>> she was pronounced on the scene. right now we're calling it a suspicious death. we're waiting for the medical examiner's office do an autopsy. >> reporter: homicide detectives dispatched to the scene inside the park. police say the woman went outer for a jog or a walk monday night and didn't return to her home on tolbert street off the back of the park. >> 9:00 p.m. she weren't out for a walk or jog in the area. she wasn't heard from her. her husband got nervous. got concerned. >> reporter: neighbors say the victim belonged to the winchester swim club, a few blocks from her home. this club member saw her on sunday. >> she always was a really nice person. she always had a smile on her face. i'm shocked to be honest with. >> reporter: word of the discovery stunned this neighborhood and had many worried about their own safety. >> very scared for my kids. very scared for myself. >> women out there jogging or walking should be with someone else with them for protect. >> i'm just kind of shocked to be honest with you. it's sad. it's really sad. >> reporter: now fox 29 is release the victim's name police have not disclosed it pending the out come of the autopsy wednesday morning. they are trying to determine if this crime could be connected to any other crimes in that area. we'll have much more on the investigation coming up at 6:00. dawn? >> thank you, dave. happening right now, the after mantle from a nasty tour bus collision in new york's times square. the buses crashed near seventh avenue and west 47th street this afternoon. dozens of emergency responders are on the scene and at least 11 people are hurt. authorities say some of those injuries are serious but they are not deadly. the double decker buses appear to be from two different tour companies. no word yet on what caused the collision. >> also happening right now, the search for a trio of vicious assailants police say punched a young woman who wouldn't give up her phone. a camera caught the whole thing. it happened last week on the 1500 block of 18th street. that is in north philadelphia. the woman says she was walking home from work when she got to her house the three men walked up and demanded her iphone. she says they punched her over and over. they took off without her phone. and she ended up at the hospital with injuries to her face. in berks county two people face charges in an assault at a school for children with special needs, and for trying to cover it up. detectives say it happened in april. at the paramount academy in reading. they say behavioral specialist at the school slammed a 14 year old student against a classroom door before pinning him to the floor. the teacher in the classroom theresa biff sense first told police the student had been disruptive. police say she later admitted she had lied. paramount academy's executive director release add statement in part which reads "the incident is unacceptable and the school is terminating both employees. ". >> and to your fox 29 weather authority now. our eyes are on the tropics. tropical storm bertha is churning and could eventually create dangerous conditions at the shore. here's chief meteorologist scott williams. scott? >> that's right, dawn and lucy. of course, we continue to watch tropical storm bertha hundreds of miles away from the shore. but it's creating large swells and that means dangerous rip current threat passion we continue throughout the week. otherwise, it's been warm and humid across our area but the latest on the tropics bertha now at 50 miles per hour racing rapid toll the north northeast at about 21 miles per hour. but once again we're looking at impacts down the shore because of the dangerous swells creating those rip currents. it's going to head out to sea but over the neck several days we'll continue to have some impacts down the shore because of those rip currents. so if you're caught in rip current, don't panic and swim parallel to the shore. also, tack near kabul. the major general is the highest ranking american casualty in the war in afghanistan. the pentagon says a man believed to be an afghan soldier opened fire at a military base near kabul. army official says the man shot at a group of foreign troops. 15 people are hurt. half of them are americans. the shooter was killed. this story is still developing and we'll bring you updates tally reports tonight from atlanta. >> reporter: right before lunch, 59 year old nurse nancy wright bowl lapped in georgia at dobbins air force base to get treatment for the often deadly ebola virus. in a specially equipped ambulance with staff in protective gear, the gravely ill christian missionary made her way down a busy atlanta highway. she was led into em morrow university hospital on a stretcher to join dr. kent brantly in a clinical isolation unit. dr. brantly arrived here saturday walking with help into a hospital. up to speed and ready to handle deadly diseases. it was encouraging both not that long ago seemed to be rushing toward death until they were given two things. a blood tran fusion filled with antibodies from an african boy who survived and an experimental recovery. >> police say a man injected a kitten with heroin and dragged the kitten by a rope from a car. a police officer says this happened in west white land township on sunday night. a vet used the heroin overdose drug narcan to revive the kitten and it is expected to be okay. james myers is now under arrest and facing animal cruelty and drug charges. >> in delaware, police catch up with homeless man they say was shot with a woman at a home he was trying to burglarize. it happened just before 5:00 this morning on the 19 hadn't dread block of west newport pike in stan tone. the home is vacant and under going renovations right now. the homeowner stopped by and came face to face with 21 year old gregory alexander. police say the woman shot him after a brief struggle. alexander took off but police found him in the wood as short time later. ness stable condition and facing several charges tonight. a south philadelphia mother who has a permit to carry gun but was busted in new jersey where the permit isn't recognized suffers another defeat today. allen bought the gun after being robbed and beaten in an alley off south street last year. she was arrested with the gun during a traffic stop on the ac expressway. allen says she didn't know new jersey doesn't honor the permit and now faces a possible three to five years jail sentence. a judge today refused to dismiss the charges or allow her to enter a pretrial program for non violent offenders. >> a big scare tonight for a philadelphia flyer and right now his future in the nhl hangs in the balance. our howard eskin who shortly after the season signed on for another year with the flyers to come back and play here but it was discovered has blood clots in both lungs and the calf of his right leg. he played with the considering appealing the bail granted to four philadelphia police officers accused of corruption. six officers face charges of using their positions to rob drug dealers of money and drug. a judge placed officer john spizer on house are rest today. officers brian reynolds, perry bets and linwood norman are out on bail right now. officers michael spicer and thomas lick kerr dell low being held without bail facing the most serious charges. the son of a popular and powerful lawmaker is under arrest tonight charged with defrauding banks and irs of big bucks. he's also charged with theft from the philadelphia school district. chaka fattah, jr., turned himself into federal authorities today. his father is a long-time congressman. fox 29's bruce gordon is live at the said federal courthouse in philadelphia with details of the case against fattah, jr. bruce? >> reporter: 31 year old chaka fattah, jr., long presented himself to the public as a successful and savvy businessman, a consultant specializing in educational programs but federal prosecutors say he's a con man bilking banks and others out of big money misusing those funds to pay off personal debts. website for fattah, jr., consulting firm 259 strategies shows him smiling broadly under a caption describing him as an experienced business executive, entrepreneur. prosecutors call it a sham. >> the indictment alleges that mr. fattah gave false and fraudulent financial information to a series of banks to obtain commercial loans over period of years. generally he told the banks that he had been a successful businessman and gave them financial information about the am of earnings he had had over a period of time including at one point entirely fictitious united states income tax return to persuade them to give him loan. >> 23 count federal indictment charges the son of long-term philadelphia congressman with more than $200,000 worth of fraud from 2005 through 2012. specifically, fattah, jr., is charged with lying to banks to obtain loans. misusing loaned money for personal use. failing to pay federal taxes, even cheating the philadelphia school district by inflating expenses on a district contract to serve at risk students. >> the indictment does not identify the amount of money taken from the school district. it was a substantial sum of money and the evidence will show exactly how much that was. >> reporter: the indictment alleges that in 2011, fattah, jr., borrowed money from a bank for business purposes then used more than $33,000 of the lone proceeds to pay down gambling debts at philadelphia's sugar house, harrah's casinos. his demeanor at this point? >> i really can't make any comment yet. i've had very limited opportunity to meet with him. >> reporter: claiming his innocence? >> i can't say much of anything. i'm sorry. i just met the man. >> reporter: fattah, jr., had been out of work for quite sometime thus cannot of a forward his own attorney and thus the appointment of the federal public defender. this investigation has been on going for couple of years. he has always maintained his innocence. he'll get a chance to make a formal plea at his arraignment scheduled for next thursday here in federal court. a written statement from the philadelphia school district says as follows, if these allegations are true, we would be quote very troubled to learn one of our vendors has taken advantage of the district and its students especially during these tough economic times. lucy? >> all right, thank you very much, bruce. it is a big day for these montgomery county k9 officers. look how proud they are. today they received their official badges clearly identifying them as police dogs. last month pennsylvania governor tom corbett signed rocco'ss law. it recognizes four legged officers as partners and gives a maximum penalty of 10 years in prison and $25,000 in fines for hurting or killing a dog. rocco's law comes on the heels of a fatal stabbing of a k9 officer earlier this year. >> it has been 50 years sin the release of the first kennedy half dollar and today a new one was released for the very first time. it's solid gold and fox 29 >> 38 year old mother of two was strangled in upper darby. that's according to the medical examiner today. griffin's body was found on sunday. police want to talk to her boyfriend. but right now he is under arrest in florida. facing dui charges. the boyfriend is not been charged or named as a suspect in her murder but police are working to interview him. >> tonight fox 29 investigates what does a gathering harrisburg bar have to do with a new casino in philadelphia? right now a lot of money is on the line with companies hoping to cash in. but the question is, is everyone playing the game fairly? fox 29's jeff cole with a closer look. >> reporter: cass zen know gaming in philly. the stakes are high and the money is big. it's why four groups have produced glittering mockups of what they think new cass zen know in the city should look like. the state will soon hand out one more casino license here and all four applicants want it badly. >> commissioner, is this a fair process? >> yes. report roar william ryan heads the board which will make the call. we had an important question for him. >> did those commissioners make bad call by meeting with him during this high stakes process. >> i'm not going to say that, no. >> reporter: you heard right. fox 29 investigates has learned there was a gathering in this bar at the harrisburg hilton after 8:30 on the night of tuesday, march 18th. sitting at one of tables were two members of the pennsylvania gaming control board. the panel which will award that casino license. commissioners anthony moscato and keith mccall. while there, they were joined by long-time harrisburg lobbyist rocco pugliese pictured here on the website of his lobbying fi firm. pugliese lobes for market east associates known as market eight they're one of the groups vying for the philly casino license. >> the place is full. there were lot of people in the place. >> reporter: state representative mike vereb walked into the bar and saw them. >> you see the two gaming board members and the lobbyist. you walk up to them because you know the lobbyist and one of the members. yes, i do. i just said hi. went about minding my own business to be honest with you as much as i've been involved in gaming i never would have thought either the two of them would participate in anything inappropriate. never came to my mine. maybe a bad decision was made if they would have gotten together. >> both commissioners say they did nothing wrong. as for gaming lobbyist rocco pugliese -- >> he went in. let's go in and see him. >> he shut the door when we tried to ask. >> you know me, i'm jeff cole from fox. don't -- don't shut. wait, one minute. rocco! >> just the gathering of two board members and a casino lobbyist raises the question of whether the gaming control board's code of ethics was broken. according to the code, it's designed to prevent the actual or appearance of corruption and the avoid dance of actions that would erode public confidence. the ethics code specifically bars communication between license applicants and board members about any matter which may reasonably come before the board. awarding the new philly casino license is before the board right now. so during a recent meeting of the gaming control board we asked commissioner anthony moscato -- >> did you have drinks with rocco pugliese who represents market eight? yes, i had drinks with rocco pugliese. >> reporter: if he crossed the line. >> i did not believe it did because we did not discuss the philadelphia licensing issue. i've known rocco for 20 years. commissioner mccall has known rocco for many decades. we all know the perimeters we can cross. we do not live in a cloister. and we're just old friends. >> reporter: commissioner keith mccall didn't show up at the board meeting he says due to a medical procedure. by phone he claimed he did not discuss the philadelphia casino license with pugliese or break the ethics rule. but his recollection of what went on in the bar difference from months cotto's. while months cotto says they did have drinks with lobbyist pugliese mccall says they did not. mccall claims pugliese sat for two or three minutes and left. he says he paid the bar bill and even sent fox 29 a copy. six drinks for he and months cotto charged to his american express guard 88.50 with tip. >> again, we tried to question lobbyist pugliese at his shore home. he wasn't interested. >> you know me, i'm jeff cole from fox. don't, don't -- don't shut -- wait one minute. rocco! >> reporter: gaming board head bill ryan says all is well. >> they've cleared him. it's okay. there's no -- the board is aware of the meeting and of the explanation given by the two members and we on the board are comfortable with the matter is closed. >> reporter: it's not closed for representative vereb he says on april 2nd after receiving this anonymous letter describing the very meeting he'd witnessed in the bar he called in the gaming board's executive director and state investigators handed them the letter and told them what he saw in the bar. >> what is disturbing in all of this is that the bureau of investigation enforcement charged by statute to oversee the gaming law has been radio silent on the matter since it's been handed to them. >> reporter: you must have told chairman. >> would you please move out of my way? >> reporter: theirs one more thing. moss cotto grew tired of our questions and walked off but not before a man he was with tried to block our camera. >> oh, stop. stop! we've got a right to shoot him. >> reporter: before he left, we asked if he communicates with casino lobbyist pugliese in another way. >> have you ever had cell phone texts contact with mr. pugliese? yes, i have. >> reporter: once begun, is the perception something you may have failed. >> no, it's not. i don't know how long you want to go on eau with this line of questioning. i don't feel i made a mistake. you may. other people may. we have not talked about the philadelphia licensure. >> reporter: fox 29 investigates has made what's called a right to know request to the board for those text messages. we are waiting. in an e-mail to fox 29 the gam gaming board said the conversation in the bar focused on a change of leadership at the university of pittsburgh not gaming. it says it has spoken to mccall and months cotto and believes there was no violation of its ethics code. as to moscato's claim they that had drinks with rocco pugliese the board now says he was speaking in a generic sense and that the three men did not have drinks together. jeff cole, fox 29 news. >> free drug tests for 10 to 12 year olds? another warm and humid day and then get ready for a few widely scattered showers and thunderstorms tomorrow. and then for the latter part of the week we're talking about low humidity behind a cold front that will be moving through. as we look at ultimate doppler are the now it's dry and quiet across our area. but take a look toward the central part of the state. showers and thunderstorms around the williamsport area. some of that activity could clip the pocono mountains as we move into tonight. the forecast path though as we focus in on bertha moving well out to sea. hundreds of miles off of our coast. but we get the on shore flow and and that it moves back out to sea with dangerous rip currents so certainly obey those warnings down the shore the next several days as we watch bertha pull away. our temperatures today have been in the upper 80s. still waiting on the official number to come in but we were right about average for today's date. right now, temperatures still pretty warm. 88 degrees right now. humidity at 37%. and the winds are calm but take a look at the temperatures. in the poconos pair of sevens. 86 in wilmington. here's the satellite/radar. you can see out ahead of a front we're watching the winds out of the south pumping in that moisture and here's the front that will be moving through during the day tomorrow to perhaps give us a few scattered showers around. the timing tonight, you can see north and west we could see a spotty shower move through the poconos but most of us stay dry until tomorrow. tomorrow morning, mild, muggy, a dry start and then during the afternoon, we could see once again some wildly scattered showers tomorrow is not looking like washout whatsoever with this system as it looks like a lot of the moisture will stay to our south. but recapping tonight, mild, muggy 60s in the suburbs. right around 70 degrees in the city. 86 degrees for the high temperature tomorrow once again with those widely scattered showers around. but take look at the changes as we move toward the latter part of the week. low humidity, 84 degrees for the high temperature by thursday. friday low 80s. and right now, the weekend looks pretty good with temperatures below average in the low 80s for highs. >> all right. we'll tack it, thanks, scott. >> howard eskin you're following big news for the flyers today. >> yeah, it's not good news either. the flyers did not get the good news today. flyers defensive man kimmo timonen may have a career ending medical problem which was discover. he has blood clots in both lungs and the calf of his right leg. now talking to medical people tonight, they tell me he probably most likely has to go on blood thinners and will not play for at least four months while doing that. the flyers are first concerned, however, about his health. timonen first discovered a pain in his right calf and saw and consult add friend. he was a doctor. and when he went to the hospital they discover the clots. he played seven years with the flyers and signed another contract after last season to play another year. but the flyers don't think he's coming back any time soon and maybe not at all. >> i can tell you as an organization we're going to plan, he's going to be out for while, which, you know, we don't have a definitive time period but we'll plan he'll be out for while and we'll do what we have to do to, um, make the team better. >> all right. the eagles it gooding close to playing a football game and for some players it's really exciting. now, we know the rookies and the new players the team have to be really excited. but there's one vet that's really pumped as well that would be jeremy maclin the wide receiver he played four years eagle in his career but missed the entire 2013 season. now this will be his first game since december of 2012 because in last training camp he suffered a season ending knee injury. so don't think the rookies are the only players really excited. >> i'm trying not to let it get to me but it's going to be special. like i said, man, like you just said, i haven't played in two years, um, i mean, i'm looking forward to it. i'm excited. >> all right. really special person at training camp today. that would be former head coach of the eagles dick vermeil he took the eagles to the soup bowl in january of 1981 but the practices are a little different than when he coach the eagles. st. louis or kansas city. but vermeil was impressed. >> you know, it's fascinating that me. the amount of work they get done in two hours. i've never seen it done as well and fishily as they do it here. it's amazing. >> there are going to be a lot of people learning from these guys and the league will adjust to trying to corporate how they're doing it here. they're all limited timewise. so the more work you get done win the time you're limited to, the better team you become, and they're setting the item tempo. >> you won super bowl. what does it take -- you gotten there twice. you won once. what does it take for team to get there. >> you have to have a quarterback. i think they got one. you have to have a running bag. they have got one. you got to have wide receiver they've got one. a great tackle. they've got one. >> you got to have a great pass rusher. i don't know if they have one. you got to be somebody. i think even more so today because you can't cover physically any more you better be able to rush. i think someone has to be -- asked me not too long about it. how long will it take the eagles to be in the super bowl. i think within three years. >> so this -- one of those three years could be this year. sure. >> do you agree? >> yes, i do. i actually think they have -- they will be in the super bowl i say that definitively in one of the next three are warning women who walk or jog in pennypack park to travel in pairs for their own protection. that after the body of that woman were you found in the park early this morning. tonight neighbors in that area are clearly on guard. neighbors in this tight knit community off holme avenue were stunned by the discovery of local woman's body in penn know pack park near the crispin gardens athletic fields near convent of a early tuesday morning. >> very scared. very scared for my kids. very scared for myself. >> right now the death is ruled suspicious death for lot of different reasons but i can't say anything until the post is done and we have a definitive answer report roar police say the 46 year old woman was discovered by a passerby just after 6:00. investigators believe the woman went out for a jog or a walk from her home just off the back of the park like she does several times week. she never returned home. >> about 9:00 p.m. she went out for a walk or jog in the area. she wasn't hurt from -- heard from her husband. got nervous got concerned.
