weekend that left three people shot and killed. president eric adams and several council members holding a rally outside burle hall this morning to launch a campaign against gun violence. they are calling for community and police cooperation after a wave of shootings over the last two days. they set up an open casket outside burle hall as a stark reminder of the cost of all this gun violence. >> when a bullet is discharged from a barrel of a gun, it does not discriminate. it would take the life of anything and anyone that it is. york cop. eyewitness news reporter kemberly richardson at today's rally will break down the antiviolence campaign coming up on eyewitness news at 6:00. in less than an hour, concerned community members will come together in the bronx to address the legionnaire's outbreak that has left four people dead. 71 cases have been reported. eyewitness news reporter joe torres spoke with council member va anythinga -- vanessa gibson who organized it and joins us more on what we can expect tonight. >> reporter: the meeting gets underway here at the bronx museum of the art. the new york city health commissioner, the state assembly speaker, the bronx borough president will address the crowd at the beginning of the meeting. there will be a powerpoint presentation followed by the main reason so many people coming out to the meeting tonight, a period of questions and answers. >> it could happen anywhere. it could happen in the bronx, it could happen anywhere. >> reporter: no worries for rally maldonado who lives and works close to the op rahouse -- op opera house hotel -- is there this is new york city, one of the best cities in the whole world. >> reporter: maldonado and others are happy city leaders are hosting a town hall meeting at the bronx museum of the arts. vanessa gibson organized the meeting to address concerns to answer questions and to clear the air. >> we want to make sure that the public is aware of the disease outbreak but educated about the causes, the factors, we want to caution everyone to not be alarmed. >> since the outbreak on july 10th, city leaders have confirmed several dozen cases of legionnaire's disease and a handful of deaths, five south bronx buildings had their cooling towers cleaned. it's still unclear which tower is spreading the bacteria. >> we don't know where it's coming from exactly but what we do know is they have tested buildings where none of the people walked into and those buildings also tested positive. and luckily we didn't have any outbreaks or we didn't have any cases coming out of those buildings. >> reporter: so you see questions still unanswered. the bronx borough president points out there have been legionnaire's outbreaks in the city before, co-op city, brooklyn, other points of the five boroughs. what's unusual in this instance is the huge cluster of cases in one particular area. coming up at 6:00, a look at what's being done to prevent future outbreaks. we will of killing 6-year-old etan patz 36 years ago. a judge today setting jury selection for the second trial of pedro hernandez beginning on february 22nd. his first trial you will recall ended in may with a hung jury. hernandez confessing to killing the boy after luring him into the bodega where he worked in 1979. after today's hearing, attorney for hernandez expressing frustration that the trial won't start any sooner. >> tension because my client sits in jail and the people keep requesting for a delay and now we are not going to get started until end of february and we wanted to get this case moving earlier. >> jury selection expected to take a couple of weeks. opening arguments expected to begin in march. moments ago the three suspects in the shooting death of a new jersey teen appeared in court for the first time following their arrest. naji mcduffy, darius emanuel and justin nesssmith facing a first-degree murder charge. 16-year-old broken wirth spann -- braun witherspoon was hit. his family donated his organs to six people. police say they have arrested a man who broke into a woman's apartment in the west village and assaulted her as she slept. 35-year-old jeffrey joseph of staten island is charged with burglary and sex abuse. police say he was caught on camera entering the building early last thursday morning. he then allegedly climbed up a fire escape to a second floor apartment and groped a 43-year- old woman who was asleep. >> the court: her young life so filled with pain and tragedy and her life ended so young and so filled with pain and tragedy. bobbi kristina brown, daughter of whitney houston buried today in new jersey, the same cemetery where her mom was buried. new jersey reporter toni yates is there in west field for us -- westfield for us. >> reporter: there were two women out here, grandmothers and they cried their eyes out when that hearse came driving by today with the closest -- today was the closest they would ever want to be in cissy houston's shoes. the funeral home in newark that handled the finalitis of whitney houston three years later carrying out the same somber duties for her daughter. bobbi kristina brought here to fairview cemetery to rest in a gravesite next to her mother, cissy houston seen here in this suv now burying her grandchild. >> i saw cissy as she was passioning and looking -- passing and looking at her and being a mother and grandmother myself i felt the pain she felt. >> reporter: bobbi kristina was just 22 years old, the daughter of whitney and singer bobby brown, many say she couldn't overcome the loss of her mother. she faced ter miles and -- turmoils and hurdles that ended in january when she was found face down in the bathtub in her atlanta area townhouse, very much the way her mother was found at a beverly hills hotel in 2012. six months in hospice care, bobbi kristina died july 26th. >> it's just sad. it's sad to see this. i can't even imagine what sissy and -- cissy and all of them what they are experiencing now. >> we love you, bobby. we here for you, bobby. >> reporter: disagreements between the housing and brown families erupted at her funeral held saturday in georgia but it was quiet here at fairview where a short service was held at graveside where just outside the gates whitney houston fans mourned again. age. it's just a tragic time and i just want to jurors taking another step toward issuing a death sentence for the colorado movie theater gunman. jurors declining to rule out the death penalty of james holmes clearing the way before another round of arguments before they decide whether death and prison without life in parole. found him guilty of murdering 12 people and trying to kill 70 others. former president jimmy carter is recovering tonight from liver surgery. according to the carter center, he underwent the elective procedure in atlanta today. carter had a small mass on his liver that was removed. there were no complications and he is expected to make a full recovery. stocks on wall street -- investigators spent the day pouring over the latest round of quarterly earnings reports. they were discouraged by another drop in oil prices which helped push energy stocks down. the dow fell 91 points closing at 17,598, the nasdaq dropped 12 points and s&p 500 lost five points. coming up as we continue with eyewitness news at 5:00, degree murder charge. an important warning tonight about rip currents after a frightening weekend for many in our area who ventured into the ocean. especially who ventured on long island where lifeguards were indeed busy. several people rescued from the waters. the tragic news, two swimmers did not make it. meteorologist jeff smith at long beach in napa county where one man drowned this weekend. jeff. >> reporter: tell you what, the wind has really picked up here in the south shore of long island and that's causing the sea to look rather angry and if you think about it, all these waves coming onshore, the water eventually flows back offshore, not evenly, though. it happens in small concentrated channels of rapidly flowing water called rip currents, enough to be dangerous and deadly during the past couple of days. as ocean water temperatures rise into the 70s here on long island, thousands of people are flocking to local beaches, inviting as it may be, that water has also been extra dangerous for the past couple of days due to strong rip currents. >> there's a rip on this side so we are trying to keep everyone in between the -- and this side. and then when they drift they tell them to move over. >> did you feel any of the rip currents at all? >> a little bit, yeah. >> reporter: you could feel them? >> yeah. >> reporter: two people drowned at long island beaches over the weekend including one here in long beach, that victim was swimming after lifeguard hours had ended as for one reason why people are tempted to swim after-hours? >> it's expensive to get onto the beach and some people don't want to pay the money, so that they come after-hours and, you know, when it's free and they take their life into their hands. >> reporter: to avoid getting yourself into trouble the first order of business is to only swim when lifeguards are present. >> we are on starting at 9:00 and off at 6:00. >> reporter: flags on the beach indicate which areas are safer to swim. >> between the green flags, red, red means no. the rocks are pretty dangerous. we don't want people going over there. >> reporter: if you feel yourself being pulled out to sea by a rip current -- >> don't swim against the rip current because you panic and that's when you have problems. when you get out to sea, you swim parallel to the shore. >> reporter: from the time you arrive at the beach, lifeguards are your lifeline in these types of conditions. >> where can i swim and be safe? >> swim in front of me and listen to what i tell you and you'll have a good time. >> reporter: if there's one piece of good news, rip currents tend to be rather narrow channels of rapidly falling water so if you're a halfway decent swimmer, you swim parallel to the beach until you're out of that current, until you no longer feel yourself being pulled out to sea and then you can start swimming back towards shore. lee goldberg was mentioning that onshore pretty strong into tomorrow. live from long beach, i'm meteorologist jeff smith for channel 7 eyewitness news. >> good to hear about those warnings. got to be careful the next few days. >> you can even just do your own forecast. if you notice that it's more humid out, we probably have more of a southerly wind or a wind coming off the ocean, that's going to stir up the rip currents a little bit more so we have had a temperate, not so humid summer. we haven't heard about brad rip that's where it is. dropping later tomorrow and into wednesday and that's when the wind will come off the land swimming situation. but not over the next 24 hours. so something to look at here in central park. got mainly clear skies, this camera is pointed off to the east, we are going to look at a picture right now of lower manhattan, we are looking at the west, what a difference. so we have thunderstorms over the poconos and catskills, they are not headed to new york city right now and we have clouds off to the west. these storms are trying to get to the coast and they are running into more of the ocean breeze they tend to weaken and run away from the ocean breezes. and the pressure is holding steady and the high today now can be updated to 90 degrees. it would have been the fourth straight day at 89. there are your records and sunset and sunrise times. were at 76. look at monticello, rain cooled 72 but still 90 in kingston and poughkeepsie, a couple of storms headed your way, 91 in yonkers, 85 in norwalk. our long island numbers are in the low and middle 80s, 92 in west orange, parts of new jersey have had a heatwave now for seven days. 90 all weekend long and back to last week. now, the dew points are generally in the upper 50s, some low to mid-60s, even 72 in montauk, we are going to get into this sticky to uncomfortable range tonight and then start to settle back during the day tomorrow. so it's not a long-term oppressive situation. we have these spotty storms mainly north and west overnight tonight, clouds will break for sunshine, it's a partly to mostly sunny day and a spot storm in the afternoon hours. we will give you the locations for those in a moment. so there's that cell racing along into southern ulster that caused a severe thunderstorm warning, a few more cells weakening over southern sullivan county so that's the strongest one right here and moving off to the northeast so ellenville, bragsmoore, walker valley affected by our brief heavy downpour, does not last very long. down so the south, the back end or southern part of the line is weakening, tries to fire up and then falls apart. i doubt these will try to reach new york city, if they did it would be close to that 6:00, 630 time period. the storms can -- only a bit of a shoving match here. the storms can only make it so far east and then begin to fall apart. the worst storms are up toward new england. the rest of the weather map nice for the middle of the week and then we will look to this low out of the rockies, that could mean wet weather late week, whether it's a soaker or shower still working on the forecast but i think the end of the week is cooler and damp at times. pop-up storm tomorrow, 90 degrees, best chance north of new york city, humidity is higher in the morning, starts to drop later. pretty hot day. and then less humid on wednesday and that looks like a partly to mostly sunny day, should be great. warm and humid tonight, isolated thunderstorms, best chance north and west. down to 75. 90-degree day, early clouds give way to sun, breezy, hot, isolated thunderstorm in the afternoon hours and then tomorrow night scattered clouds and less humidity. for 5:30. i told you about a pop-up storm mainly north tomorrow, one near the jersey shore too. new information i'm looking at there. will the new jersey heatwave extend to nine days and will we have a soaking and only low 70s by the end of the week? that will be a first in a long seven-day accuweather forecast coming up quick thinking likely saving lives when the driver loses control at the wheel. and he's known for speaking his mind, but has new jersey governor christie this time gone too far? has he threatened williams. angry blow back tonight from teachers and their union who say the governor indeed has gone too far. >> but with the republican presidential debate just three days from now and with governor christie close to not being included, was he trying to generate some headlines? >> political reporter dave evans here with the latest. david. >> as you know, this is a long running dispute dating back to when governor christie first took office and he has tangled with the teachers union ever since. so this latest remark was not a big surprise but it might -- with republicans voters who will be closely watching thursday's big televised debate, the first of the campaign season. governor christie has said before he would handle a bully by punching them in the face. that led to a question yesterday and an answer that angered many. >> at the national level who deserves a punch in the face? >> the national teachers union. >> governor christie has said it's not teachers but their union that has caused so much trouble. >> because they are not for education for our children. they are for greater membership, greater benefits, greater pay for their members. >> reporter: in east brunswick today we talked with two teachers, one from orange and another from hawthorne, they were furious with governor christie. they fought with him before but it's that pitching comment that's -- punching comment that's angered them now. >> i wouldn't want my students behaving like this in class and wouldn't want my own children behaving like this. >> very inappropriate and to say anybody would punch anybody in the face for whatever reason, that is not a solution. >> reporter: christie will take his antiunion spiel to thursday's big debate, it will include the top 10 republicans, christie is there but barely. the latest polling shows donald trump widening his lead with 26% now, followed by jeb bush, scott walker and you have to go all the way down to seventh place to find governor christie with 4% of the vote. teachers see a connection now between thursday's debate and christie's latest inflammatory remark. >> he does like to stir controversy and to get his name, you know, out there as much as possible because i think that probably going more west people don't know so much about governor chris christie, but also i think that i wouldn't want him representing our country in peace talks. >> reporter: but christie is not backing down. he says with the teachers union, he never will. >> they are the single most destructive force in public education in america. >> reporter: nationally the aft, the american federation of teachers which has already endorsed hillary clinton responded to christie by saying problems. randy weingarten who used to be the uft president says here extremely inappropriate especially because most teachers are women. bill and sade. >> thank you. the schumer cousins, one a new york senator another other comedian today teaming up for gun control. amy schumer stars in a movie called "train wreck," during a screening in louisiana a man opened fire on fellow audience members killing two people. feeling heart broken over what happened she decided to join her cousin, chuck schumer in new york today to discuss violence. >> no one wants to live in a ill or other dangerous people can get their hands on a gun with such ease. the time is nofor american changes. >> congress is working on a mother that -- measure that would reward states that submit information to the federal background commission, states who don't comply will be hospitalized. 13-year-old girls pulled from the long island sound on sunday off jennings beach in fairfield. police say they were riding on an intertube being pulled by a boat when the tube ran into a yacht. the girls were thrown into the water. people on the yacht pulled them out unconscious and then called 911. >> the kids hit the boat. they were in tubing and she is unconscious. >> where exactly in the water are you? aryou ofof >> black rock beach. >> okay, you're in fairfield. hold on. i'm going to get help going. >> good news to report about the girls. we have learned they have been upgraded to stable condition. also in connecticut, starting today, police there are cracking down ondrivers who talk or text while behind the wheel without using hands- free devices. the u drive, you text, you pay campaign runs through august 16th. drivers caught using their phone without hands-free devices will be fined $150. in april during a similar campaign police issued nearly 16,000 citations statewide. president obama unveiling his ambitious plan to take on climate change aimed at sharply reduced greenhouse gas emissions. it's a move that could place central to his leg -- play central to his legacy but already pushback. stephanie ramos has the story from washington. >> reporter: a scannedding -- standing ovation as president obama took another aggressive stand on climate change. >> i am convinced that no challenge poses a greater threat to our future and future generations than a change in climate. >> reporter: because of this, obama unveiled a tougher dioxide emissions from power plants in the u.s. >> we are the first generation to feel the impact of climate change and the last generation that can do something about it. >> reporter: he adds, it's important to start today with cleaner future. >> the e.p.a. is setting the first ever nationwide standards to end the limitless dumping of carbon pollution from power plants. >> reporter: those plants are the largest source of greenhouse gases in this country, releasing about 30% of the u.s. carbon pollution. once president obama leaves office new requirements will include an order that carbon emissions be reduced 32% by the year 2030, but some republicans are joining business groups to say the administration's plan would be costly on the economy. >> they will also likely result in higher energy bills for those who can afford them. >> reporter: president obama says they are wrong. >> the nerdier way to say that is we will be keeping 870 million tons of carbon dioxide pollution out of our atmosphere. >> reporter: the administration says states will have flexibility. they will have until next year to come up with a draft under the new guidelines. in washington, stephanie ramos, channel 7 eyewitness news. police officers in queens rescuing a small dog from a very hot car. it happened yesterday afternoon in forest hills. temperatures were in the high 80s, somebody noticed the dog in the car and they alerted police who were able to get into the vehicle through a slightly open window. the puy had been left there an hour without any vision of the owner. issued a summons but allowed to keep the animal. a bad boy -- bat boy struck and killed on a baseball field. another frightening escalator accident. coming up you will meet a new yorker who helped save an entire bus load of tragic death of a 9-year-old bat boy who died after he was hit in the head with a bat at an amateur baseball game in kansas. the national baseball congress now suspending the use of bat boys and girls during its world series following the accident. a player accidentally hit kaiser carlyle as he took a practice spring. today carlyle's team, the liberal bee jays remembered the boy. >> trying to get remarkable seeing that in such a young kid. >> the team says it will honor kaiser at games tonight and tomorrow. one pilot killed after a helicopter accident in russia, an accident that was captured on camera. the attack helicopter participated in an air show about 100 miles southeast of moscow when its hydraulic system failed. an alarm system sounded, the pilots struggled but ended up crashing. one of the two pilots died. the russian air force suspended flights on this hype of helicopter while the crash is investigated. another tragic escalator accident in china to tell you about. this time the man's leg amputated. the floor panels giving away and trapping the man's legs. comes after a week -- comes a week after a similar accident in central china. a mother died while pushing her baby to safety. in that accident the escalator panels also gave way and she fell through. right now rescuers looking for victims after two trains lifting part of a bridge came crashing down on several buildings in the netherlands. the dramatic moments all caught on camera. the crane toppling four homes and two shops, at least 20 people are believed to have been hurt. well, the show isn't until as we look at threatening skies off to the north. some building clouds up there toward the george washington, the hudson valley and into the catskills. our temperature at 87, partly sunny skies, southwest wind about 17 to 25 miles an hour. here's a planner, we will have clouds around during the evening hours, 80s dropping into the upper 70s, the humidity is actually spiking during the overnight, so there can actually be a little thunderstorm that probably flares up over parts of the area during the overnight. don't be surprised to see that and then some clouds may be left over from that in the early morning hours, we will start out the day around 75 or so. so clouds may be -- maybe even a shower east of new york city leaving the area, clouds giving way to sunshine during the day tomorrow. then there could be a pop-up during the afternoon hours the best chance for an isolated storm in the afternoon mainly in our northern suburbs, we will watch that closely. notice the thunderstorms that were over the catskills and poconos, been a lot of weakening a couple of other cells trying to get into northwest new jersey right now. this cell is really weakening near high falls, going to marbletown, there will be a rain shower here but nothing severe here, the warning expired over sullivan county at 5:15. our futurecast is insisting a flare-up on the front -- along the front of a couple of storms this evening. there will be clouds around during the overnight. then as that humidity spikes overnight, maybe a couple other thunderstorms around, i think they will be isolated. whelm have to watch this -- we will have to watch this trend of the futurecast depicting a thunderstorm blowing up during the morning commute tomorrow morning. i think it's overplanning. a couple of pop-ups during the afternoon, i think that's accurate and it will be during the afternoon hours and then the humidity drops later in the day. now with the wind still out of the south at least early on and southwest, there will be a rip current risk that's high again tomorrow. a choppy boating day, the water temperatures are inviting but it's not that safe to swim. make sure you're near a lifeguard and there will be rip currents. there will be a lot of improvement into wednesday as the winds become more off the land during the day. air quality moderate, uv index at 8 and the pollen count is moderate. later in the week a storm coming out of the rockies, looks like it's going to come at us or to our south. decent amount of rain to this system, even if we don't get the heaviest rain with it we will be overcast and temperatures struggling to get out into the lower to mid-70s. a spot thunderstorm around, 90 degrees tomorrow, and then on wednesday 87, less humid, clouds will be gathering on thursday, worst case is late day some rains moving into our western suburbs, friday looks like a cool and damp day, 76 could be optimistic but i think the clouds are going to break on saturday and overall we are looking at a nice weekend. it's not the heat that we have experienced of late but still pleasant around 80 degrees and nice into early next week, so hopefully (narrator) only one family goes to incredible lengths to bring the thrills, the adventure and the best of africa back home to you. kalahari resorts. now open in the pocono mountains. book now at kalahariresorts.com new at 5:00, we are hearing from a quick thinking passenger who may have saved a bus full of riders. when the driver lost control, this man you're about to see jumped into action. the bus from queens was in north carolina when police say the driver crashed into a car. eyewitness news reporter lauren defranco spoke with the hero. >> i heard a noise from the driver, when i looked, he was laying down on the wheel, then the bus shook. >> reporter: he was in the front row of this bus trying to sleep at about 4:00 sunday morning when suddenly the smooth ride south on interstate 95 turned scary. the driver ejected and the bus had crossed into the northbound lanes. >> all i knew is that this bus needs to be stopped, somebody has to try to stop it and i was right there. >> reporter: the 36-year-old jumped into the driver's seat and applied the brakes, veering back in the right direction. he had precious cargo on board. >> when we came to stop, the first thing i asked my wife, that how is my son. that's the first thing i asked her. she said he's fine so i asked her again, check him. >> reporter: he and his family were along with three bus loads of travelers from queens headed to a spiritual retreat in north carolina. they were only minutes from their destiny -- destination when they crashed. the bus is from apex in brooklyn, the driver, 28-year- old eric jimmerson in new york is hospitalized and charged with misdemeanor death by a motor vehicle of a 55-year-old grandmother. he and his wife were bruised as were several other passengers. he says the driver had been going the speed limit. >> i don't know if he had a seizure or he fell asleep. i can't tell. i heard a noise. he made a noise from his mouth. >> reporter: and it's a good thing he did hear that noise. he saved a bus load of people. >> everybody was like saying thanks and you are the hero, you saved us. yeah, it's a good feeling. >> reporter: he and his family made it back to new york early this morning. sachen says he wasn't afraid to get back on the bus but is glad to be here safe and sound. in kew gardens, darla miles, channel 7 eyewitness news. new power as a special prosecutor to investigate the death of a mother in a police holding cell. eyewitness news at 6:00 starts right now. >> this is new york's number 1 news, channel 7 eyewitness news with bill ritter and liz cho, rob powers with sports, and lee goldberg with the exclusive accuweather forecast. now eyewitness news at 6:00. growing words in the bronx tonight about legionnaire's and the outbreak of that deadly disease. right now a town hall meeting getting underway as we learn new details about what's being done to try to curb this deadly outbreak and prevent another one. first an extremely violent weekend in new york city, shootings out of control, 19 people shot, three of them are dead. tonight new questions about how to stop this gun violence and one elected official using some dramatic theater to call attention to the blood shed. at 6:00 i'm bill ritter. liz off tonight. the shootings again raising concerns about police strategy, lack of stop and frisk and guns out of control in new york city. cold, hard facts. the number of people shot in new york city so far this year, 794. last year at this time slightly fewer than 787. but this weekend eight shootings, 16 wounded, three people killed. most of the violence in brooklyn and tonight the borough president, a former new york cop, making a dramatic statement about gun violence. eyewitness news reporter kemberly richardson with the story. she is in downtown brooklyn for us. kem. >> reporter: bill, is it disturbing? absolutely, but then again that's the point, a single open casket here in front of borough hall. we have watched people all day. first they are curious, stop but once they look inside that wooden box, well, they are moved -- their mood quickly changes.
