. >> sadly, we have learned the death toll has climbed to three confirmed deaths there in lafayette, louisiana. just since this newscast began. and police now say of the seven people who were injured, three of those injuries are critical. take a look at some of the new instagram video we got into our newsroom. it shows a slightly closer view of the grand 16 movie theaters with plenty of police activity there moving through the parking lot. all of this started at 7:30 in lafayette, louisiana. and again we have confirmed that the shooter is one of those three fatalities. we're told the shooter was a white man in his late 50s, police at this point do know who he is but they're not yet publicly releasing his identity. we come back out here live i can tell you that we have learned that louisiana's police say no charges will be filed at a deadly crash that shut down 495 in new castle delaware county today. the man was killed when his car swerved went airborne and landed on top of a car here. a mother and three children were in another car. one of the children seriously hurt. the crash shut down the interstate for three hours. >> there are new developments tonight in the effort to crackdown on so-called sanctuary cities that shield residents from federal authorities. philadelphia is among those cities. the white house is threatening to veto a bill the house passed to day. that bill would cut off certain federal grants and spending for cities that don't cooperate with federal immigration requests. democrats call it an attack on immigrant communities. and they accuse republicans of following donald trump's lead in demonizing latinos. trump paid a visit to the mexican border today. protesters and supporters. met him as he landed in laredo texas. it is his first trip to the area since announcing his run for the republican presidential nomination. his run began with controversial comments about undocumented immigrants. >> new jersey state lawmakers are picking a fight with governor chris christie. all has to do with taxpayer money and his president sham campaigncam -- and his presidential campaign. one would require the governor to repay expenses for security details at north philadelphia. the mural, depicted cosby alongside civil rights leaders like nelson mandela and dr. martin luther king. the mural arts program was already considering removing it because the wall where it is painted is in bad shape. the recent allegations that cosby drugged and sexually assaulted women moved the mural higher on the list. cosby has never been charged with the crime. >> state police say no charges will be filed at a deadly crash that shut down 495 in new castle delaware county today. the man was killed when his car swerved went airborne and landed on top of a car here. a mother and three children were in another car. one of the children seriously hurt. the crash shut down the interstate for three hours. >> there are new developments tonight in the effort to crackdown on so-called sanctuary cities that shield residents from federal authorities. philadelphia is among those cities. the white house is threatening to veto a bill the house passed to day. that bill would cut off certain federal grants and spending for cities that don't cooperate with federal immigration requests. democrats call it an attack on immigrant communities. and they accuse republicans of following donald trump's lead in demonizing latinos. trump paid a visit to the mexican border today. protesters and supporters. met him as he landed in laredo texas. it is his first trip to the area since announcing his run for the republican presidential nomination. his run began with controversial comments about undocumented immigrants. >> new jersey state lawmakers are picking a fight with governor chris christie. all has to do with taxpayer money and his president sham campaigncam -- and his presidential campaign. one would require the governor to repay expenses for security details at out of state events. and the other would force the governor to resign. top state democrats say people should know what is going on when the governor is touring the country. >> we have grave financial problems here. why should our taxpayers be asked to underwrite the cost of strictly partisan political events. >> christie's campaign called these efforts "political drama" and just a part of daily
