>> cleanup on aisle 7 a gourmet grossner d.c. shut down by the health department. what inspectors found that forced them to close shop. >> and, shake, rattle and roll. a maryland homeowner is singing blues over a jarring problem with his newly built home. what he says the builder did not tell him. right now on "fox5"news at 10. we begin tonight with a "fox5" exclusive. a firefighter hurt on the job is accusing montgomery country workman comp program of widespread corruption. thanks for joining us tonight i'm shawn yancy. >> i'm tony perkins. >> the firefighter says delayed diagnosis and treatment forced him to go on disability and he says, the delays are costing the taxpayers money. and "fox5" tisha lewis joins with with the story. >> tony, shawn, it is damage to say the least. they are records instead of patients and miss diagnosing first responders and more. >> there's heavy assertions about the lack of transparenty with montgomery country when it comes to their workman's comp company. >> what is the incentive for them to do this. >> money, it's all about the money. whatever this company does not pay out, in their you know to payments to the first responders or to workman's comp payments or doctors and stuff, they're incentiviseed on saving money. >> 52-year-old allen mark spent years and then a neck injury on the job forced him to disability. the latter could have been pev entered. >> fist responders and paramedics and firefighters that are retired on disability the reason most of them are retired on disability is because of the delay in treatment and diagnosis for their injuries that have happened on the job treatment had no happened, most of those people, a vast majority, would all be back on the job. >> mark us is describing what he calls widespread scuption with the contractor core vel. the biggest issue is delayed or denied payment and treatment which he says according to his doctors, caused his injury to worse. >> throughout delays of the workman's comp company and, and, doctors they sent me to, everybody kept saying there's nothing wrong with you, nothing wrong with you. it took months and months to get the proper diagnosis as far as mri was concerned to though the damage. and it took a total of 18 months from the time of my injury to the time that i had surgery. and because of that, i suffered permanent spinal cord injury. >> ultimately, marcus would like county and workman's comp administrator to be held accountable for delayed treatment and diagnosis so first responders can get back to worse inste retire. >> county says marcus filed a number of complaints to the workman's compp board but none about delays in treatment from the neck injury and they're interested in any evidence allen marcus has that he might have about corruption and independent audits of the vendor resulted in 95% rating in the last two years. "fox5" has learned allen marcus is receiveing a $3,000 check from montgomery county to reimburse medical cost. marcus says it was mailed after we contacted montgomery country. the county says it was not. tisha lewis, "fox5 local news". and staying in montgomery county, police are trying to figure out who shot and killed a man in montgomery village this afternoon. it happened just after 2:00 in the 8500 block of hawk run terrace. when officers arrived they found victim suffering from a gun shot wound in a parking lot. he died at the scene. and the swat team was also called to the scene at least five people were ta >> investigators also located some potential witnesses within a home adjacent to the parking lot where the victim was located. they have been taken into investigative detention so we can interview them and determine what part anyone of those individuals may have played or may be just a witness. >> so far, there's no word on a suspect or a motive. james sparse moved into the germantown townhouse nearly a year ago and he never imagined to would shake literally and endure sleepiness nights. it's happening his home is close to train tracks and says the noise is unbearable. lauren demarco is live with the "fox5" exclusive. lauren. >> reporter: shawn, sparks lives here along vaughn landing drive and has collected 35 signatures petition from neighbors who say that they are fed up with the racket from these trains. now, this is the side of spark's home it's just about 50 yards from the tracks over there. so he says clearly he did expect some noise. but that he was misled as to the extent of. it our cameras were rolling as several trains came passing by. >> i've been outside barbecuing in the summer and when the train blows it's horn it's like a mega phone next to your ear. you cannot think and you just want to collapse because it's so loud. >> reporter: spark says the noise pollution is so extreme when inside it drowns out all conversations and wakes him up at night. he says he's been complaining about this since lasts "action news" when he moved in. when he bought the townhouse representatives from thebilityer ryan homes says it's mark brunswick commuter line and the trains don't come through night and weekends and after sparks moved in he realized other lines use the tracks around the clock. and our cameras caught a csx train rolling through and he shared an email where the montgomery county planning board told him it appears the wooden faens here was the only requirement in the site plans. but sparks is now looking into other sound studies supposedly conducted after the construction was complete. >> my opinion take the fence and take it out and put a 8 foot wall in that's a sound barary. this wall was already in place before this sound 12udy was done. i'm not sure how this wall is sufficient enough to block any sound. >> i spoke with the head of the hoa tonight and he says that there were plans in the site plans for two, eight-foot high walls or sound barriers. i also looked at some emails that sparks shared with us between him and ryan holmes, ryan holmes is talking about some wall that is supposed to be built by the developer. charlie turner. and that it is l-shaped wall supposed to be built along the edge of his town home. they say they don't have an update as to when that will happen. now, we reached out to ryan holmes and they told us they have no comment to the media. live in germantown. "fox5 local news". and another popular grocery store is closed tonight over health concerns. we're talking about dean and deluca in georgetown the gourmet grocery store located m street north west. d.c. department of health forced dean and deluca to close doors after they discovered a rodent infestation. they've been closed for similar issues two other times over the last few years. no word when they plan to reon. meanwhile, a whole foods market in the glover park neighborhood we told you about yesterday after being shu yesterday for insect and rodent issues that store is reopened. it's located on the 2300 block of wisconsin avenue northwest. whole foods apologized for the incident and issued a statement saying "they asure community that the store is safe and the products meet the convicted and found gultty on all counts. sarah simmons is here with more or the story. >> trevor was nine months old when he died and today the parents witnessed end of a 7-year-old legal battle with the woman convicted in his death. this was a retrial against 59-year-old gale doddson convicted of second degree murder and child abuse resulting in death in 2009 and sentenced to 20 years. the case was tried on the eastern shore. but the defense then raised questions about the prosecution's evidence poyting to shaing baby syndrome. some doctors came out suggesting there could have been underlying illness or accident that would cause that kind of head trauma to the little boy. new trial was set and ultimately a judge, again, found doddson guilty. she was sentenced to 20 years if prison assist in this case and county state attorney said the head trauma sustained by trevor shows without a doubt he suffered from shaing baby syndrome. >> he had severe brain injury and swelling and retinal tears and catastrophic injuries to his brain. the doctors there found that this was a homicide. >> it took the jury hours to reach the same conclusion in the trial. doddson has already spent four years in prison for killing trevor. the judge has ordered her back for 16 more. shawn. >> sarah, thank you. do you recognize these men? prince george country says they're wanted in connection it a deadly stabbing the incident happened tuesday 6400 block in seat pleasant and both men walked by cameras moments before jamaal barnes was stabbed. let's take a close up look at the of crime and traffic cameras. d.c. officials say while ransomware was use was paid to the culprits. >> working with the city we were able to mitigate any potential threats and get those cameras back up online and operational very quickly. the secret service was on the case immediately. the cameras were down for about two days. but restored by the inauguration. and nearly a month later, questions about who did this and why remain unanswered. >> i believe that the people that were responsible for looking to cause disruption of some type. but i really can't get into any other details other than that at this time. >> reporter: brian ebert is special nast charge at the d.c. field office he was not comment on the two arrest made in london confirmed by mayor's office. those suspects have not been identified. and they are reportedly out on bond. far from case closed ebert said this is a global investigation. >> secret service continues to pursue aggressively several leads in the case. it's an investigation world it needs to for us to identify and apprehend criminals responsible. >> people may be unaware of the secret services role in combating cyber crimes. the agency can even help individuals or small businesses that fall victim. >> in addition to protective mission we have investigative mission where we work to combat counterfeit currency and credit card fraud and check fraud to speak to the mayor's office about this to find out what is done to prevent another hack into the system. no one would speak on camera. however we got a statement from the office of maybe muriel bowser. "cyber threats are the new reality for all governments and what people want to know is that were an incident to occur can we detect and respond. this district was ready to respond quickly as we detected breach and moved within a matter of days to restore our system. >> when the u.s. education secretary visited d.c. school today the welcome was not exactly warm. >> betsy devos was greeted by this was the scene just after 10:00 this morning as protesters tried to stop a visit by the new u.s. secretary to jefferson middle school in southwest washington. the car betsy devos was riding in was turned away moments earlier in the back ever the school building l building. the man arrested here was theif insti greater with a smaller group of protesters who had physically blocked defrom entering the school. after she mit with the school meeting the chancellor and other officials there's this great police presses because when they tried toe sneak her in the backdoor earlier today, it was neighborhood zones. speedlimits would be lowered to 0 miles an hour neighborhoods and 15 mile an hour safe zones would be implement around schools, parks and other areas. in montgomery county there's a bill on the table table that would the lower the speed limit to 20 miles an hour on roads and residential and business districts. here to discuss the speed limit proposals harn reimer montgomery it. >> tonight. >> hans let me start with you, you are saying and in the district they're saying it's all about safety. some people are concerned it's really about raising revenue. how do you respond to that. >> what we're trying to do there's some roads where 25 is too fast it's not safe in a neighborhood. you have a lot of neighborhood street. they don't have dividing line the roads are narrow cars on both sides. on those kinds of roads 25 is really dangerous. i kid can run out from behind a car you don't have time to react. what we're looking for in montgomery country legislation is ability to take those streets where there is a safety concern down 0 miles an hour. these are quiet residential streets. they're not speed camera arterials it has nothing to do with that. >> do you have a sense of how many streets or still surveying. >> we're not really survey have aing we would not apply in blanket way we would make it available to neighbors and xhunt and they could ask for the designation and then t department of transportation would do i astudy to confirm whether it really is appropriate for safety vantage point. >> not something that will be implemented it overnight in council pass it's do you think it's a good idea. >> concern motorists have is blanket drop of of speed limit or lowering of speed limit in such a way you would not have engineering study or traffic safety study or crash data related study to determine whether that road could tolerate the dropping of speed limit. and it may end up being as it is in district of column he bee aare a & c and so you might think it's 25 because in that area that vicinity it says 25 but actual legal limit is 0 if you hit somebody going 29 even though neighborhood is marked 25 you can go into court and say i didn't know it was 25 i thought it was 30. and judge might very well afree with you and it happens a lot. so what we're trying to do is change that unposted speed limit to 5. >> what about people who you know we've had people write in and a lot are talking about in the district and there's differences between montgomery county and how this would be implemented. what about people who say okay what we need to do rather than dropping speed limit isnf the current speedlimits people we all know tend to drive 5, 6, 7, miles above speed limit posted why not just enforce okay 25 that's it. you're going 26 miles an hour. >> i don't think enforcement is really that realistic when you really get down to the actual neighborhood level the individual streets are thousands of miles of these neighborhood streets. this is really about education and it's about culture. >> but it's three prong processed occasions is saying and also engineering and has to be predicated on you're saying tony on enforcement. and the problem in the district is when kathy linear was chief she he rad indicated that's a tough verbiage or verb or she got rid of the traffic division. and total reliance on automated enforcement. montgomery county has that problem. we have to have a police presence that makes a big difference if a get a speed limiting ticket from a red light camera but once a burley police officer pulls me over i will never forget it. >> we got a lot of comments when with you started talking. nicole miller writes what a cash grab if this were about safety they would keep can't and stack point leading to suspension and this sharon broadly district and surrounding cameras can propose smrelts and but can't pave a street that's badly needed. you clearly explained for montgomery country that we're not going to start seeing speed cameras on the streets themselves. i mean this is nothing new. this is being done, new york done this. oregon done this. boston done this. >> new york. >> and all the studies have shown that the number of traffic-related crashes and injuries have gone down as a result of this right? >> the issue is so important if you get hit by a car doing 40 you're likely to die. if you 20 you're likely to survive. >> survivebility rate is 90% if car going 20 the other issue in new york city this is what people feel in the district of columbia they put a lot of speed cameras when they lowered to 5 and in one year revenue increased to $1.9 billion in speed camera tickets and other traffic-related tickets? are they planning to use speed cameras. >> yes, of course. >> not in montgomery county. >> not to the extent that montgomery county plans to. >> i'm not part of the -- >> the district took in 200 million in ticket revenue last year and on track to take in more this year. if this plan sim supplemented you can expect number of tickets to skyrocket. here's why. though it is safer you have to weigh all the elements when you set the speed limit including impact it's goinging to have on congestion and the way there's a dirty little secret in district of columbia. 90% of all speeds in the district 70 to 90% below the speed limit because of so much traffic people can't speed especially in morning rush hour and evening rush hour there's third rish hour in the district, lunchtime. >> of course this debate is far from over. people get fired up
