in the chest. during an interview with police, chase indicated to them, she did not mean to fire and was lowering the pistol when it went off. listen why detectives increased charge from second to first-degree murder followed by a neighbor who was home when the shooting thomas. >> the investigators consulted with our secretary's office, and during the course of the dispute, there was evidence that may indicate that the suspect had in mind to engag activity instead of being in the heat of the moment. >> meaning it may have been premeditated >> it may have been but that's still under documents that had been filed in this case in court. and the other person who was in the house was again described as a family member, but didn't say it relationship between the two. that document says it's a family member got in between the 17-year-old and his mother and separated them. but then ms. chase told that family member to leave and go down into the family member did and then heard a loud bang. we did hear from the school, we were told christopher perry was described as a quiet kid but had a lot of relationships with his senior class. and that he helped out with the middle class all the time serving meals. again, at this point, angelique commonplace has been charged with first-degree murder, being held without bond, she'll have a hearing on monday. live at prince george's county police headquarters, paul wagner fox 5 local news. to the district now, where two dc police officers were shot last night in northeast. both officers are recovering at this hour, one had been released from the hospital >> we have new video for you. showing part of the incident that left those two officers injured and the suspect dead. fox 5 lindsay watts is live in northeast. speaking to the witness who took this video. lindsay? >> reporter: matt, something important that we heard both from the witness and the police can chief is that we cannot say suspect who shot both of the officers. police believe that the suspect and one of the officers fired shots, but exactly how the officers got injured, that is something that is still under investigation. this is the intersection where it happened in the trinidad neighborhood of northeast. the witness said he started recording after the suspect fired his gun. and just a warning this video may be difficult to watch. you can her someone yelling shots fired. the suspect is already down on the ground. then three gunshots, one of the officers involved falls. more officers arrive running towards their two injured colleagues and the wounded suspect. >> it was crazy that i sat there and witnessed it >> darren watson recorded the video. he said he saw the suspect walking down the street and police in an unmarked car >> he was fidgeting as walking and looked back at me and the officer, that's who he was really looking at. >> reporter: he said the suspect tried to get away and ended up in a struggle with the officers. he said he heard the suspect fire off a gun five to seven shots. police gave us this re this picture of the semiautomatic weapon. that's when he started recording. he says the three gunshots from the video are from the officer shooting the suspect. >> he was on his stomach. still moving. so they had to do what they had to do. i don't know if he had a gun on him or under him, glad that the police officers are fine, and you know, they had to do what they had td >> he had been interviewed by police about what he saw and chief peter newsham said this isn't at the only video >> officers activated their body warn cameras before the foot pursuit began >> it's up to the mayor to release the footage. tonight the suspect has been identified as timothy lionel williams, 47, he doesn't have any fix to do address. we don't know where he was living. the two officers involved in this have not yet been identified. they work for the fifth building district and they are part of the crime suppression required schools to allow transgender students to use the bathroom of the gender they identity with instead of the gender they were born with. were adopted under the boom loss of federal money for schools that didn't comply. this had been a hot's debated issue in our own area. specifically in fairfax county where the school system added gender identity to their nondiscrimination policy in 2015. the trump administration said the change in federal policy puts the decision back in the hands of the states. today, members of the fairfax county school boards spoke out about the issue >> i have heard from students that expressed concerns. i put out a message yesterday, our board put out a message, saying we weren't going to be backtracking any time soon >> it does not have much of an impact in fairfax county. we have a state attorney general that's ruled that we have the legal authority to have these protections. >> the supreme court may have the final say on this issue, the justices will hear arguments on a case from central virginia next month. a ruling could come in june. dc attorney general speaking out about president trump move to eliminate bathroom protection for transgender to student. he issue as statement. our office is committed to working with the dc office of human rights to insure robust enforcement of our anti-discrimination laws. all students regardless of zip code should be able to learn in safety and dignity. i will continue to add my voice to those fighting for quality and fairness for lgbtq students and all jurisdictions. at 5:00, this us. fox 5 news at 5:00 will continue. suspect in clarksville. police say 38-year-old dorsey was shot along front crossing drive. he's wanted by police apparently tried to hit an officer with his car. the officer fire to do the driver, the suspect is currently in critical but stable condition. a man suspected of burglarizing homes in loudoun county. theodore bailey was arrested accused of six burglaries in loudoun county and detectives say says they were investigating the burglaries in loudoun they were able to link him to a series of break ins. he's currently being held without bond. ahead of a system. that will bring us big changes once we get into the weekend. the winds are a little bit on the breezy side. in fact, we had wind gusts and right now, they're anywhere from about ten to 15 miles an hour. a huge change with the winds tomorrow. they're going to be just down right gusty. prepared for that. if you're planning for tonight, by 7:00, mild at 67. by 9:00, 63. by 11:00, we'll be about 61 degrees. so for your weekend now, here's what you can expect. starting out at 73 degrees on your saturday, the first part of the day is going to be pretty pleasant. second part of the day, different story. we got a frontal system coming in. so expect to see thunderstorms, some of those could be strong, we're under a marginal risk. then on sunday, totally different ballgame we're going to see sunshine and it's going to be a much calmer day. clouds tonight, but it will be mild. wrapping it up out here and just enjoying it, we'll have to come back inside pretty soon, we're to be so beautiful, a lot of these guys are going to want to get on the water. we were just talking earlier way georgetown sailing club. they s it's when conditions go like this to more than like this with the wind, that's when there's big problems. it happened last year in december, december 18th to be exact. this is down along the seven river where the winds immediately kicked up to about 40 miles per hour as a cold front came through. unfortunately a situation came up and about 20 boaters ended up in the water. we're going to start off gorgeous, pretty good amount of sunshine, not quite as nice as today. but temperatures are going to be in the 60's and 70's. a beautiful day can quickly become a dangerous day and we not only think a cold front is coming through but potential of thunderstorms too. and that could quickly get some gusts up, maybe up to 40 miles per hour, so just so you know, between buy 2:00 and 4:00, here along the potomac, a little sooner out to the west and later to the east. that's when we think is going to will immediately kick up. that's when we want everybody to avoid if your going to be out on the water, keep that in the back of your mind. little bit after lunch start wrapping things up and get back to shore. if you can stay out of the water or off the water when these thunderstorms potentially come through, 2:00 to 4:00, i think that's the time frame we're looking at tomorrow. you should be in real good shape. because matt and sarah, obviously, we don't want be pluck, people out of the water tomorrow. the water is 43 degrees in the right, in america due new tonight metro is taking legal action to make sure riders are safe >> they're filing an lawsuit to be able to implement an antifatigue policy. it also requires any employee who works six straight days to receive at least one day off before returning to work. metro's current union agreement indicates over time is often without fatigue situations. metro first developed the policy back in 2013 to bermuda where a frightening accident at sea caught on camera. got to see this, an american cup crew member fell off. the on board people captured the incident. you can see when he tumbles back into the water, barely missing the sharp edge of the rutters underneath. luckily we're told he was not hurt. it took a total of 16 firefighters to rescue this dog in san francisco. look at the little guy. a firefighter was lowered down using a special k9 harness. fire officials say the dog could have fallen another 60 feet. they say the dog was friendly during the hour-long rescue >> didn't look too frightened either. boa boa news. boa boa is still adjusting to her new surroundings in china. handlers say she's having a little trouble understanding commands. also for the shooting caught on camera moments before the crime. it was a story that went viral. a virginia waitress claimed a customer left a racist note on her receipt. now that man has filed a lawsuit claiming 53-year-old eric wright was shot and killed last friday at 12th street in northeast. police are asking anyone who recognizes these men to give them a call. a virginia man involved in a deadly crash has been charged with involuntary manslaughter. 26-year-old andre dmren was driving northbound on route at any time tuesday when he hit a traffic divider, two female passengers were thrown from the jeep. one died. the other one suffered minor injuries. glen and the male would not not seriously hurt. he's also charged with dui and driving on a suspended license a wood bridge virginia man will spend the next 11 years in prison trying to help isis afederal judge handed that sentence today. he pleaded guilty last october to charges he tried to provide material support to the terror group. prosecutors say he plot wanted i another wood bridge man, just to travel from the united states to syria to fight with isis. we told you about waitress who claimed a customer stiffed her on her tip because she was black. there was note to that effect recent r written on the receipt >> today, the customer in question is refuting the allegations and claims that receipt was fake. fox 5's alexandra limon is live in ashburn with more on all of this. alex? >> reporter: that restaurant is this one anita's new style cafe. you may remember the story. it was viral. she told us she was from a tip and the customer left racist note. the customer reached out to fox 5 through an attorney and said that's not at all what happened. in fact, through a witness statement they gave us, they make pretty strong allegations, including that someone at the restaurant they believe forged the customer's signature on that receipt and the customer's version of event is very different and goes like this. he says that the service was terrible. and that he did, in fact, leave a note on the receipt, but all it said was terrible service. he also claims he left a one cent tip, not zero. and the documents that that attorney sent to fox 5 they also included a copy of the customer's receipt, which they claim actually has a different time stamp than wait showed us and note that said great service but don't tip black people. that's what they claim is their proof that the receipt in question is actually fake because they say that time stamps on those two receipts actually prove that. we, of course, reached out to the restaurant, the owner and the manager, trying to get ahold of the waitress to ask them what happened, and what is their response, we're still waiting to hear back. >> great service. don't tip black people? what? shocked. very, very shocked. wow. who would write this >> it's so disheartening and my heart goes out to kelly and her family and her friends. >> never happened in over 40 years. >> reporter: that was waitress and it's owner who again, we spoke to last month. that's at the story they told us originally, and again, we have reached out to them today to ask them, you know, a response to these new allegations by that customer, who, by the way, wants to remain anonymous and the attorney again, we're still waiting to hear back. jim, sarah? to the district now. where savoy elementary school is set to reopen monday, crews have been hard at work cleaning the school following an ongoing rodent and bed bugs problem. it caused it school to shut down nearly three weeks ago. students were going to another school while cleaning was underway. mayor bowser announced a big financial boost. more than 6 million dollars if new have notes for the 2017 to 2018 school year. money will go towards expanding extracurricular activities scnc college and career supports >> we already make a tremendous investment in public education and we don't equate improving offerings, choices or schools with dollars alone. so we are making sure that we're looking at all of the different things the chancellor talked about, but this is a discrete area where we're going to make new vs >> the annapolis, 66 at leonardtown. here's a look at what's happening. the warm southerly flow kicking in and evident where we got a pretty strong frontal system, a cold front to be exact. because look at these temperatures into the 20's on the back side of it. and that's going to continue to push towards us and that's what's going to happen. winds are sustained anywhere from put about seven to 15 miles an hour, but gusty in some areas, going to be strong when the front comes through. we're going to go see pretty strong storms, here's a look at the storm moving across into ohio before the fronts comes through and once the front comes through, showers and storms along the line but on the back side of it. ridge of high pressure builds in and gets cold and breezy and we're right back to here for the oscar predictions. i watch officer 100 films a year and it comes you down to think my number one film of 2016 is pool. i have my tuxedo on i'll be wearing on sunday. let's go through the playing, he's my well and should win. next is supporting actor. i love moonlight of 2016. he won the sag award. he's an amazing actor, for me i think lucas hedges, the actor from manchester by the sea the more defining supporting character. he's in the film for a very short amount of time i think the actor who played shiron in my opinion deserve to be nominated but lucas will win because it will give moonlight at least one oscar win right there for a phenomenonal put movie by barry jenkins. next supporting actress. i think this is viola davis is brilliant in fences. played the character on stage and in the film directed by denzel washington who's amazing in the movie as well. by august wilson was the screen play and play. incredible performance of viola davis when you get to the and she has that breakdown sequence, it's unbelievable to watch that, strong character, extremely strong performance and i loved watching that. she was very much a leading character, which is why i think she deserves this award and the supporting category for sure. next is best actor. now, this is where it gets interesting, acting category is tough to predict, if you were to ask me a couple months ago, i would have cold you casey of a flex was the one to go to and for the defendant win i think denzel will take this, i think he deserves the win, he gives a powerhouse performance in the movie but do not be surprised if casey affleck sneaks in there. next best actress, another category extremely hard to frequent. i would have told you natalie portman in jackie, no question, but then everything changed. when i see bell won for el and emma stone won for now it's all up in the air, i think emma stone deserves it. i think she was phenomenonal in the performance. it's a personal film for her, one of the best thing she's ever done singing and dancing and beautifully directed. she became this character and you can feel the emotion from her real life coming through the performance as well, emma stone is my pick for best actress, will and should win. finally la la land best picture, 14 nomination, this film is a master piece reminds you why you love going to the movies, tweet along i'm shawn yancy >> i'm sarah simmons. we begin with an update on the two police officers shot in the northeast. one has been released from the hospital. we have new video showing part of the altercation. lindsay watts is live in northeast. person who record that day video? >> reporter: that's right, shawn, something important that we heard both from that witness and the police chief today. we cannot say for certain that it was the suspect who shot both of the officers. police say they believe that both the suspect and one of the officers fire shots. but they have not ruled out a friendly fire kind of situation. this is where it happened last night here in the trinidad neighborhood of northeast. i can see cream tape. he started recording after the suspect fire his gun and just a warning, this video may be difficult to watch. you can hear someone yelling shots fired. the suspect is already down on the ground. then three gunshots. one of the officers involved falls. more officers arrive running
