beautiful. >> glorious start. temperatures are falling back into the low 50s in many spots and sunshine expected for most of the day. low 80s for afternoon highs. let's get a look at the numbers. impressive stuff. some of the coolest temperatures in two months time here in downtown washington. 64 at reagan national. frederick 50 degrees. 55 in hagerstown. 56 in ocean city. great looking start. it should be a beautiful day today. a few clouds moving through from time to time but things should remain dry as high pressure continues to work on in here from the west. not much to show you. lots of clear skies and we are expecting plenty of sunshine today. the forecast for tuesday, mostly sunny skies. high temperature about 83 degrees. changes by the end of the week. we will get a closer look at hurricane irene in a couple of minutes. on-time traffic with julie wright. >> so far so good. no incidents on 395. the pace is rolling up speed from duke street to seminary road. no incidents reported, just volume. heavy and steady is the flow. no incidents on the 95 corridor. you will find spotty delays at annandale. no incidents on this stretch out to the lane divide. don't forget kids in prince george county went back to school yesterday and today anne arundel. keep a check out for the yellow buses. that's a check of your on-time traffic. breaking news in maryland this morning after capital police arrest a man for planning a fireworks attack. >> they found him and are work wearing the joint terrorism task force. we get the latest from audrey barns live at the park. >> park police are on patrol and spotted a red jeep cherokee parked in a remote section of the park. inside they saw this man, green nap, 27 years old. he lives in stewart florida. he said he had issues with the banking industry and was going to use all the stuff inside his vehicle to draw attention to his plight. what was discovered inside the vehicle? >> a large amount of fireworks. the exact amount we can't release at this time. it's part of the investigation as we put it together. we will release that at the time. there was a homemade turret type device on top of the vehicle in which he could launch the fireworks from and change the direction of those, move them side to side if he needed to. >> reporter: the montgomery county bomb squad was successfully able to dismantle the fireworks and they got lots of tubing and wiring and other things from out of the vehicle. all of this has been collected to use as evidence. charges are pending. allison and steve, back to you. >> audrey, thank you very much. we will check in later with you for more details. in virginia this morning, the polls are open for a rare august primary. of the 16 legislative primaries six will take place for the state senate and three for the house of delegates and sheriffs races and board races. the polls will be open until 7:00 tonight. voter turnout is expected to be low. today is the deadline to file to replace leslie johnson. johnson resigned after pleading guilt to witness and evidence tampering for her role in a sweeping corruption scheme. the primary will be held september 20th. the general election october 18th. ahead of sunday's official dedication, today is d.c. day as the new martin luther king junior memorial. >> fox 5 sherri ly spoke to one man that visited the site yesterday. sandy jenkins was there in 1963 when dr. king delivered his i have a dream speech. >> i am overwhelmed. first of all, i didn't think i would be living to see this day. >> reporter: sandy jenkins sees his past in the martin luther king junior memorial. >> when i was coming up in the south, we stood on one side of the fence. we drink out of colored water fountains and they had white. >> reporter: he remembers marching on washington in 1963. he was 22 years old in this german video of king's immortal speech. the words still resonate. >> is it like you are back there? >> when i look up there and see him standing there, i can hear his voice right now. the one thing that keeps ringing out of me is i have a dream. >> reporter: he is awed by the monuments's likeness. do you feel his presence here? >> i do. not in that statue but his presence what he did and what he left. >> reporter: a von johnson was too young to march with king. >> he came through my hometown and my parents marched with him. >> reporter: coming here with her children rekindles her childhood and her parents story. >> they knew about the dogs, the guns, the fire trucks. they were determined. >> reporter: so much has changed since then. around the monument and whites stand side by side helping one another. it's king's real legacy. >> is this personal for you? >> it's personal for me. i say it's personal because of what i went through in the south. >> reporter: in a way, king's memorial is as much about the past as it is about our future. >> sherri ly reporting there. jenkins plans to come back this weekend when president obama dead indicates the memorial. he never thought he would live to see the first black president or a king memorial. we should mention today is d.c. day at the memorial. tickets are required. if you don't live in d.c., you won't be turned away. we will tell you how to get the stories to us. holly morris is down on the national mall at the king memorial. hole holly, good morning. >> reporter: what a gorgeous morning it is. it's not everyday or every week that a national memorial opens and, of course, this is for the country. they want people to make pilgrim majors here to come and spend time to reflect. the memorial is in the district of columbia and they are celebrating that fact today as they are dedicating this to d.c., d.c. residents encouraged to be out here. they will have many of the different leaders from the d.c. area out here this morning. the mayor will be coming. he will be live on our show after the 8:00 hour. it will be wonderful to hear what he has to say as he stands in front of the memorial. it officially opens at 8:00 a.m. they are holding true to that time. so, you can come down now, get in line. there is not a line right now. it will be open until 10:00 tonight. the official opening was yesterday. it has been kind of a soft opening to the memorial. it's all leading up to the huge dedication on sunday. each and everyday they are doing something a little different to get people acclimated to this new spot on the mall. it has been well received as you heard from people that were here yesterday. many of them walk in, they go through the mountain of despair and into the freedom of the plaza itself. they see the 30-foot tall granite statue and many of them were simply overwhelmed and overcome with emotion. many said it exceeded their expectation. the designer of the memorial was here yesterday. he is from china. he said, via a translator while this wasn't the most difficult work he has done, he believes this is the most important work that he has ever done. so, this morning, as we get closer and closer to the time when the public can come in, we are hoping to talk to people. i spoke with one person who said there are some young leaders from lou high school that will be out here experiencing it for the first time. and the mayor will be here and we will have the building team, we will talk with them about watching the design come to fruition and how they feel on this glorious morning. >> thank you, holly. our other big story, the battle of tripoli and a son of the leader shocked foreign journalists when he showed up at the hotel. he said he was air-rebels said he was arrested yesterday. >> we are going to win because the people are with us. that's why we are going to win. look at them. look at them. everywhere. >> gadhafi forces are fighting rebels. they fired three scud missiles at rebel fighters. checking the other top stories, the mother of a toddler shot in the face recently is pleading for whoever shot that child to do the right thing and turn himself in. police want to talk to devin motte toss. they -- motos the child is in stable condition. his mother says he will need a series of surgeries however. new details in the search for a maryland woman missing in aruba. a witness is conflicting gary giordano's story. he was robyn gardner's travel companion. giordano said the two went snorkeling and the current pulled gardner tout see. the witness said he saw the couple on the beach and they never went in the water. officials searched a coastal area for hours but found no new leads. a trial is set to begin in the case against albert haynesworth that won't happen after a plea deal was released. the new martin luther king junior memorial is open to visitors.  welcome back to fox 5 morning news on a tuesday. the calm before the storm. feeling nervous. >> allison, still days away with irene. we will keep a close oneye on it and the eventual path is not known. we will watch it. by saturday night and sunday -- >> that path could change. >> we talk about the cone of uncertainty. that varies several hundred miles. it could stay to the east which would be good news. the latest with irene and now maximum winds up to 100 miles per hour. gusts up to 120. if you look carefully north of haiti, you will see the center of circulation and good convection and thunderstorm activity. that tells weather forecasters this storm is likely to intensify. warm waters off to the north and west, water temperatures in the mid-80s up toward the bahamas. it will likely grow into a major hurricane as it treks to the north and west. i will switch maps here. what i will show you on the spaghetti models, these are the models trying to figure out where the storm will go. watch what the computer models are doing with the storm the next couple of days. as i put it in motion for you, there you go. a wide variation in the eventually path but there is general consensus that it will go to the west then north and likely make landfall near the carolinas by late in the day saturday, saturday night and currently the thinking is it may come up into the might atlantic and if it does that, a lot of rain and potential for gusty winds by sunday. we have to watch it in washington as we get into the weekend. five-day forecast, locally great weather. 83 with sunshine. tomorrow 86. we will warm it up thursday and friday. i put a question mark with irene because it's possible that it will stay tout sea. >> as long as we stay out of that cone of uncertainty, i feel better. >> the cone of uncertainty is my life. that is everyday for me. this is what i know. we are getting a report of an accident eastbound on the prince william parkway over to ac to kwon road the prince william parkway not so bad. this is 95 from the prince william up to the ac take quan. a fender bender at duke street. traffic is slow working up to seminary road. you will find on the beltway outer loop below speed heading to georgia avenue. inner loop is in better shape into the sunshine. delays at river road and again at connecticut avenue. that's a check of the fox 5 on- time traffic. >> thank you so very much. albert haynesworth section assault case will not go to trial today. all charges could be dropped in 18 months. how did the deal get down? haynesworth attorney joins us to talk about new details in the case. scott, thanks for being with us. talk about what happened behind the scenes. >> without disclosing too much, this was a deal that had to get done. it was an important deal for albert haynesworth. how does he get back to the core mission of playing football rather than sitting three or four days in a d.c. courtroom. he has a new team. the deal allows him not to admit wrongdoing. and then, secondly if he fill fills the conditions of community service and other stuff, then the case could be dismessed within 18 months. so, that is important. for him, while he still believed in his case and i'm sure the government believed in his case, this was a way for him to plead knoll low con ten dry, do community service and quite possibly have the case dismissed without anything on his record. the plea was to a misdemeanor assault, the sexual abuse was dismissed. from our standpoint, it's a deal that gives him back to the new england patriots and back to playing football, his core mission. >> through the deal, the sexual assault was wiped out completely. was it his goal to get on with the football part of it? is that what spurred him to do this? >> absolutely. if you talk to the new england patriots or the nfl, there is relief there that one of their representatives is not in court defending himself over four days. it's a very expensive process. justice -- i think he had a good legal defense team and i think this was a good deal for him or important deal for him while the government gets what they want vis-a-vis the -- they still got the misdemeanor that they wanted but knoll low con ten dry plea and community service. >> as for the community service, will that happen here or what might that entail. >> it will happen in boston. he is free to do it with any organization. we are looking at what organizations he will be working with. he has 18 months to do it. albert haynesworth does a lot of this already, quite frankly, like so many other great professional football players. it would be consistent with him to do a lot of community service anyway. >> does he have any tie left to d.c. or does this sever his ties judicially from d.c. >> he has some checkpoints, if you will, every six months vis- a-vis and appearance in court if necessary. but if he is doing what he's supposed to do, doing his community service, getting the assessments done and he doesn't get rearrested for probable cause he ought to be in good shape and this ought to be the final chapter in his life that allows him to move on to boston and as he said yesterday, go patriots. >> that won't go over well with the redskins fans. there are talks of this supposed witness that was offered money to testify in the case. how did that come about? what did you make out of that? >> most folks know that i continue as a defense attorney do an independent investigation and share information with the government. it is ex-culp a tower. that is likely to show my client not guilty. we have affidavits from two witnesss that that offer was made to the complaining witness. these were affidavits, not allegations and stuff. you had accusations going back and forth. as part of the investigation we came up with that. we gave it to the government. they investigated. they reached whatever conclusion they were going to reach but clearly that was going to be an issue at this trial. in the end, this was a deal that had to get done. this was a deal that albert haynesworth allowed him to move on and that's most important for him and his defense team. >> and he is moving on in boston with the new england patriots. thank you for joining us this morning. >> appreciate it. allison, back to you. 64 degrees on this tuesday morning. a fire breaks out at sir richard branson's vacation home while one well known actress is visiting. what started the whole thing. also, mother nature rocky colorado, an earthquake hitting the city late last night.  branson, his wife and son are staying in a nearby property at the time. kate winslet and family had to leave the residence. no one was injured. colorado struck by the largest earthquake it has seen in 40 years. the managing any thud 5.3 quake hit before midnight local times. the epicenter shy of 200 miles south of denver in a town called coke dale, colorado. the battle for tripoli continues in libya. the son of moammar gadhafi seen on the streets, not captured by rebel forces as claimed but meeting with journalists. we will sit down with the congressional policy writer for quarterly.  today is d.c. day at the new martin luther king junior memorial. washington residents are encouraged to take this day and come out and visit. this is part of the week long celebration leading up to the official dedication sunday. yesterday emotions were running high as the public got the first glimpse of the memorial on the national mall. the master sculptor is from china. he is aware of the controversy of a chinese artist to create an african-american monument. >> it shows the spirit. judge people from his character. >> even though d.c. has been dubbed -- today has been dubbed dc day, tickets aren't required. of question marks about the weekend. we will get into that coming up. yesterday's high temperatures, i want to mention 64 at reagan national. the coolest temperature in about two months time. not your imagination if it feels a little chilly. trending in the right direction the last 24 hours. 83 at dulles. marshal 82. it will probably be a degree or two cooler today. highs in the low to mid-80s. a lot of sunshine and low humidity. it will feel absolutely fantastic if you are out and about. temperatures up to 65. 50s hanging tough in the 7:00 hour off to the north and west. gaithersburg, 54 degrees. martinsburg, chilly. 54 at dulles. let's see, fredricksburg 57. association it should be another fine looking day. lots of sunshine expected as we have high pressure moving through. this will deliver a nice one today. cool conditions tonight. open the windows tonight and save on the air-conditioning then another tomorrow before we get heat and humidity back for thursday. out in pennsylvania, ohio, michigan, it's quiet. high pressure will be moving through. again the winds will be out of the north here. we have the northerly trajectory winds that will keep the atmosphere on the dry side. no problems with humidity the next couple of days. lots of sunshine, comfortable temperatures, winds out of the north at about 5 miles per hour. later tonight, i mentioned cool conditions. 64 in the city. lots of 500s overnight with a few clouds out there. here is the five-day forecast, 86 tomorrow. another nice one tomorrow. more steam, more heat, more humidity on thursday. afternoon storms thursday and friday. big question mark with irene on saturday. that could impact as late as saturday and sunday. i will show you an update in a couple of minutes. we are waiting for an update from the hurricane center. that's a look at traffic. julie wright has the traffic. >> reporter: sunshine delays around the belts way into the sun, the inner loop leaving connecticut avenue to georgia avenue, the sunshine at this point. we call it sunshine delays because it's coming right under the advisor. we can tell that because the shadow is directly behind the vehicle. the sun is right under the advisor and smacking you in the kisser. that explains the delays on the inner loop of the beltway into silver spring and slow traffic between university and new hampshire avenue. on the beltway, 95 heading to georgia. eastbound 66 same thing with the sunshine delay from fair oaks to 123. beltway inner loop spotty delays up to 66. meanwhile, inbound new york avenue no problems leaving north capitol street to the third tunnel. that's a check of your
