tonight we are hearing from the family of the driver behind the wheel of a red minivan that rear-ended a parked 93 nissan sending it over a -- parked nissan sending it over a curb. his family says as a defense he doesn't own a minivan. no. a car. i don't know about him being in the vehicle, anything like that at all. >> with dwi assault of auto and leaving the scene of an accident. police in new jersey say they have arrested a man for the sexual assault of a 4-year- old boy. 66-year-old russell cortese of -- gave them the details of the assault yesterday. they immediately arrested a man at the point in point -- at a home in point pleasant where he was visiting. the number of cases of legionnaire's cases in the bronx now more than 70 with four deaths. folks in that borough worried about the highly contagious respiratory disease and what officials are doing to try to stem the spread. right now a town hall gathering so many city officials there but not mayor de blasio. >> reporter: federal officials as well just said hello to a congressman from the bronx as he makes his way into the meeting. also attending. the line is starting to form, has formed now just outside the bronx of arts as this town hall meeting gets underway right now at 6:00, you have to think every person in line, they are armed with a question for a meeting that's scheduled to go until about 8:30, 9:00 tonight. by the time people leave later this evening, they should have a pretty hefty education on legionnaire's disease. people in the bronx want answers and they want them quickly. >> my concern is really everybody, breathe in this, it's being taken care of and then it's -- it's kind of hard to say where it is. >> reporter: on july 10th, city leaders went public with the outbreak of legionnaire's disease in the south bronx. since then, several dozen cases, at least four deaths, five buildings tested positive, equally disturbing, what authorities don't know. >> why this neighborhood, why at this time, i have no been able to answer that question but i do know that the health department and all city officials are working extremely hard to really force the -- find the source of this outbreak. >> reporter: the bronx borough president who will attend tonight's meeting wants a renewed effort on preventing future outbreaks. >> as we move forward i think we are going to have a system in place now so that we can discover this and we can identify which cooling systems and which buildings in the city of new york test positive so they can clean it out in time without having an outbreak. >> reporter: organizers expect a full house at tonight's meeting inside the bronx museum of the arts which holds several hundred people, john ribeiro therein there -- will be her burial in new jersey. her body from a funeral home in newark to fairview cemetery in west field. private service held at her grave which is next to her mother's grave, whitney houston. both died in eerily similar circumstances. both found unconscious in bathtubs. fans feeling heart broken for cissy houston who had to bury her granddaughter today. >> just looking at her and being a mother and a grandmother myself, i felt the pain that she felt. >> young girl died last week at a hospice care. she was just 22 years old. young woman. tonight the first case of a new law calling for an attorney general investigation into any new yorkers who dies in police custody. raynet turner a mother of eight who died last week while in custody in the mt. vernon police, one of five black women to die in police custody across the country in july. renee stoll. >> reporter: still a mystery as to how and why 42-year-old raynet turner died while in this holding cell at mt. vernon police headquarters. >> looking into the >> reporter: a new investigation headed by attorney general eric schneiderman intends to answer those questions and find out if police acted lawfully or may she died. turner, a mother of eight, was arrested for shoplifting. she spent the weekend in jail before she died on july 27th. >> we are going do this right over the middle and we are not going to be overly aggressive in seeking to find something wrong and we are not going to ignore any facts. we will follow the facts where they lead and take this on i am partially and -- impartially and thoroughly. >> reporter: this is the first came he will take on, wants the attorney general to oversee tenor cases where -- certain cases where a person has died in police custody. deaths such as eric garner who was put in an apparent chokehold by an officer before he died. however, the district attorney association of the state of new york has said the order could do more harm than good. >> this relates to a crisis of public confidence, not to any particular act of misconduct or alleged misconduct by any d.a. it's not about that at all. >> reporter: before we left the attorney general's office here, i did ask him if he would be doing anything differently, then the -- than the district attorney who would normally be taking on a case like this, whether it was a larger staff to handle the investigation, maybe one with less of a couldn't comment on the staffing of other cases, only to reiterate that he would be doing a thorough investigation. reporting in lower manhattan, i'm renee stoll, channel 7 eyewitness news. the second trial in the man accused of killing a 6-year-old etan patz expected to begin in march. it comes nearly three months after a judge declared a mistrial on the case because of a hung jury. hernandez confessing to strangling patz back in soho in 1979 but his attorneys argued his confession was coerced. the jurors have taken yet another step to issue a death sentence for the colorado movie theater gunman, they declined to rule out the death penalty for james holmes clearing the way for another round of arguments before they eventually decide of death of life in prison without parole. found him guilty of murdering people and trying to skill 70 others. stocks kidding off the trading weeks with pretty big losses. the dow fell at 91 points, the nasdaq dropping 12, the reported a drone within 100 feet of the cockpit. and later that day a drone startled a delta pilot: >> 100 feet below us. >> reporter: three in as many days. it concerns veteran commercial and from the bronx. seven deaths now. there were four when we talked to you earlier in this newscast and now 81 cases of the very contagious respiratory illness. right now in the bronx i'm meeting with local state and federal officials to talk to residents about what they are doing to try to calm this outbreak. mayor de blasio is not there, at least not yet, and maybe that will change, we will have the latest tonight on eyewitness news at 11:00. switch gears and talk about the weather. i think this summer has been pretty good so far. >> it's been fantastic. >> and continuing. >> very consistent. especially over the last month and now this seems like a different type of week. we feel the same now and then things start to change a little bit. so let's go ahead and go outside, we have sunshine, also have a lot of clouds off to the north and west and that's where our camera is pointed. we had strong storms earlier, they are really diminishing, we just don't have the support locally for big storms. that's happening upstate and into parts of new england, we are at 86. south wind has helped because that's coming off the ocean, that tends to choke off a thunderstorm and we have the pressure right now holding steady, managed to reach 90 degrees in central park, six above average, sunset tonight at 8:10, should be pretty. humidity sticks around through tomorrow, and it's even higher in the morning and starts to back off a little bit in the afternoon, there can still be a spotty storm around, i'll tell you where in a moment. best bet is wednesday, lots of sunshine, low humidity, the clouds will start to gather on thursday, i'm sure you're hearing about the late week rain threat and you're already concerned about your plans for friday. still have questions with that. get to that in the seven-day accuweather forecast. 72 rain cooled in monticello but 84 in cold spring, a pair of eights in stomachford right now -- stamford right now. 84 belmar, 91 in newark. had a heatwave now for a week. dew points are starting to climb into the mid-60s so you're getting into that sticky, uncomfortable region but going to be there overnight into tomorrow and then it will get back to pleasant by the time we get to tomorrow night. wednesday there's a spot thunderstorm overnight, especially north and west, although once we get into the wee hours of the morning there could be a shower just about anywhere, early clouds give way to sun tomorrow, and then a nice westerly breeze, more sun coming out and a spotty storm in the afternoon. there are the showers that have weakened considerably since about 3:00 this afternoon, there's still a little feisty downpour here that's racing through sussex county toward frankfort, brief and a lot of these showers are going to continue to fall apart but we are getting the blowoff clouds to get to the coast. even if it looks dark in the city and down the island, it's unlikely the showers are going to reach you at least in the next few hours as they weaken. overnight, as the humidity begins to increase, i can see how a spot shower flares up. even into the early morning hours just about anywhere. but then clouds leave the scene, we are partly to mostly sunny during the day, get up to about 90 degrees, and then there can be a scattered shower in the afternoon. mainly on the jersey shore and also well north and west and then drying out in the evening hours. later in the week we watch this storm come eastward but still a chance this is going to slide to our south and we are just on the northern fringe of it and also some indications the whole development of it may be a little slower so not sure pop-up storm tomorrow not only north but i could include the jersey shore as well in the afternoon hours, wednesday is a mostly sunny day, pick of the week, low humidity as well. here's your accuweather forecast, 75, warm and humid tonight, isolated storm, mainly north and west early and then anywhere later on. but then again isolated. most of us staying dry, breezy, hot tomorrow, isolated storm in the afternoon, less humid, really nice night tomorrow night. wednesday is great, thursday clouds gather and they have an update on that friday forecast at 11:00. right now there's a decent chance of rain but there's also a way out of that and hopefully we dry out for the upcoming weekend. so more on that at 11:00. >> national league player of the week honors. lucas duda and noah syndergaard announced as the co winners for last week and last night the big reason why as the mets pulled off the sweep of the nationalvirtual tie for first in the northeast. three home runs, two run shot from curtis granderson followed by this, daniel murphy a home run and then duda another two run blast. syndergaard struck out nine in a solid eight innings, pair of solo home runs. the real stars of the game, though, the fans, citifield was rocking, the mets are finally giving their faithful something to cheer about as they make their push for the playoffs. >> so much fun to be a met right now, just the atmosphere around the clubhouse, we have a lot of momentum going in this next series so it will be a lot of fun to
