is bruised but talking to fox 29. thanks for joining us, i'm iain page. >> i'm lucy noland. this all started over an argument about a sandwich. fox 29's shawnette wilson spoke to her live now outside of southwest detectives. shawnette. >> reporter: i caught up with the victim as she was opening up her store tonight and honestly, i still cannot believe what she told me that she said to her attacker that set him off. apparently, she was tired of being disrespected by customers but things did not turn out the way she thought would it. why would somebody go off on woman like this? i talked to the victim after it happened and i still can't believe what she said. >> i said, say the one more time. >> you're stupid. >> she actually called him stupid. she was charging him $5.99 for cheesesteak he only waited to pay $4 he got mad and started arguing but then this happened. >> watch video and you see him get irritate irritated and squea bottle of choose through the glass. the woman behind the counter is the owner of day late deli where it happened. she says that set her off she ran out to confront him. >> i talk to him. i fight with nobody. >> reporter: this guy clearly did not want to talk. so he began punching her over and over and over. >> never thought he going to hit my face. >> reporter: her knows and eyes were swollen. we went to the pizza shop across the street to see if they knew what happened. marie perry had already seen the video. >> it was crazy. she's such a nice lady. >> reporter: she says it totally shocked her the woman came from behind counter which was probably the safest place she could be. >> it did. it did. it did. i was scared for her. like i couldn't believe -- i would -- i would never came from behind the counter. >> reporter: the victim wasn't expecting what happened to happen. >> most customers are very nice. very nice. >> reporter: we didn't note victim's face because number one she's badly bruised but number two she believes this guy is pretty regular customer. so lucy she's hoping that neighbors will help police track him down. >> all right. hopefully it happens. thank you so much, shawnette. >> rain with all kinds of stuff some of that heavy rain is moving over the philadelphia area as we speak. some of those yellows now moving into south jersey, but philadelphia county into parts of montgomery county, even into the lehigh valley this will be moving out within the next two hours. look at the temperatures. 46 in philadelphia. 50 in dover. and millville it's 47. so a huge surge in temperature through the whole region overnight that's a warm front moving on through. so we'll say goodbye to the rain during the early morning hours. temperatures will be rising and by 1:00 a.m., they should be out of here. skies will be clearing by tomorrow morning. and then the change begins. we are talking about the warmest air yet. coming up in the seven day we'll talk about those numbers to beat because we're challenging kathy. police who are looking for the killer of 26-year-old man in the west oak lane section of the city. it happened along the 7800 block of baldwin street right around 5:30. investigatoinvestigators say heg a car when someone shot him four times and he died. >> in camden police are investigating after an elderly man pulled a gun on himself in a hospital. spokesperson from the lords medical center says the 72-year-old was being treated at the hospital this morning when all of a sudden he shot himself in the head. no staff, patient or visitors were in any danger he's now in critical condition right now. looks like president-elect donald trump going to take his volatile relationship with media with him to the white house. in a news conference since july the president-elect be rated cnn the under secretary of health with the obama administration. trump says he interviewed at least 100 people for the job. our city will be represented at the inauguration next week. the first troop philadelphia city calgary will be marching in the parade. they practiced tonight in valley forge. they are the country's oldest continuously serving unit. the inauguration is next friday, january reporter: this has been an issue that has had many people here in the gayborhood talking for months but despite this meeting we were asking where was everybody? taking action in the gayborhood. the philadelphia commission on human relations meeting with members of the lgbtq community to show them how to file complaints after numerous claims of discrimination in recent months. >> gays are being attacked. whites are being attacked too. straights and blacks. >> howard brown says he came to the meeting after witnessing an attack at a church. >> somebody came in and attacked an african gay american with a knife, and said he would come back and attack whites and black in there. >> reporter: he listened as officials with the commission explained how complaints would be handled. >> so long as it rises to the legal standards, we docket it, investigate it, and it's a long process but there's opportunities to settle the case, to mediate. >> reporter: we couldn't help but notice surprising few people showed up to the meeting after numerous accusations of racism at gayborhood bars and other businesses. one protest group even interrupting mayor kenney pressing him for action during the city's pride raising flag ceremony this past october. >> i think there is -- there's always been annealed always ban need. >> reporter: she insists the city is taking appropriate action but we went around the gayborhood tonight to fine out why more people were not at the meeting. they either were not around or didn't want to talk. but fitzpatrick says the fight for equality is far from over. >> the racial discrimination and the racism we've seen locally in gay bars that exists in places outside of the gayborhood as well in our city and in our nation. >> reporter: we're told the city will shooting in camden. police responded to the 2700 block of federal street this morning for a report of domestic violence. when thee police got there they saw a man armed with a gun. prosecutors say that police shot the gunman as he approached woman in the home. police identified him as 38 year hold jose ventura. he and the woman are in the hospital right now. accused of carjacker brought down by the gun of a good samaritan. police say they chaotic confrontation unfolded as suspect tried to steal a septa truck. >> that 32 year old man expected to be charged at some point. bruce gordon reports some witnesses were not going to let him get away. >> reporter: the scene at 63rd and woodbine looked like something out of the an action movie but it was all too real. this catholic priest father matthew fail land had a front row seat. >> at that point just thinking i just hope nobody is dead. >> reporter: it started when the driver of this dodge charger blew a red light at the intersection and rammed this car setting off a chain reaction that actually damaged two other vehicles. the driver of the charger ran down 63rd and came upon the driver of this white ford. >> the offender tries to get into his car and carjack him. he's able to keep his -- pulls his car door close and fight him off. >> reporter: this man was the driver. >> came and pulled me out the truck much that's all i can say right now. >> he physically grabbed you? >> putt pulled me out. >> reporter: police say the carjacker sideswiped two parked cars and then hopped out racing back to the accident scene at 63rd and woodbine with the driver of the first car he was permitted to carry handgun in hot pursuit. joe kell al high school freshman was a passenger in one of the cars from that original accide accident. >> the man with the gun was yelling to stop him, tackle him since i think he tried to break into his car. so i ended up just tackling him and bringing him to the ground. >> the father picks it up from there. >> they tackled him he got up and began coming at the this other guy. the other guy said something to him, then a lot of shouting commotion and in the street and then he pulled a gun and very calmly and i think he gave him a warning or something and then the guy came at him and he shot him. >> he didn't want to shoot him. clearly didn't. he was just trying to be protect full citizen and protect people around him. >> reporter: police say the good samaritan in this case described only as 34-year-old philadelphian man will likely not face criminal charges for his actions as for the carjacker a 32-year-old philadelphia man with no criminal record they couldn't find drugs or weapons in his car. they're at a loss to figure out why he would have taken a basic car accident and turned it into something potentially deadly. i'm bruce gordon fox 29 news. three men climbed through a small glass window at a northeast philadelphia gas station. once they come in, something else came out. lived a long life of abuse. that is what the lawyer for the girl's birth parent is saying tonight. this week prosecutors say 14-year-old grace packer died in a rape murder fantasy carried out by her adoptive mother sarah packer and packer's boyfriend jacob sullivan. lawyer for the girl's birth parents said her biological parents lost custody of her as a toddler. why? over allegations that other adults were sexually abusing their children. later her adoptive mother's ex-husband went to prison for molesting grace. investigators say grace died last summer. hunters found her dismembered body last october. several men are wanted to night for stealing from atm after atm in northeast philadelphia. police say the burglars gotten away with thousands of dollars. >> the rash of burglars started back in november and police want them off the street where is they hit again. fox 29's dave schratwieser is live in northeast philadelphia outside of one of the businesses that got hit. dave? >> reporter: iain, this is one of the six businesses at the burglars broke into. in fact, they stole $7,000 out of this atm machine right inside the front door but police say they not only had a taste for cash, they had an appetite for sweets. >> they bend, pry, hammer. >> reporter: specialize in brute force first they break into a business then they smash open the atm and make off with the cash. in some cases lots of it. >> different amounts of money. sometimes really not worth it and sometimes they get lucky. >> same people come and rob store again. >> burglary spree started back in november when the bandits made a big score here at aria doors oil tours dale hospital they walked not lobby and walked away with the whole atm. loaded with close to $30,000 in cash. >> they're all clothed and they work in the middle of the night early morning hours. one of the videos they spend over an hour in place on new year's day. >> reporter: in all the burglars have struck at least six times. using this van forget away vehicle. they hit atm's at least five businesses in northeast philly and once for $10,000 at an atm in upper chichester. the atm at the red robin diner got robbed on new year's eve. the burglars made off with two grand. >> they just popped in the door, popped open the safe and atm and took the atm and it was gone. >> reporter: northeast detectives say this crew is resourceful they cut the alarm system and took $7,000 from atm from this store. >> at this gas station on oxford avenue they broke in the front door, ripped open the atm and took some cash. but then they helped themselves to lot of candy. >> they broke the door. >> reporter: the total take from these atm burglaries so far is about $50,000. no one has been harmed in any any of these crimes. police recovered a hammer they hope to get fingerprints or dna off that hammer. iain? >> dave, thanks. this huge mess in fishtown not going away any time soon. the philadelphia water department has offered to put up some people in the 2300 block of east boston street in hotels. street collapsed on sunday. they expect repair work to take longer. in the meantime they're shutting off water service during the day as crews make repairs and in addition $200 a night and hotels they'll get some money for food. philadelphia police are on the hunt for two men who barge flood a port richmond home wearing masks and got away with $15,000. investigators say it happened on the 3,000 block of memphis street. the men knocked on a woman's door then forced their way in. they made their way to the second floor where they found the cash and took off. no one was hurt. the family of a boy who was severely injured in a bucks county mall accident is now suing oxford vally mall and escalator company. his foot got caught inside the escalator. doctors had amputate toes op his right foot. the mall and shipped lower corporation were sued. both companies are not commenting. who can and cannot go to a high school sporting event? one local high school just set down new rules about just that. all spectators must now show photo id to watch the game at truman high school in bristol township. younger students have to have an adult with them. this stems from the cancellation of basketball games monday because of rumors that a fight was going to break out. pennsylvania governor tom wolf officially has a competitor for the neck election in 218. today state senator scott wagner of york county announced his bid for governor. this is video from an event earlier today. pipersville bucks county and one of six stops the republican senator is making over the next couple of days. he spent much of his speech slamming governor wolf. he says the governor is a major roadblock in harrisburg. >> it's very overdose so to speak of marijuana but basically that it would just run its course. >> police are investigating recreational marijuana is legal in massachusetts but it's illegal for anyone under the age of 21 to handle or ingest. in ohio prosecutors have charged the parents of five-year-old girl with her death. today appeared before a judge. ming ming chen and reported their daughter missing monday night. chen told police the girl went to the back of their restaurant to take a nap. when she wept to check on her hours later she was gone. they found the girl's body hidden in the restaurant. investigators say chen hit her daughter on the head, killing her. judge set bond for both of them at $5 million each. straight ahead 87-year-old marine veteran gets kick out of his home of 17 years
