both cases as we get them. right now at 11:00 a lot of questions about this viral video. police in fairfax county say it was the appropriate use of force when an officer had to tase a suspect. thanks for joining us. i'm jan jeffcoat. >> i'm bruce johnson. tonight the family of the man in that video said he's disabled, but police stand by their officer and say the suspect was resisting arrest. let's go to ellison barber who tells us both sides have video to support their claims. >> reporter: fairfax police say their officer used an appropriate amount of force. the family of the man in that video elton cansler disagrees and now they have an attorney. >> it does not seem clear from the video that the suspect did anything to warrant the tasering. >> reporter: dr. robert wiseberg does not represent cansler's family, but he specializes in criminal procedure at stanford law. after hiwatcelng conl phe video of a fairfax county police officer using a stun gun to subdue 35-year-old elton cansler, wiseberg has many questions. >> it's not possible to detect from the video any movement of the hands at all. something caused the officer to fire the taser at that point. all i can say is that i don't see what could legitimately cause the taser. >> reporter: that's essentially what cansler's family says. they don't see how this was justified. off camera cansler's uncle marty jackson told wusa9 he doesn't believe his nephew was resisting arrest. he said cansler has cerebral palsy and it makes it difficult for him to control his movement. when the video surveillance faced, some thought it was an obvious instance of misconduct. >> he was already putting his hands on the car. >> reporter: police in fairfax county launched an internal investigation but said this video only told part of the story. according to police, their officer approached cansler because someone stole sunglasses from a teller at a nearby bank and cansler fit the suspect description. >> the officer asked mr. cansler if he was at the suntrust bank and if he was the one that committed the larceny and took the sunglasses and mr. cansler replied yes. >> reporter: when the officer approached cansler, police said he had this knife in his pocket. >> but then again he would put his hands back into his pockets. >> reporter: when that officer went to arrest cansler, he resisted. >> mr. cansler stiffened up to actively resist and locked his elbows. >> reporter: they say all that suggested the officer acted appropriately, but to wiseburg it still dental make sense. >> the crime he admit -- doesn't make sense. >> the crime he admitted to wasn't a violent crime. >> reporter: according to a family spokesperson after a meeting tomorrow their attorney will have a public statement in. fairfax county i'm ellison barber, wusa9. there's new information on a major change in how many of you will get an ambulance if you ever need one. tomorrow there will be a profile policy to use -- proposal to use private ambulance companies to respond to calls that are not emergencies. it sounds like the department's in pretty desperate need for some outside help. >> reporter: well, they're certainly moving quickly to get in done. chief dean told me today he's seen public/private partnerships like this work seamlessly in places like seattle where he's from and where they've been doing this sort of thing more than 30 years. now recent events in the district have convinced him they need to do something here quickly. when 5-month-old traqwon sumter stopped breathing earlier this month firefighters rushed him to the hospital in the back of an engine. the closest ambulance was 7 miles away. >> it makes no sense a baby has to die because the ambulance could not get to it in time. >> reporter: chief dean hopes more ambulances would be available for that kind of emergency. >> we're running up into the high 600 call per day and we've had some vehicles that have run over 23 hours a day. >> reporter: under the proposed plan a fire engine still responds to every 911 call for triage. the most serious cases like heart attacks and trauma get a d.c. ambulance. less serious calls would summon a private ambulance for transport leaving ems crews free. dean says having a private partner to shoulder minor calls would allow for more training and maintenance time for d.c. and ambulance crews. >> the third-party provider is not the answer. it's just helping us get to those core issues so we can deliver an even better brand to the residents in the district. >> reporter: mayor bowser supports dean's plan and the firefighters union doesn't oppose it, but unanswered question about it remain. how do you pay for something like this? >> we haven't even got into that yet because we wanted to lay the proposal in front of the council and mayor to see if they have an interest in it. if they do, we'll start addressing those issues, also. >> reporter: now unlike in seattle where they've been doing this kind of thing for decade, chief dean says in d.c. this would be a one year pilot program, time he hopes for the city ems to catch up to the need of the growing district. reporting live in northwest d.c., garrett haake, wusa9. >> thank you. chief dean will present his plan to the council tomorrow morning. we will have coverage of the council's response tomorrow afternoon. it was a tricky rescue by both air and ground on frederick county sugarloaf mountain today. sky 9 was on the scene where a man took a bad fall and injured himself late this afternoon. rescue crews reached him in some rocks on the side of the hill. they placed him in a stretcher and then a helicopter for transport to the hospital. you'll probably want to hang onto your umbrella really for the whole week. >> i'm getting more concerned about severe weather tomorrow. we mentioned it earlier in the show, but now it looks more and more likely. let's start with 3 p.m. tomorrow afternoon on futurecast. i'm starting here because we feel the biggest threat will be between 3 p.m. and about midnight tomorrow. so 3:00 80 downtown and you see the showers and storms developing out of the south, culpeper to fredericksburg, migrating northward. by 5:00 looks like a wet ride home for most of us and we're seeing yellow and orange out toward luray. it gets worse going through the evening. by 7:00 look at all the red between culpeper and luray moving northward. by 9:00 we got big storms in montgomery county, fairfax, loudoun, martinsburg and winchester, the biggest threat flash flooding and potentially strong winds. we'll talk more about that and a new tropical storm that could affect our weather over the weekend. two d.c. council members are asking metro to reconsider a discussion to cut back rush hour service at the stadium armory station. starting tomorrow orange and silver line cars will bypass stadium armory during rush hour for at least six months while crews repair equipment destroyed last week in a transformer fire. only blue line cars will stop there. council members charles allen and yvette alexander say the decision will have a ripple effect across the system and cause significant delays. new tonight reaction from you the fans and the professional sports world to this dugoutight now seen around the world, nats closer jonathan papelbon has been suspended four games without pay for trying to choke teammate bryce harper. now the public and players in and out of baseball weighing in on the big brawl. >> let's bring in kristen berset. what does this mean long term for the team? >> of course, it's going to be interesting to see if they bring papelbon next year despite having an $11 million contract and more importantly, matt williams, will he be back? was this of the lineup, it's not fun. >> reporter: the extreme nature of this altercation brought back memories of michael westbrook and steven davis at redskins training camp in 1997. this nats incident was the franchise is wrong, you never touch the franchise like me touching john wall. >> yeah. you don't do that. papelbon is still under contract next year due $11 million. rizzo did say today he will evaluated papelbon just like everyone else once the last out was thrown in 2015, but fans are so outraged by papelbon they've started a collection to charity donation on twitter if papelbon is measure that would have canceled funding for planned parenthood. kevin mccarthy has announced he's running to succeed john boehner as speaker of the house, but the california republican apparently did not want to talk about it to the press tonight. mccarthy quietly slipped out of an event where he was honorary chairman, a gala for charity foundations created by actor kevin spacey and orioles legend cal ripken, jr. a possible plea agreement in the case of former house speaker dennis hastert, the word of attorneys who went before a judge in chicago today. hastert pleaded not guilty to skirting federal banking laws. the 73-year-old republican is accused of paying $3.5 million to coup sexual abuse allegations -- cover up sexual abuse allegations. hastert led the house nine years retiring at the top of his power in 2007. virginia governor terry mcauliffe denied a last minute attempt to delay the execution of serial killer prieto. his attorney said he should not be put to death because he is  intellectually disabled. in prince george's county tonight students who do not have their immunizations have two days to get them or they will not be allowed back in school. some 3,000 kids in the districts don't have their booster shots. that's about 2% of the school's population. the school is calling apparents to led them know about the dead -- parents to let them know about the deadline. if moving southwest right now, but it's going to change direction. it will move west a while. it's never going to reach hurricane force winds. by thursday it's still well off the coast of florida and not any problem. then we get into saturday about 8:00 at night. now it's off the delmarva and this could cause some problems for us friday night and saturday. there's going to be a frontal boundary right along the eastern seaboard. it will probably absorb that storm. that could give us hefty rains friday night and saturday. let's start with a live look outside, our live michael and son weather cam, 73, like late august, dew point almost 70, kind of sticky. so headlines, morning commute is mainly dry, a couple isolated showers. that's not the main event. bus stop temperatures 64 to 74, dropping the kids off you'll be dry. when you pick them up, i would recommend driving and getting ready for big storms. yellow weather alert tomorrow afternoon and night, heavy to severe storm between 3 p.m. and midnight. 6 a.m. a couple spotty showers, 60s to around 70. by 9:00 temps around 70, cloud. by 1:00 showers developing to the south -- clouds. by 1:00 showers developing to the south of us and becoming heavy. you see red and orange, that's heavy activity at 6:00. look at all the red between 6:00 and 10:00 go through the western suburbs around manassas and leesburg and crossing over the river into montgomery county, temps still around 70. we're talking heavy activity and even at 12:30, 1:00 we have heavy storms pushing through the immediate metro area crossing over 95. if you download our app, you can track the storms with it and get severe weather notification. 76 at 11:00 with clouds, 79 at 1:00 with showers on our door step. showers and storms possible wednesday, 77. that, too, may be a yellow weather alert and on thursday more showers, upper 60s. over the weekend we'll have to watch what joaquin does, morning showers on friday, but despite what he does, showers are still in the forecast saturday for the terps gay and lawyer's homecoming -- terps game and and dry for the burgundy and gold. >> the season game such a disappointment they're ready to end on a
