surrounded by law enforcement and escorted into the criminal justice system in philadelphia. he was at the controls of amtrak train 188 on the night of may 12th when the train left the tracks. landed in a pile of twisted metal. eight people were killed, 185 others were hospitalized. bostian had accelerated to 106 miles an hour as he entered the frankford curb where the speed live is 50. you no doubt heard those numbers since the accident. partly about it's journalistic shorthand, any two or three, word description of what happened must include those numbers and partly because the attorneys who filed civil lawsuits on behalf of the crash victims and fought so hard had repeated the numbers over and over again to anyone within earshot. that's ok. that's their job. their advocates for their client. but there's another number, 110, when i was in washington, dc covering the national transportation safety board's report on this crash, i snapped a photo of the train's route that night. notice the speed limit coming out 110 miles an hour, that's the speed limit trains can leave that. criminal charges suggest brandon bostian was negligent or criminal and prosecutors with the attorney general's office will make the argument bostian knew his route and should have known his speed limit, a jury will ultimately decide that. before you cheer too loudly over bostian's arrest, you should know he was not impaired by drugs or alcohol, wasn't distracted, following around on his phone. instead, the ntsb believes bostian was, in fact, distracted but by an incident moments earlier in which a vandal or vandals threw rocks through the windshield of a nearby septa train sending glass into the face of a fellow engineer. bostian spent time on the radio keeping updated on that situation. >> he went >> the investigators believe bostian acceleration to 106 miles an hour was consistent with a belief that his train had already passed the curve into an area of relative straight track where the authorized speed was 110 miles per hour. officially he was ruled to have lost situational awareness, bottom line, he's captain of the ship, it's his fault when it crashes and of course, amtrak deserves some blame for dragging its feet on track technology that would have automatically slowed the train to avoid such a catastrophe. the why amtrak settled all the civil lawsuits, wrote a massive check for more than a quarter of a billion dollars and also the reason brandon bostian will never get behind the controls of another train as long as he lives. but criminal charges? forget the comparison you heard over and over about what would happen to you if you drove your chevy 106 miles an hour in a 50 miles an hour zone, there's no scenario which driving your car, truck or suv at more than 100 miles an hour is ever ok. ever appropriate or legal. but for a train, the scenarios do exist. did exist. that night. not so far away from where brandon bostian crashed the train and immediately became public enemy number one. what happened there night was terrible. claimed eight lives and damaged many more. was it a crime? don't be too sure. only in philly. >> bruce was one of
