a former temple university employee. the incident more than a decade old. prosecutors with onlays days left to charge cosby before their time ran out. good evening, i'm iain page. >> i'm dawn timmeney. >> many wonder if today's charges will be the beginning with dozens accusors coming forward. chris o'connell is live you spoke with cosby's attorney, chris? >> reporter: i did, dawn. legendary comedian vowing to fight these criminal charges tonight. bill cosby's attorney telling us her client is in the and sexual relations between him and a colleague from temple university 12 years ago was consensual. >> mr. cosby, can you tell us anything? >> reporter: only fox 29 us what there when bill cosby left his cheltenham to home tonight with a suitcase. >> mr. cosby, you want to say anything. >> reporter: hours earlier the 78-year-old comedian looking frail and needing help walking was released op a million dollars bail after being charged with three counts of aggravated indecent assault. his attorney disputes the charges. >> this case involves a woman and a man who had a consensual adult relationship over time. >> reporter: montgomery county prosecutors say back in 2004, cosby met victim andrea constand who was work fog the temple university woman's basketball team. investigators say he invited her back to his cheltenham township home, gave her three blue pills and a glass of wine. she reported feeling rubbery and like jelly. she says cosby fondled her from behind, put his hands down her pants and assaulted her. >> charges today are filed as a result of new information that came to light in july of 2015. statute of limitations in this type of case is 12 years. >> reporter: prosecutors investigated the case back in 2005 but decided not to file charges. after cosby and his victim settle add civil suit, his attorney says the new charges filed less than a month before the statute of limitations expires are politically motivated. >> it's sad for his legal team, for his family, that he would be dragged through this. that this would be a political maneuver that this would be the fulfillment avenue campaign promise. >> reopening this case was not question, rather reopening this case was our duty. >> reporter: cosby's attorney also telling fox 29 the embattled comedian is now blind. >> the fact that he is blind is a fact of life. the fact that he's 78 years old and that he's being charged as a 78-year-old blind man 12 years after an alleged incident. >> reporter: now if convicted cosby could face a maximum of 10 years in prison. he's due back in a courtroom in mid january. montgomery county prosecutors putting out the word if there are any other cosby victims out there to come forward. iain? >> chris, thank you. meanwhile we got a clue today about some things we may see or hear at the trial. the lawyer representing 29 other women who say cosby drugged and assaulted them says they would be willing to testify against him. attorney gloria allred held a news conference in la this afternoon. criminal case brought in montgomery county happened within the statute of limitati limitations, allred says the statute has expired for many of her clients. nevertheless she says they are ready to help the prosecution. allred called today's developments historic. >> this is unprecedented. for so many women who allege that they are victims of one rich powerful famous man to have spoken out in the 40 years of law practice that i've been engaged in, i've never seen anything like this. all that said allred believes cosby deserves a fair trial and that she and her clients are looking forward to a just result. today. will continue to push across the turnpike and 95 and then continue to move out. so we're seeing this end from west to east. by the time you wake up tomorrow morning there may be some fog around. notice the clouds linger a bit. we're looking for this clearing here and we'll eventually see that by tomorrow morning. so there's this period in time between the rain ending and then that wind picking up bringing in the dry air we do see fog developing. 3:00 o'clock in the morning there it is but look at how it clears up by 11, 12:00 o'clock in the morning. there it is bright sunshine there. so that will help more of these temperatures warm up. remaining steady into the 50s. 45 in allentown. warmer to the south. we go up a little bit and then we plunge down. much colder weather coming in not only for the new year but few days after that. it's all in the seven day forecast much those numbers are coming. >> dave, thank you. just day after firing chip kelly we're hearing from the team owner about his decision, and the former coach himself met with our howard eskin. howard is here now with more on that. howard? >> well, it was a casual conversation as he was leaving town with his girlfriend taking along the dog, maybe one of the best conversations i actually ever had with chip kelly. now, one thing he did tell me is he's relaxed, comfortable and i mean it by looking at him, comfortable with the decision. i'll share more of what i can in our conversation that will be coming up later in the news. but jeffrey lurie made a statement today that explained what he's looking for in a head coach. but clearly it was directed as a criticism of chip kelly. >> you got to open your heart to players and everybody you want to achieve peak performance. i would call it a style of leadership that values information, all the resources that are provided and at the same time values emotional intelligence. >> i hope he can find that head coach. now coming up later in developing now an indictment for a friend of the san bernardino shooters. a grand jury tonight indicting 24-year-old enrique marques on several charges including lying when he bought the guns that were used in shooting of 14 people. conspiring with shooters sacred farook to carry out attacks in 2011 and 2012 attacks that never materialized. farook and his wife tashfeen malik opened fire on a conference room full of co-workers at social services center back on december 2nd. that couple was later killed in a shootout with police. new video release dad avenue shootinshooting of 11-year-old l back on december 14th. surveillance video showing a man police say is the shooter running down the 700 block of luzerne street. philadelphia police say the little girl was walking home from school when she was shot in her right heel. if you know who this person is please call police. just this afternoon more gun violence. a man died after a shooting on the 1200 block of read field in west philadelphia about 2:00 o'clock. philadelphia police say he was shot in the shoulder and later died at the hospital. no arrests have been made. and then about five hours later, another shooting on the same street. the victim taken to the hospital in critical condition. this evening, those who have lost loved ones to violence gathering to remember victims. they were not the only ones taking a look back at crime this year. philadelphia police department released crimes statistics and the results were mixed. fox 29's shawnette wilson joins us live from philadelphia police headquarters tonight. shawnette? >> reporter: well, homicides are up this year from last and just as that report came out today, a community in north philadelphia held a vigil tonight urging people to stop the violence. >> tyreke hilton. --ing. >> each balloon represents a life lost in violence in philadelphia this year. each released during vigil tonight near 15th and susquehanna in north philly. >> we got to keep killing each other? we got to stop killing each other. tiffany's brother 25-year-old saleem was murdered um four years ago. she is honest about the scars she still carries. >> i sat on the couch 16 months and drunk my life away. i was out of work for 16 months. >> 21-year-old mark, organized the vigil after losing several people close to him. he wants the killing to stop. >> the crime we got in philly right now is like 200 and something. up high two hundreds. that's a lot of crime. >> his mom called for healing. >> this is serious. ya'll lives matter. >> reporter: maybe get a little healing. closure. um, from those that they have lost due to gun violence or police brutality. >> reporter: vigil comes on the same day philadelphia police commissioner charles ramsay gave a year end report on crime. as of today, there have been 275 homicides. a 12% increase from last year. shootings are up 18% and 84% of homicide victims died of gunshot wounds. >> that's troubling because that does represent an increase in the number of gunshot victims that we've had this year and obviously that's not good. a lot of illegal guns out there and we have a lot of people that aren't afraid to use guns. >> reporter: and back here live, again, even though homicides are up this year from last, commissioner ramsay says it's important to look at this in context. he said the number of homicides have gone down dramatically over the past eight years. he also says this is the first time since 1969 that we've had three years in a row with less than 300 murders. shawnette wilson, fox 29 news. ♪ around, it's when his knife caught me and he hit the ground his knife went -- >> the navy vet and married father of three shows off his injured arm. battle wound he says was born of fear -- >> i was power trip ended when he pulled over a real police officer. >> activated emergency lights. i believed it was a state police vehicle at that time. i began to move over to the center lane and then to the right lane on to the shoulder. believing i was being stopped by the state police. >> sergeant charles stab says it went down on the garden state parkway last monday. the suspect pulled behind him and activated his lights and once he pulled over 68-year-old richard gold rick well he immediately sped away. authorities later found gold rick who they say that a handgun, ammunition and fraud len for now. immigration authorities got a judge's injunction to block his deportation so he'll remain in custody. ethan is on probation in the us for 2013dui crash that killed four people. back then, his lawyer successfully argued he should only get probation because his parents affluent lifestyle left him incapable of taking responsible. they were tracked down in mexico this week. >> a mother in central florida mistook her daughter for an intruder and shot her oh death. >> according to police there who say it appears to be tragic mistake that mother was asleep last night when she heard someone enter her home. she told police she heard footsteps approaching so she opened fire. the mom soon discover the person was her 27-year-old daughter who died at the hospital. neighbors are shocked but are also sympathetic. >> i don't know any of the circumstances. it's just for me this is shooting your own kid, you know, that's what was really horrifying for me about it. >> police are not releasing the names of the mother or the daughter since person in their house works in law enforcement. officers are investigating but say the mom's story appears to match the evidence. still cosby charged with drugging and sexually assaulting a woman 10 years ago. the 78-year-old looking very frail stumbling as he walk into the district court in elkins park, montgomery county this afternoon. the comedian arraigned on aggravated indecent assault cosby is accused of drugging a former temple university employee and sexually assaulting her in his montgomery county home. this was back in 2004. cosby telling investigators it was consensual. the comedian posted 10% of his $1 million bail. montgomery counties district attorney kevin steal is you were any other potential victims to come forward. today's news hitting hard on temple's campus. he's one of the school's most famed graduate. >> many still coming to grips with the charges facing the man once hailed for having done so much for the university. fox 29's jeff cole explains. >> reporter: for years, temple university's airtight relationship with its proud 1971 graduate bill cosby was great for both as kobe's troubles mounted the university like others retreated. now, the relationship with the school is severed and his supporters are teetering. >> i'm disappointed, you know, by him and the news because, you know, media can really take this thing and blow it out of the proportion, but so many folks -- people coming forward, you know, have to wait and fine out what's real and what's not real. >> reporter: at the calgary international airport in canada this afternoon. the plane had to make an emergency landing. air canada flight on its way to toronto with shanghai with more than 350 possible on board. 21 of them had to be taken to the hospital. all with non-life threatening injuries. air canada says a full investigation is now underway. final preparations underway for one of physical's oldest traditions bay maybe a few showers there in southern new jersey. off the coast, by 3:00 o'clock in the morning, now there's a time between that cold wind setting up and rain clearing out. where we'll have fog developing right about 3:00 o'clock in the morning. maybe around tomorrow morning you step outside you can see dense fog it will clear out quickly. look at the temperatures. there they are. they're getting colder so we'll bump a degree or two tomorrow morning and then we'll really drop tomorrow night. coldest part of the day will be tomorrow right before midnight. we may stay at our high temperature of the day right after midnight. be a able to jump a degree or two. these are the temperatures by tomorrow morning. about 49. then we get a little bit of sunshine. there it is. up to about 50. this is at 1:00 o'clock. then we'll really drop look at these numbers dropping as that cold air moves in. by 8:00 o'clock, 43. and then ringing in the new year with temperature of 38 degrees. that will be the coldest part of the day tomorrow. now this pattern will stick around for awhile. a block sets up in the western united states new year's day and that means this pattern doesn't really change much and it means we're in for colder air and a bit of a breeze here. shots of cold air coming in. a day after day. what to expect, well, the temperatures will be dropping. cooler breeze on friday. new year's day gusty in the after about 20 miles an hour. more sunshine a few flurries on monday and defendant day that's tuesday. wait until you see the low temperature. it's dropping down crowders of pedestrians on las vegas sidewalk had pot in her system that's according to prosecutors tonight. they released blood test results showing that lakeesha hold away had more than the nevada legal limit of pot in her blood when arrested back on december 20. her lawyer says that does not prove she was impaired in any way. police say she killed one woman and hit 35 other people when she drove her car into the crowd. hold away is due back in court next month. one man's stroke of bad luck ends with new friendship all thanks to good samaritan. surveillance video shows 76-year-old jim lear shopping at a florida grocery store when he dropped his wallet. that guy walking he's not the good samaritan he picks the wallet up and takes off before the army vet even knows it's missing. another man found the wallet in the garbage can with all the cash still inside. he called police who reunited lear with his wallet. the victim has a message for the thief. >> a stupid, he through the wallet in the garbage that had $700 in it and now we got your picture on the front page. >> lear gave 100 buck of that to the guy who returned his wallet. the thief left the cash but did he charge a michael remains calm even after distressing episodes of choking and gasping for air. >> instead of him swallowing on his own or coughing it up he has to have it vacuum sucked out of him. >> reporter: it's constant and michael never complains. this is all he knows. he was born with a congenital heart defect called hypo plastic left heart syndrome hlhs. the left side of his heart severely under developed leading to other serious medical complications. >> this is mistake. we actually did trach change this morning. >> reporter: he also has a condition called hetero taxi. his organs are not pigged where they're supposed to be inside. >> so where your right lung is supposed to be, his left lung is. his heart is also flipped upside down. >> reporter: two open heart surgeries at five days old and another major procedure at six months -- >> i don't even -- i can't really explain it. it just seemed like i was living in another -- like other world. >> reporter: his parents say they were told their little michael may not ever make it home. >> therefore all i can do was my hand underneath him and that was the way i held him for about two months. >> reporter: a full year in the hospital, multiple surgery and many more to come. >> he's denied the odds so far and, um, i think he's going to keep fighting. >> i didn't know how serious it was. i didn't know -- i was hearing technical terms i didn't know day to day what that was going to mean. >> you want to take him and i can grab these. >> it takes a whole team an different machine just to move michael from bedroom to family room. at grandmom's house. the family underwent extensive training to be able to care for michael at home these past six months. >> how to change out mistake, how to change out his feeding tube. and what signs to look for if he's in distress like he's kind of choking now. so i need to suction him. he's kicking because he's trying to catch his breath. >> reporter: i am terrified but they, they don't break a sweat over this. >> the more he fights, the stronger it makes me. >> reporter: what they are stressing over is a power outa outage. a brief scare exposed their biggest challenge. >> very scare row because we knew without electricity how everything can just fall apart for him and he's come so so far. >> reporter: as the family prepares for michael's second round of surgery with better odds, they've had to set gofundme account to help raise the money it's going to take to buy a back up generator for their century old home if the lights go out here, it means that we can call an ambulance, yes, but that's still time ticking. >> reporter: she worries about a risk of brain damage from lack of oxygen to a feisty little boy who just may be able to go to school and he was going in another direction, chip put up no resistance and then the espn report that chip was fired when supposedly lurie took away the gm duties. another incorrect report. people just make this stuff up. all right. so now just one game short of three seasons kelly is moving on. jeffrey lurie toll us today what he wants in a new head coach and without explaining what he thought was missing. >> i go back to peak performan performance. if you want to have peak performance you got to have tremendous collaboration, trust, respect, um, smartness, agility, you got to have a lot going for you to achieve peak performance in leadership. and so, you know, that was the -- that was the decision was made to -- to move on with a new leader as a head coach. >> all right. the situation like this the players have to give up some of their feelings practice went on today as scheduled. with the game on sunday, yes, there's a game with the interim head coach pat shurmer in charge. what's different about this practice? >> i would just say the surprise factor, um, you know, i thought we had really good practice yesterday. he broke us down after practice and, you know, everything was normal and for it to happen last night just kind of surprised everyone isn't i knew something going to happen but i didn't think it was going to be this drama especially during this time of the season. last week of the season. but i understand why. >> all right. did have a chance to spend 20 minutes actually with chip kelly today. now there's some things i can share outside of the typical press release by chip kelly tonight which said nothing other than the players mean the world to him. now, the only things i can share in my conversations and host people understand it's a personal conversation, chip half kidding said, he will have a job within a week. maybe wip radio would hire him he told me and did he tell me he feels good and feels very rela relaxed with this decision. he's not here because of
