good evening, i'm iain page. >> i'm dawn tim feature lucy is off tonight. the victim told state police the driver was aggressively tailgating him on the girard point bridge right around 6:30 this morning. he says that driver pulled up in the lane next to him whipped out a black semi automatic pistol and fired. the bullet hit victim's back tire on the passenger side. >> the victim could have crashed. he could have caused another crash. i mean especially on the bridge it's extremely dangerous. we need to get this person off the road. >> fortunately the victim was not hurt. shooter took off down the broad street exit after firing this gun. he's describe as black man between 30 and 40 years old with facial hair. he was driving a black chevy impala or malibu from the early 2,000s. if you know anything at all, give state police call. a man delivering food in southwest philadelphia neighborhood is shot in the head. the victim did survive. >> our dave schratwieser is live tonight outside the penn presbyterian trauma unit where that man is recovering. dave, you spoke to his family. >> reporter: we did. he's in stable condition after surgeons removed a bullet from his head. he was carjacked last night. taken to cobbs creek park, forced to his knees at gun point and when he tried to escape, he was shot in the back of the head. tonight, his family says this was a setup. >> not supposed to happen because somebody who is trying to survive. >> reporter: as thrive-year-old pizza delivery driver saru recovered from gunshot wound to his hospital tuesday night at the hospital his family was just thankful he's alive. >> he's very very amazing brother i never have in my life. somebody we do everything together. >> reporter: his cuss season says the hard-working delivery driver helped support more than 10 members of his family in africa including a three-year-old daughter. he also has a wife here in philadelphia. >> he's the only family taking care of them. >> reporter: he left the pizza shop to drop off a delivery in the 5700 block of beaumont. two men with gun forced him back inside his car and drove him here to cobbs creek park and forced him at gun point to kneel on the ground. >> as he's on his knees they go through his pockets. they get $60. they tell him that's not enough. the man threatens to shoot him. >> when he tried to run the suspect shot him in the back of the head. his cousin was one of the first people to see him in the hospital. >> he's dying. i said don't say that. >> doctors were able to save him and remove the bullet from his head. police recovered his car nearby. the suspect escaped with $60. the victim's cell phone and food from inside his car. >> just horrible working man has to sit here fighting for his life because of couple idiots who want a few dollars and some pizza. >> i feel like -- you took the money and everything why you shot him? they just want him to die. >> reporter: police are trying to get fingerprints off the victim's car they believe the two suspects with guns are from the very same neighborhood where that carjacking and robbery occurred. tonight victim's family tells me they're just praying he makes home hitting a five-year-old little boy. his parents heard the gunshots and tried to protect their children. you can see a bullet hole in their window. that five-year-old is in the hospital tonight recovering. fox 29's bruce gordon spoke to his mom about their terrifying night. >> reporter: a shattered rear window and series of shell casing markers just all all that's left a horrified mother the incident that nearly took her child away. there is one other grim souvenir. >> my little son will still have bullet lodged inside of him because of this ridiculousliness. >> reporter: it was just before 11:00 monday night latasha haze in her kitchen with fiance' and two younger children making a late dinner when shots rang out. >> me and my kids hit the floor. nothing else we can do. when i pulled my son down the bullet hit him in his chest and went up to his armpit and that's where it's lodged in at. four-year-old mariah was unharmed but five-year-old mark andrews, jr., was struck. >> what did your son say to you at that point? anything? >> he said, mom, i'm shot. that's what he said. >> reporter: chester police are calling it a drive by shooting. and say latasha and her children were not the intended targets. cold comfort to mom who spent the day in the hospital as her five-year-old recovers from bun shot wound. >> i'm raising great kids. check their track record. they shall not be going through no trauma like this. this is ridiculous. >> reporter: a year ago latasha's car was shot up. she says she's been driving for month to get the chester housing authority to move her and her family to safer neighborhood. now her mother mark's grandmother has had enough. >> people in chester need to start talking. this got to be to stop. somebody else child will be tonight or tomorrow. this has got to stop this violence. >> little mark could be released from the hospital with or without that bullet lodged in his shoulder. mom says he's been in great spirits looking i was police say is responsible fort murder of a southwest philadelphia man is behind bars tonight. 18-year-old quintis clark turned himself in to police headquarters last night. he actually is now been formally charged with murder, robbery and other offenses. police say clark beat and strangled 78-year-old joseph daily one week ago on the 6300 block of theodore street. neighbors say the victim a veteran was hard working and very friendly. it's good day for wine lovers the pennsylvania house approved a proposal that would allow to you buy it in supermarkets. let's get out to chris o'connell bit of convenience it will cost jobs. >> reporter: union boss for state store workers says this could cost jobs and ultimately lots of revenue for the state. he believes this is the beginning of a full privatization of the state's liquor system. >> going to impact their selection negatively much it's going to impact their pricing much it's going to impact the revenue the state gets negativ negatively. the only thing it will do make it ease your for people to buy wine in many more places. >> reporter: governor wolf says he will review this legislation but he is expected to sign it which 3-cent per ounce tax on sugar drinks in philadelphia they say it's the best way to fund expanded pre k and raise money for rex and rec centers. opponents claim it would hurt small businesses by in their glory days now the group director says the drum line is gone. >> apparently it just doesn't have the money to keep marching on. fox 29's shawnette wilson talked with students fighting to keep the group alive and joins us live from upper darby high school. shawnette? >> reporter: well the parents of those students say they are still unsure why the decision was made to end drum line, however, they do admit there have been problems with fundraising. tonight they spoke before the school board pleading with them to step in and help. >> ♪ >> we're just a family. i connected with people i never thought i ever would. >> reporter: 17-year-old zach schneider place base drum in upper darby dine drum line after playing for three seasons this one will be his last. >> really debilitating. like i -- drum line was the reason i came to the school the music program. >> reporter: he and other students say their music director told them drum line was ending. with no real reason why. he start the this facebook post with video he produced in hoping of saving the program. >> upper darby drum line has been a staple in the upper darby school district. >> reporter: it has more than 30,000 views for the group who traveled to ohio where they won a national championship three years ago. >> it's awesome. going out and seeing thousands upon thousands of people that love doing what i like to do is something that's really cool. >> reporter: tonight parents and students spoke during an board of school directors regular meeting. they're making a plea for help saving the drum line which operates solely through fundraising. >> lie yo sides has been the driver for the group for the past three years. he says drum line has kept the kids in line. >> keep the kids off the streets. it's something they love to do. the kids get a lot of glory and fun out of it, and they get a lot of respect from other plac places. report roar kids are left wonder wagon is next? >> i'm very disheartened that the program is over. it was a big part of my life. >> reporter: and back here live, some parents also tell me that they inquired about getting corporate sponsors which they say most drum lines have. they claim they were told by school officials they would have to get corporate sponsoring for the entire music program not just the drum line knowledge word tonight on whether service in the city's tioga section it mapped in maim police say the guy got away with customers tax information. police say the man took $100 in cash. so if you know who he is please call police. in bucks county, this sign on the side of the road has many people outraged. we first showed you this spray painted peace of wood last night at 10:00. tonight, police are speaking out bones are against when he saw a sign that said the only good cop is a dead cop. shocked by the sign mike flagged down officers believing that this was much more than a personal statement and couldn't be overlook. >> you have the right to free speech. but you need to use it wisely, and that was not -- that was not using it wisely. that was just out right stupid. >> reporter: falls township police greed and not only took the sign down, but posted a picture on facebook challenging the person who wrote it to come to the station to learn face to face about what police really do. stern words aside police told me this isn't a reflection of their relationship with the community. >> falls township we have a close relationship with our communities so to have somebody put up a sign like that out of the blue is a surprise for me. >> reporter:. facebook post generated numerous responses with most hoping that someone comes forward with information. the police made it clear that this is not being taken lightly and they would appreciate any help that neighbors can pro provide. >> if anything notice anybody anything about the individual that put the sign uppiled encourage them to contact us. >> reporter: until someone is arrested or questioned it's serious to know how a threat this really was for residents who support their local police they remain cautiously optimistic. >> i'm hoping it's some idiot misusing his first amend the rights. >> i was told that possible charges could range from terroristic threats to simple assault. but none of that matters if they don't find the person who actually put the sign up. so police are asking for your help. if you have any additional information, please contact them immediately. in the newsroom, i'm bill anderson fox 29 news. saint charles borromeo seminary in lower merion is looking to move. sky fox over the campus tonight. archdiocese of philadelphia says the seminary will look to affiliate with a local catholic college or university and move the entire operation to new buildings on or near the campus of that school. this news comes after an independent feasibility study. the seminary will abandon a prior plan to consolidate operations on its lower merion campus. it's been a spring full of bare sights in our area and chester county apparently also attracting the giant mammals much this black bear caught on camera in west whiteland township behind the oakland corporate center. police say there have been other sightings of this particular bear and still believed to be in the area. police say call 911 if you see the bear and do
