trial against former penn state president graham spanier. >> he is accused of putting children at risk by not to go more than about blend jerry sandusky and a young boy in the shore in 2001. skim curly and gary schultz were also charged and both accepted a, plea deal last week. they could be called to testify, against the spanier. >> for more on today's jury selection, and impact on curly and schultz guilty pleas, of course, we will bring in our legal analyst ken rottweiler. >> good to see you too, thomas , alex. >> what are current charges, that we can expect here begins spanier. >> there is two counts of endangering welfare of a child and that is a felony charge. also a conspiracy charge. but lets get back and fill in the blanks as to what happened because it is kind of interesting. remember mcqueary the assistant coach. he saw, supposedly sandusky, you know sexually messing around with a child. what he did was he went and told paterno. here's where it becomes interesting. paterno tells curly the athletic director. curly then goes and tells schultz, who is the vice-president, at the institution. so curly and schultz then bow meet with mcqueary to substantiate what mcqueary saw and then curly and schultz supposedly told spanier. now, the whole problem with the case is, nobody told the authorities. that is why spanier is being, you know, charged in this case and there is a trial. curly and schultz already pled guilty. they said yeah, okay, we should have told somebody. we didn't tell anybody. >> they said they didn't believe it was that severe as mcqueary said. >> they said it was horseplay, okay. mcqueary said i didn't tell them it was horse play. mcqueary was very precise in his language when he testified that he told them both this was sexual conduct that was going on between sandusky and these children. so now the question is, you know, did what did spanier any , what did he did and we will have a trial. >> how will you mention the other two curly and schultz, the fact that they did a plea deal how does that affect what will happen with spanier. >> it will have affect it a lot, because i think what happened here. a deal was made. curly and schultz will go into both testify. they will both testify a again spanier and they will testify very clearly that they both told spanier about what was going on and that spanier didn't do anything. actually, 2001 e-mail that will be the crux of this trial that basically is an e-mail between curly, schultz, and spanier that basically says, you know, it talks about we better tell the authorities but, you know, is there other considerations, that they talk about in the e-mail. that e-mail will be front and center in this case. >> what would spanier's key fence. he has revealed that he has dealt with abuse by his own father, do you think he can say hey i have dealt with this , this is not something would i ignore. kanye that as a defense. >> he can try but i will not go over big. either you have responsibility to tell authorities or not, right. what he is saying i'm very sensitive. don't you think i would have gone forward and done the right thing i think testify may be you didn't do the right thing because if the jury believes curly and schultz that they told spanier about this thing that was happening with sandusky and children and fact that spanier didn't go tell police that will look back for spanier. >> he will take the stand. does that i am pack at all when it comes to the jury. >> it does, normally you don't have a defendant take the stand but spanier is very confident that he thinks that he will be able to explain to a jury what happened here and that he didn't, you know, go forward and didn't need to go forward and they were trying trying to to handle it internally. therefore he is not guilty. maybe a jury will believe that >> if he is convicted then, how much time or what could be the sentence here. >> that is interesting, sentencing. sentencing of curly and schultz has not happen. it will happen in the 90 days. that is why they have made a deal because they want to see how curly and schultz testify. if they testify the way that the prosecutors want them to testify, then the prosecutors will be looking for a long, you know, prison sentence. i think they will get probation. i don't think they will spend anytime in deal because of the deal. >> even spanier. >> now spanier if convicted i think will spend time in jail because then because he was tried and convicted. that is different then a plea deal. spanier is taking a risk here. spanier could have taken a deal. >> he reject it. >> he rejected the plea deal because he said i didn't do anything wrong therefore i will not plead to something i that did not do. curly and schultz felt you know risk was just too great and they decided to plead, you know, take the plea deal. it will be real, real interesting. remember here, remember that louie freeh report, okay. louie freeh report, conclusion he found was that curly, schultz, spanier, paterno all concealed critical facts. what is interesting here and it is not talked about here if joe paterno were alive i believe he would have been charged as well. everybody in the chain was, you know, charged. remember, mcqueary first told paterno. paterno told curly, curly told schultz, curly and schultz told spanier. they were all charged. if paterno were alive i believe he would have been charge as well. >> this could unlock mysteries >> i think for penn staters and i feel bad because i have a lot of friend that went to penn state, it is a great institution this may be the final chapter and trial. once thinks over i think that we probably won't be hearing about, you know, too many casing ago begins penn state anymore. we will be just routeing for penn state football. by the way, i had villanova in my bracket as well. so, i'm out. >> yes. >> that is exactly right. >> good to see you. >> good to he sue guys.
