way of showers to wet the roadways. most of it north and west of the city up into montgomery county. you can see it pushing across 270 and in montgomery county. not going to rain all day but we'll see scattered showers and thunderstorms develop from time to time during the course of our thursday. temperature right now, it is warm out there at 69 degrees. humidity, 96%. it goes any higher than that, we'll have some fog. winds out of the south at five miles per hour. here is your forecast. if this looks familiar, that is because it is. it will be more of the same. highs in the upper 70s with montgomery county police. they are on the scene of an accident that is involving a pedestrian. this happened around 1:30 this morning. this is near the intersection of rockville pike and edmondston drive in rockville. the state of georgia executed troy davis at 11:08 last night despite last-minute appeals, international condemnation and protests. davis was convicted of the 1989 killing of an off-duty police officer. right before he died, davis said he was innocent. and another government shutdown could be just over a week away. congress failed to pass a continuing resolution last night that included $3.7 billion for disaster relief. the next republican debate is tonight in orlando, florida. it is organized by the fox news channel, the republican party of florida and google. d.c. fire chief is in the middle of an ethical fire storm over whether his brother can get a promotion. kenneth ellerbe is a chief and there are questions about whether his brother kelton can get a promotion. >> reporter: kenneth ellerbe was a 27 year veteran of the d.c. fire department before abrief stint lead as chief this heading up the department in sarasota, florida. now, he is in a quandary, what to do about his brother. >> no final decision has been made. no permanent promotion has been made. >> reporter: he didn't want to talk about the issue on camera but tells me privately his brother has done his job for 20 years. he says he sent him into the pentagon on nerve. the unrestaurant thing is that he is related to me. what is the gray administration to do? the mayor deferred to his deputy. >> i am asking the general counsel to provide clarification and to provide a path as to whether or not this can be done. >> reporter: personnel regulations say no public official may promote a relative in an agency where he exercises control. it is not sure whether a nepotism law applies to uniformed services and personnel but -- utah fact that a person's brother or sister is a chief should not prevent the person from being promoted. the issue is who makes the decision. >> phil mendelsohn is chairman of the committee that has oversight ever the department. >> the current chief, his fingerprints are not on his brother's promotion. there are others i'm told who will be making the decision. >> reporter: mendelsohn says he has been assured the decision will be made by the are taking a live look over washington, d.c. this morning. good morning. i'm sarah simmons. welcome to fox 5 morning news. let's check in with tucker barnes now. he is here with the latest for us. it is kind of like spring, summer, i don't know but it is just muggy. >> you don't like it. >> you'll live with it. >> she's going to live with it. not much choice. we have temperatures in the upper 60s, low 70s. just a little bit of shower activity to add to the moisture in the fair. all in all, not a fall-like feel here. this is last full day of summer. there is your satellite-radar. you can see it going around and around. hit and miss across the area. looks like a pretty good batch across the lower eastern shore. maybe some embedded lightning there. just north and west of the city, pushing up towards montgomery county, we have a pretty good shower as well. that will be the theme around here today. much of the day should be dry. might be a few peeks of sunshine from time to time but the risk of a shower and/or a thunderstorm will be here in the forecast throughout the day today. temperatures right now at reagan national, 69 degrees. 70 at dulles. 67 at bwi marshall. mostly cloudy skies for today. showers and we introduce the possibility of a thunderstorm today. two degrees warmer than yesterday, 79 although it will be a muggy 79. >> that is going to feel like summer for just a little bit longer. >> you got it. a traffic alert in montgomery county for you. a driver hit someone on a scooter around 1:30 this morning near the intersection of rockville pike and edmondston in rockville. the victim on the scooter does have life-threatening injuries. we were told at first the driver did not stop at the scene but was stopped by officers a short distance away from this. let's take a live look at the scene on rockville pike. it is expected to be closed between veirs mill road and edmondston drive through the morning rush hour. you can see this picture. it is also raining right now. that will be an issue during your morning commute. you can imagine any traffic trying to get in and around this area, it will be quite a headache this morning. we'll check in with julie wright coming up in just a bit. also new this morning, we are hear aiferg fire overnight in an apartment complex in howard county. -- we are hearing of a fire overnight in an apartment complex in howard county. we are told three people were rushed to the hospital and 34 people living there now have no place to live. in our other big story, the execution of troy davis. the state of georgia executed him last night despite last- minute appeals. fox 5's stacy cohan has the latest live in the newsroom. >> reporter: the execution of 42-year-old troy davis set off international protests including some in our area. ed with a scene in washington last night around 11:00 where dozens of proat the timers gathered outside the supreme court in hopes of gaining last high pressure minute intervention. their effort was unsuccessful. at 11:08, troy davis was executed. his effort to avoid the execution was supported by former president jimmy carter among others. some view davis' death of as failure of the judicial system and a lack of interest by president obama. >> may god bless those who stand in the hall behind me pushing for a better justice system. >> reporter: the family of officer mark mcfail has fought equally hard for the execution to stand. relatives of the slain officer say justice has finally been served. i'm stacy cohan. back to you. >> thank you. a white supremacist gang member has been executed for the infamous dragging death of of a black man in texas. lawrence brewer had no last words before a lethal injection in huntsville. he is convictioned of chaining james bird, jr. to a pickup truck and pulling him to his death 13 years ago. we have developing news from the hill where there has been a surprise sportsrise defeat of a bill to keep the government running past next friday. democrats and about 50 tea party republicans oppose the measure over parts of the bill that dealt with disaster aid and spending cuts. the opposition to disaster money comes despied predicts that fema will run out of funds in the next few days. and get ready for another gop debate. the republican candidates are appear nation fox news channel google debate in orlando, florida. governor perry and mitt romney are expected to go after each other over social security. romney is raising new questions about perry's position on it. some of the questions will come students turned out if a memorial service for dominique frazier. police say the 18-year-old was stabbed to death by her roommate in the dorm room following an argument over music. alex six simpson is being held without bail. funeral services for frazier are being held tomorrow. two prince george's county police officers indicted for the beating of a university of maryland student turned themselves in to police. each posted $75,000 bond and were released. the incident happened a year and a half ago after the maryland big win over duke in basketball. the two officers are facing felony assault charges. police in prince george's countiy also asking for the public's help in two sex assault cases. both attacks happened this month in the for he haveville area. police handed out flyers looking for new witnesses. first attack happened on september 6th and a similar assault took place just 10 days later. both incidents happened late at night. an attempted armored car heist ends in gunfire. in the middle east yesterday. an armored car heist leads to a wild shootout in broad daylight in the district. this happened yesterday morning at a cvs drugstore on georgia avenue northwest. no one in the store was hit. two other men drove off. one want to a local hospital with a gunshot wound. at come police ran off and is still on the loose. the race to replace leslie johnson on county council is now set. former councilmember leslie johnson resigned after pleading guilty to corruption related charges. both nominees want to help the county move forward. >> we have had a lot of corruption in prince george's county, not with just this scandal. there have been a lot of problems here. i think the most important thing that is we really put an end to it. >> we are all upset when we have corruption that occurs but i am focused on a new day, focused on the future. i was raised in the house that the cardinal rule was don't bring shame on my house. that is my pledge. >> the general a thunderstorm. more like a summertime forecast. >> what is up with that? all right. >> that's the way it is. we'll show you the shower activity. there is a little fog out and about across the region. but for the most part, the fog is less thick than it was yesterday. all right. hit and miss shower activity. there you go just off to the north. pushing up into montgomery county, sandy springs probably getting some shower activity. this will be working up towards burtonsville and columbia. we have more showers along the lower eastern shore. let's switch maps here. we have more showers developing off to the south and west. pretty good band of showers now south and east of the city. this has had a history of thunder and lightning. that will be the big difference from yesterday. you can see off to and west, not a lot of shower activity. and it is not going to rain all day today just like yesterday but it will be mostly cloudy. there might be a few peeks of sunshine and during the course of the day from time to time, we'll see the showers and thunderstorms breeze on through. i hope you like this pattern. it is not going to break down any time soon. we are kind of stuck in it. for the foreseeable future, that means right through the weekend unfortunately, we'll have at least the possible of some scattered showers and thunderstorms in the forecast each day. 70 right now at reagan national. 07 in gaithersburg. 68 in leonardtown. they we'll be on the warm side with highs in the upper 70s to about 08. plenty of clouds around, a little sunshine from time to time. showers the south at five miles per hour. here is the five-day forecast that features more rain than sun. friday, saturday, sunday, even monday, we've got the possibility of a few showers in the forecast and the big story this morning is going to be the closure of 355 in rockville. that is shut down in each direction right now as a result of an accident which occurred back in the 1:00 hour involving another vehicle and a scooter. you will find that 355 -- if we have those live shots, let's go to it. 355 remains blocked off in each direction between veirs mill road and edmondston. that is going to be tied up until further notice for this ongoing investigation. there is the scooter. there is the car and the windshield badly damaged to put it lightly. this is what the ongoing investigation is finding my trip coming in through rockville, we were dealing with some rain so that could very well cause this investigation to linger a little bit longer. so proceed with caution, 355 shut down between veirs mill and edmondston until further notice. 270 is open for business as the alternative route. no incidents to report if you are traveling in on 66. a nice easy go coming in from fair oaks headed in towards the capital beltway. that's a check of your fox 5 on-time traffic. >> thank you. thousands of people in our area are in a foul mood over a not so pleasant smell. if you've been near the potomac river or the c&o canal, you know what we're talking about. our tricia thompson is tracking down the source of the step. in this -- the course of the stench in this fox 5 investigation. >> reporter: if you live or play along the potomac river, you may have noticed there is a bit of a stink about where that smell is coming from. >> all the way down the canal, i've smelled the smell. >> yeah, some would describe it as old socks. >> i would say it is somewhere south of rotten eggs. it just permeates everything. >> something wrong with this picture. something wrong with this fragrance. >> reporter: david has been kayaking the potomac river for 30 years and says the water, the trees, the bald eagles, it all gets ruined by that certain smell lingering in the air. >> it is just awful. you have all this wonderful outdoor and then you're followed around by this odor, this noxious odor. it is just contemptible. >> i started jogging when i moved to cabin john and every quarter mile on my runs, i would smell this odor. >> reporter: it took cabin john residents matthew logan, max thornton and burt great areas to figure out where the smell was coming from. like many, they at first assumed it was stagnant water in the c&o canal. >> it is kind of shocking when you realize it is not that. it is sewage. >> reporter: it all started back in the 1960s when congress ordered the construction of dulles airport. now, airports, they create a lot of sewage. so the federal government ran a sewer line from the airport to the potomac river. it crosses just below great falls and then runs on the maryland side along the length of the c & o national historical park. but remember, this was the '60s. the federal government owned the land but it wasn't yet a national park. so it was really the cheapest and east yet way for the federal government to get all of that sewage down to anacostia where it went to the blue plains treatment facility. >> that smell is all of the collected waste from all of those communities. >> reporter: more than 50 years later, the d.c. water and sewer authority says virginia, maryland and the district all contribute to what is called the potomac interceptor. >> in order to something to flow somewhere, something has to come out, the air comes out. >> the way it is constructed, along the entire length, you will find several hundred vents. >> like a wind tunnel when you are near it. but the smelliest, most disgusting wind tunnel you've ever experienced. >> reporter: they took us on a short hike to the vent causing all the stink in cabin john. >> these sewers are made of the same substances as all the other sewers in the washington area but this is the only one that is vented like. this. >> reporter: with the help of about a doesen other communities and organizations, they say it has taken more than 40 permits, 15 years and at least one lawsuit to eliminate the smell. d.c. water is now building four large structures along the sewer line. they will eliminate the need for the old stone vents. >> we are constructing a facility which will draw the gases out of the sewer, treat it through a carbon tank and discharge it. >> reporter: d.c. water system's maryland side will finish in 2012, virginiaing, the next year. >> high time. >> brilliant news for david who says after waiting near lay lifetime, he will finally be able
