take you to look at hillary clinton. just a short time ago in fact. we learned that the associated press is reporting that hillary clinton reached the number of delegates needed to become the democrat's presumptive nominee for president. clinton is expected to accept the nomination during the democrat national convention next month in philadelphia. it is important to note the delegates could still change their commitment before the convention. also, right now, bernie sanders is saying he'll continue to fight for the nomination right up to the convention. tomorrow marks eight years to the day since clintons dropped out of the 2008 race and threw her support behind president barrack obama. we want to take you to our top story locally tonight. a widow claim that is a jailhouse video is raising more questions about how her husband died while he was in the custody at prince george's county jail. >> marina marraco is here with the story new at 10:00. >> reporter: a local family says still they have in justice. take a listen. >> murder. murder, murder. murder. murde murder. >> this is video shot by a corrections officer inside the prince george's county jail. what you just heard were the whales of 49-year-old samuel shields screaming murder. this was shot back in june of 2014. his widow released the video to fox 5 tonight after she obtained it from the county. she alleges her husband was beaten to death by correction offi schizophrenic episode. earlier. shields was arrested for getting on a metrobus without paying the fare. in the video, officers repeatedly speak in the camera contending the detainee was combative 10 refused to put on his jump suit. what you don't see is what happened inside the room where shields was. you do hear screams, cries, demands from the officers to shields and eventually he's pulled out from the room unspoof nearly 30 minutes, officers and emts performed cpr but ultimately he died. >> they just beat him. first they started hitting him to make him move to go into the room. he went into the room. started choking him. stepping on his chest. even told him they knew he had health problems and they sprayed him again. of officer acknowledged that he had health problems. you hair loud strikes. hear him hollering murder and jesus and it was unfair i felt they didn't have no remorse in their heart for nobody. if this type of thing goes on in jail all the time. he only went there one day. i imagine the people that's in there for years and life, you know? and he, he was a good person. it wasn't like he done -- metrobus fare and him would have never done that. i know the type of person he is. he would have never done that. i knew something had to be wrong. >> on the one-year anniversary of his deathings his wife filed a lawsuit against the county for his death despite the medical examiner's office maintaining that shields died from natural causes. we reached out to the jail but have yet to hear back. a marina marraco fox 5 local news. fox 5 in montgomery county tonight more than a dozen people reve caused a out and about crash into a tree on east/west highway in silver spring. driver was penned inside until rescuers could get him out. suffered serious injuries but expected to be ok. we also spoke to the man who was driving the pickup truck. >> couldn't get the truck to go to the left because that was to broken and pushed it this way. i guess the pressure whatever, he got, you know, scared or something. he went up and on the curb and he just freaked. >> they plan to ticket the truck driver, the metro bus driver is not at fault. tonight one person dead another seriously heard after an atf accident in frederick county. they crashed head-on into car. the sheriff's office said illegal atf riding is a big problem in that area. we've been talking about it around the dc region. >> one of the a t v riders went through the windshield, the second went over the car and landed in the road. with illegal atv riding to be an issue, law enforcement hopes maybe this will make people think twice. >> the wreckage shows how powerful this crash was. investigators say the atv was in the wrong lane when it rounded a corner slamming into a car. >> it was a direct head-on collision. >> a mom and 12-year-old son were inside the vehicle and suffered minor injuries. there were beer cans all over the roadway but officials wouldn't comment on that. while it doesn't usually come to this. >> we receive a lot of complaints about reading atvs on the roadway illegally. riding on other people's properties illegally trespassing. things of that nature, causing damage. it's quite common to get that phone call or that complaint about atvs. >> corpo he got a separate call about an atv that nearly crashed head-on. >> i was on that call talking to the person about what happened when this call came out. >> of course, it's not just frederick county. who can forget this of an atv rider taunted a police officer. or this pack of riders months ago on the streets of dc. no chase policies often lead police with their hands tide. >> it's very challenging for us. we don't want to try to stop someone to educate them or get them off the roadway and they take off from you and run from you, you know, and then, worse things could happen. >> reporter: this guy was recently caught and dc police started offering with regards to find atv drivers. >> i've seen is disturbing. >> some say more needs to be done to curb illegal riding. currently violators face fines of a few hundred dollars and short jail sentences. >> i think they need to the penalties on these people and really send a message. >> reporter: in this case, one rider paid the ultimate price with the other left fighting for his life. >> this is a prime example atv versus a car. it's a horrific crash and true tragedy. >> we don't know the name of the victims or how old they are but investigators tell me she should have that soon. there are efforts underway to stop illegal riding. just tonight, a dc council member told us she's introducing a bill that would outlaw gas stations from selling atv fuels. lindsey w atts fox 5 local news. skyfox over the scene of a small plane crash in virginia. went on in started county. crashed into an embankment near i95. the pilot survived the crash. she was taken to the hospital with serious injuries. day three of metro safetrack program kicked off today. first surge of track work is happening in arlington. today many crowded trains on the orange and silver lines. of some complained that metro needs get more staffs on to the platforms to help riders get on the right trains. >> i mean, i know it's the start of their new improvements but to me, just seems like they're just talking with each other up there. they're not actually doing their jobs. very frustrating. >> you're not sure if you're supposed to be which side of the platform you're supposed to be on. you're not sure like when the next train is coming. if it says no passengers, you do you get on or do you not get on? so it's pretty confusing. >> metro gm says they plan to jevity the efforts as safetrack moves forward. the track work will last until thursday june 16th. metro overhaul will have a ripple effect on businesses especially those who indicated to the night crowd. they're expecting a financial impact on business and employees. sarah summons is live with that part of the story. >> reporter: even even though the red line is my shutdown, the early closingur hos are already having impact. we're talking about dupont circle, 14th street, chinatown, the restaurant and bars are feeling the pinch already. here in dupont circle tonight. some of the nights late night business is already they're closing early because of all of this. now, that metro is close at midnight on the weekends instead of 3:00 a.m. they know they have to adjust. it's not just because there's less business but many employees rely on metro to get home. i spoke with some of the restaurants that are juggling schedules and trying to stay profitable. dupont is now closing at 11:00 p.m. instead of 11:30. >> financially half an hour makes a big difference. for us as a business, small bu can see the impact this past weekend, more or less, but i foresee it's going to be a huge impact on all of the small businesses around here especially with dupont circle is metro accessible. parking is a nightmare. i don't see the city is go doing anything with regards to the parking. people are coming to eat. they want -- if you're taking the metro give me something. but the city apparently no success with that whatsoever. >> reporter: as you hired him talking there, he's upset feeling as though the city isn't really helping them as much when it comes to parking. try get people back down here and keep business coming in. they do understand that the work needs to be done on metro. pretty much all agree on that. however, there are a lot of the ride sharing service expanding their pool rides like uber and lyft to where they're putting more cars on the roadway in hopes of trying to get people to move around much easier during this very trying that's latest at dupont. a jury will not hear the case against the officer facing the most serious charges in the case. hey there, sean and tony. a mild and 10:00 will be right back. flu ♪ ♪ developing tonight, the search continues for two fisherman who went missing on the potomac river. they went missing sunday in frederick county. last seen around 10:00 a.m. ye tree. other in the water. crews recovered their boat but no sign of the men. we want to take a live look outside. there's been a quiet night across most of the area but there could be showers. let's check in with sue palko down in the weather center. >> we will have a few showers possible tomorrow but not a lot. not from collin. we don't think unless maybe a couple of them graze parts of central maryland. we're kind of surrounded by rain but everything moving away from dc. there have been showers and stronger storms up through the pittsburgh area. those are moving pretty much due east north of the maryland line. so we're not expecting to see anything with that. we have had a deck of clouds come in tonight associated with what is collin's moisture and they got to be bumped down in hatteras. especially anybody spend, the week at the beach. they just ditched bonnie on memorial day and now more rain down there. this is coming from a system that will be assure very soo tropical storm collin, all of collin's moisture is on the east side. it will be rather an tie climactic. three to six inches of rain possible for much of florida and southeastern georgia. we'll have the latest on collin's track coming up a little bit later. caitlin will have that part of the weather story but it will be dropping good rain. winds about 50 miles an hour but we think it stays out of our area because we do have a frontal boundary that's going to be coming through tomorrow that will kind of keep it on more of a southern track. that's its current position and no shortage of heavy rain and and conditions across florida. getting back to the local story. temperatures still mild and due points are not as bad as they were yesterday. the humidity is noticeable tonight and we're still at 77 degrees. that's about ten degrees cooler than our high for the day, which was 87. dulles 76, fredericks 73, we're going to have a mild night and we'll keep that he is clouds around but the clouds should be gone by the morning. passing showers around on tuesday but i would not think of tuesday as a wet day. tonight, we do still have the clouds, and we'll take you forward to tomorrow morning. we think a lot of those clouds will be moving away. the shield from tropical storm collin. here comes a frontal boundary. and as that approaches, it will sprinkle a few showers across the area, not a lot at 1:00. a for now more maybe a rumble of thunder in the afternoon tomorrow but again, fairly widely scattered and by the time we get to 7:00 or so, we think most of that will be over. that frontal boundary will bring in more changes. i think i have days you're really going to like. back to you. >> i'm loving that thank you, sue. a jury will not decide the fate of a third baltimore police officer to stand trial in the death of freddie gray. officer caesar goodsons faces most serious charges. fox 5 >> reporter: first of all, officer caesar goodson junior will not have a jury trial. that's what we were expecting. he told the judge today he wants the judge to decide his fate. >> if we don't get it. >> reporter: officer goodson's decision to forego a trial. those have been calling for justice for freddie gray. >> we recognize that the officer has a right to have a bench trial but when the citizens of this city have endured so much as a result of this case, it would have just been good to have the citizens of this city in the driver's seat to determine the outcome of this case. >> reporter: the 47-year-old officer caesar goodson faces second degree murder and other charges for his alleged role in the death of freddie gray while in police custody in april of last year. the 25-year-old gray suffered a fatal spinal cord injury inside the police van goodson was driving. in a bombshell decision today's pretty hearing, judge barry williams ruled prosecutors cannot use a crucial piece of their evidence. statement of police detective said one of the other baltimore police officers william porter made to her about what freddie gray said to officers in that van. >> that's been gutted. that was the thrust of the state's case that this was a callous, wanton disregard for health and welfare of freddie gray because you, officer goodson had been told by porter that freddie said he can't breathe of the judge is not allowing any mention of that whatsoever. in part because officer porter denied it on the witness stand in his own case. >> reporter: a trial ended with a hung jury raft december. officer goodson's decision to go with a bench trial may have been influenced by the acquittal last month of officer edward near recharged with four misdemeanors in the gray case. judge williams verdict in that case now has goodson's fate in his hands. >> in the relatively rare instances where police officers on trial, choosing a judge has been a successful strategy throughout the country. >> reporter: the second degree murder trial of officer goodson begins in baltimore thursday morning. fox 5 local news. for more than a week we've been waiting to see if a mother will face charges after her son snuck into a gorilla enclosure at the cincinnatti zoo. >> she is in the disturbing video that shows samuel shields being forced inside a room outside of camera view and in that room his widow says he was pepper sprayed repeatedly and beaten to death despite the man's asthma. she believes her husband was suffering from a schizophrenic episode. the medical examiner's office ruled he died from natural causes. illegal atv riding continues to be a problem this time a ride turned deadly in frederick county two guys slammed in a car head-on. one of the riders died. the other critically hurt. this is in buck ky's town, a mother and her 12-year-old son in that white car suffered minor injuries. sean. >> hillary clinton has the number of delegates needed to become the democrat's presumptive nominee for president. it's based on the count of pledged delegates. bernie sanders says he will continue to fight for the nomination right up to the convention. the world continues to mourn the death of muhammad ali. the boxing legend passed away friday at the age of 74. this was the scene this morning in ali's home town of louisville kentucky. a large procession escorted his body to a funeral home. it's expected to be a star-studied event with bill clinton scheduled to be one of many to you' they say he died from septic shock due to unspecified natural causes. meanwhile fans are leaving flowers, cards and boxing gloves as a tribute to ali on hollywood's neglect in the case but has not been found mentally competent to stand trial. the fund raiser is this thursday starting at 2:00 p.m. in northwest. police in culpeper are looking for three suspects after a woman was shot sunday morning during a house party. investigators say an estimated 100 people were at the party but not a single one called police when 19-year-old samantha sloan was shot. police were incident after the victim was taken to the hospital. they believe the shooting was the result of people not being allowed inside. >> they were denied entry by the person taking the money at the gate. so to speak. of the party. as a result of that, they left and as they were exiting the driveway, they began to fire up on party goers. >> police say they believe at least one person at the party fired back at the suspects. sloan suffered serious injuries and remains hospitalized at a nova fairfax hospital. fox 5 is in spotsylvania county. they arrested him in connection with a domestic violence related shooting on mansfield street. cross shot his girlfriend following an argument at his home. the woman was treated and released from the hospital. cross is being held without bond. fox 5 in fairfax county now. a man is wanted in connection with bank robbery. it happened last wednesday in fairfax. investigators say at man was wearing a hat and flannel shirt. he approached a teller demanded cash. currently there is a $5,000 reward for information leading to arrest and conviction. if you have information call the fbi. coming up tonight, a proud moment for the district. . fall in florida and affecting millions along the east coast. >> so much rain they're getting. and it's been three years since florida has been hit by a tropical storm. over ten years since it was hit by a hurricane. it's pretty unbelievable. we thought it would be an active hurricane season and the first few days have proved it's off to a busy start and the national hurricane center saying that tropical storm collin is the earliest in the season that a third named storm has ever formed in the atlantic bay son. we don't usually get to see this early on in the season. even though collin is officially making land fall. right now as we speak, heavy rain has been pounding florida all day long. mexico. a state of emergency was declared for 34 counties and the state's national guard has been activated. governor is warning residents to stay safe and vigilant as the storm moves through overnight. >> if you don't need to go out, especially as the rain gets heavier later this afternoon, don't go out. prepared. follow your local news. if you have concerns about whether there's going to be floating in the area, have water, your food. >> flooding, rough surf and rip current continue the, as it made land fall along the florida pan handle t georgia and the carolinas are up next. they will feel the i'm going to show yous through tuesday before collin moves offshore tuesday night. here's a look at tropical satellite. you see all the moisture that has been moving out ahead of the storm across florida and into georgia and the carolinas rain. once collin makes land fall. which it pretty much has it will move quickly offshore. we have tropical storm warnings out along the gulf of mexico side of florida as well as the carolinas cape hatteras, the outer banks, this is coming off of tropical storm bonnie last week. it's been a lot of activity in the past ten days, collin made land full but it should weaken and move quickly across florida and quickly out to sea. you could see by tuesday pushing off the carolina coast line and far out to see as we move threw wednesday. heavy rain along the east coast over the next 24 hours. the good news is we send it back to tony shawn and sue, not expecting any impacts which sue will talk about in our area. we had clouds but luckily not going to see much around from this. >> thank you, caitlin. it could be worse. hurricane strength. >> thank goodness it's not. i've got a brother and sister in law and mother-in-law are all down there. everybody is doing ok: if they hunger down they will be fine tefl it's moving. sometimes they're slow across the peninsula. they could use rain in california. they've had a tremendous heat wave on saturday, a brush fire north of los angeles. >> my sister had to deal with that one. >> where are they going next? i need to know. she's got people, tony. of. >> this fire broke out saturday. very fast burning, more than 500 acre, they say it is 80 percent contained. this was start by a pickup truck struck a power pole and this fire took off like crazy. you see this tropical storm with all this water. don't you just wish we had the power to redirect some of this another look at the moisture and it has been able to push tropical moisture up to north carolina. we've had the clouds in place from tropical storm collin. also, from a separate system, a few showers and storms moving across pittsburgh. there were severe storm warnings, i really think both of those will miss us. tomorrow we'll change things up because we are going to see a frontal boundary crossing our area, it could potentially bring us a couple of shower, maybe a rumble of thunder but i'm not thinking it's going to be a big wet day. it is certainly been a sunny and warm start to our work week. that will continue. we will keep an eye on collin. he were just showed you the latest with that. and the updated. you notice it gets stronger once it gets out to the atlantic with winds of 65. it should be far enough way that it shouldn't have a big impact on the coast. watch the surf if you know anybody at the beach those waves will be rough. we're calling for on tuesday. mainly from the frontal boundary that will be crossing us and boy is that front bringing a nice change. it's going to chase the humidity out of town. mid week looking delightful with temperatures in the 70's and we're going to chase the 80's out of town as a you ridge in the jet stream will allow us to get cooler air. it will come into town and the 80's will be replaced with 70's and lower humidity. kind of weather we don't get a lot of. tomorrow warm and humid and as the frontal boundary comes through we'll have showers mainly in the afternoon then breezy and comfortable on wednesday with a temperature of 74. a refreshing day. of very dry and comfortable in the humidity to department. high temperatures up into the 80's. average is 82. we're getting in a that hot time of year and still very mild out there tonight. good faithersberg 77, fredericksberg is 76. we'll stay mild tomorrow morning, 66 to 71 and maybe a few showers to dodge after school with a range of 80 to 84. here and the futurecast so you can get an idea. ly we have the clouds from collin overhead tonight but as we get closer to morning, those should pull away. 1:00 we start to pop a few showers here and there maybe an isolated rumble of thunder. bit more unsettled. looks like we might have thunderstorms saturday with a temperature of 84. sunday showers, 84 and monday, nice and mild again, 79 degrees and looking dry there. that's a look at
