all new tonight, a frightening attack in charlotte's dilworth neighborhood. >> police say someone attacked a worker with a knife outside his business and then tried to rob him. this happened in the middle of east boulevard in a busy shopping center. today shoppers and store owners were stunned when ken lemon told them what happened. >> that man worked at zen massage center. right here on a busy east boulevard. you can take a look here. we've been watching cars go back and forth all day. that guy stepped outside to his car. you can take a peek right here. you see where the parking lot is. we're on the backside of the building. it's completely hidden by people passing by up front. he never saw the man walking up from behind. didn't realize he was about to become a victim of an attempted robbery until he felt the knife at his throat. the victim got away with a couple cuts. it may take longer to heal from >> fantastic neighborhood, great people, great service. >> she owns the building next door. she says there's rarely a problem in this community. her parking lot is next door to the lot where the worker faced a robber with a knife. >> i'm absolutely shocked. >> reporter: people often walk on this stretch of east boulevard, there's a harris teeter grocery store and several businesses on the same block. coleman visits businesses here. >> very little crime around here. >> reporter: in the last six months there have been nine robberies, 48 assaults, four of them were aggravated assaults. they are people expected. >> you would think this neighborhood is -- that wouldn't even happen in this neighborhood. >> the owner of zen massage center says he's never had a crime in the 11 years here. they have motion sensor lights that come on when anybody moves nearby. they say mapping tool that's inside kent's story on the home page. now we have breaking news in catawba county where a deputy shot a suspect who fired a shotgun at him. dave faherty is live at catawba medical center where the suspect is being treated now. dave? >> that suspect rushed here to the medical center after being shot in the hand. it happened while a deputy was trying to serve a warrant at a home this afternoon. take a look at this video from chopper 9 sky zoom. you can see the scene near the home on lake hickory. channel 9 learned the deputy went to serve a warrant for failure to appear on possession of a firearm by a felon against a berry hildebrand. investigators say the 44-year- old yelled to the deputy he but tried to flee out a back window. when the deputy chased after him. hildebrand fired a shotgun at the officer. the deputy went back to his patrol car to get his long gun and deputies say he fired that long gun after hildebrand pointed the shotgun at him a second time. >> none of our officers want to harm anybody out here. including people that's wanted. they want to go home to their family also. they're not going to take unnecessary chances. this is what they get paid to do. he couldn't just get in his car and leave. >> right now sheriff deputies are getting ready to go into the garage to search it for any more possible weapons. i was told by the sheriff earlier that once hildebrand is treated here, they're going to take him to the county jail. reporting live from catawba county, dave faherty, channel 9 eyewitness news. breaking news right now out of west charlotte where a thousand people don't have electricity. we're asking duke energy if beechnut road that chopper 9 sky zoom flew over earlier. police say a truck hit a power pole. you can see that pole there lying across the roadway. we're asking if anyone was injured in all this. duke officials say they hope to have the power restored by 6:30. a big sigh of relief for investors right now as stocks finally rallied today. although both of the indexes are still finishing the week with losses. the dow added an incredible 313 points today. nasdaq gained 70 points the day. stocks surged after oil prices climbed back above $28 a barrel. you might remember they fell to a 13-year low yesterday. bank stocks also rebounded after a rough stretch. retailers also say today that sales rose more than expected in january. giving investors even more confidence in the market. even though the markets have taken a beating, charlotte's housing market has not taken a hit. coming up ahead tonight at 5:30, the reason that sales are and the factors that are pocket. the presidential front runners are ramping things up tonight before the first in the south primary in south carolina. winter weather that's headed our way, state and city transportation crews are all ready planning on how to keep you safer out on the roads. eyewitness news reporter jenna deery just got an update from them. she's live right now in east charlotte, jenna? >> reporter: erica, that started with sealing a water leak that was creating a sheet of ice along independence at i 277. now it's turned to widespread treatment of roads which i learned this afternoon, crews may not be aggressive about until this weekend. it's been a cause of concern for drivers since saturday. >> our cars are stopping in the middle of the road. i saw almost an accident several times. >> reporter: just today, a broken under ground water line was finally sealed off. it had been leaking on independence at i 277 and freezing over causing back-to- back wrecks. crews prepare to get roads winter weather ready. >> the very first places you'll see our crews are the highly traveled routes. >> reporter: the plan is to hit interstates and highways first. but drivers may not see trucks sunday. the state is waiting to make a call until it knows whether to rain. >> that drastically changes how ncdot would respond to the advance. >> reporter: spokesperson jordan ashley walker says any form of rain would wash away whatever the state puts down and resources are costly. more than half of the state's snow and ice treatment budget has all ready been used up this winter. >> we want to be good stewards of the supplies and the equipment and the crews we have and make sure they're put to the best use possible. >> reporter: drivers told us they just don't want it to be left up to them to get around safely this weekend. >> the experience doesn't help. you have ice, you need to have salt. >> reporter: city crews have been out treating bridges and but they too also plan to wait until late this weekend to decide whether or not to dedicate more crews to keeping roads safe as we continue to track what to expect. live in east charlotte, jenna deery, channel 9 eyewitness news. jenna, thank you, environmentalists are demanding charlotte based duke energy pay more for decades of suspected pollution at the company's coal ash ponds. now today they spoke in superior court challenging a 7 million-dollar settlement between duke and the state department environmental quality. the settlement cut down a previous 25 million-dollar fine against the energy giant. and it also settles pollution claims at all 14 coal ash plants. coming up ahead, tonight at 6:00, the landmark resuming that will allow duke energy to drain it coal ash pit right next to the source of charlotte's drinking water. new tonight, the city of charlotte officials tell channel 9 they will have a chance to speak out about a controversial ordinance before this would protect the lgbt community from discrimination in various places including businesses and also allow them to use any public restroom they want. men's or women's. this ordinance failed last year. the next vote is expected february 22nd. a north carolina scientist says the state does not have the ability to track or control mosquitoes. this comes amide fears of the mosquito-born zika virus suspected of causing severe birth defects. megan davies with the state health department says there's no morormoney for local mosquito control and parkway west control programs have -- pest control programs have been eliminated. any zika virus vaccines are months away from large scale trials. the agency says up to 4 million people could be infected this year. the department of homeland security is now monitoring for infected travelers at the border. new information on a shooting and chase that ended in north charlotte. blackman and donovan davis were fighting on leek street yesterday. blackman shot at him and missed. the men led them on a chase. both the men face a list of charges tonight. a central piedmont community college student is facing charges after officers discovered that he had a gun on campus. an officer noticed a knife showing in his car at the matthew's campus on wednesday. he also turned over a gun that he says he forgot was in his car. cpcc tells channel 9 that grub didn't mean any harm. they're reminding students that handguns are only allowed in a closed container in locked cars. south carolina flood victims left to sleep in homes taken over by mold because they have nowhere else to go. >> you see a lot of despair. you see a lot of destruction. >> with federal assistance money running out, where victims are heading out this weekend. vi it has been nearly 17 years since the shooting massacre at columbine high school. that tragedy sent shot waves through the country. tonight the mother of one of the shooters is speaking about it publicly for the first time. eyewitness news anchor allison latos is joining us with a preview of this abc exclusive. this is a special interview that families can watch together. for many this tragedy may know that it happened. tonight, the mother of dillon is breaking her silence talking about the shooting, the victims, her relationship with her son, and what it was atlanta. up fortunately our weather is coming from the north. you see cold air pushing back in. we have readings of teens to 20s from the great lakes to the northeast. 36 belmont cox concord, harrisburg, ballantyne. winter picking up in the high values down. and it'll get dangerously cold in the mountains tonight. heading to bojangles arena, we have the san diego gulls in town. chill. mid 30s at 7:00. 10:00 will be around freezing. near 20 in the metro. 19 in salisbury and lincolnton. readings in the single digits toward the high country. the sun will be shinning, as it will for most of saturday. temperatures will be in the upper 30s tomorrow afternoon. valentine's day started sunny. look at the morning chill. but the clouds will begin to roll in, a sign of things to come. tomorrow looks great from start to finish. snow showers and pretty early in the mountains. this is not a big snow maker for the high country. the northwest winds will be felt. even in the charlotte area tomorrow afternoon. keeping the windchill values well below freezing. actual air temperature mid 20s at 9:00 a.m. .around freezing at lunch time. topping out in the mid 30s. we should be 55 this time of year. we'll be close to 20 degrees. colder than average. our neighborhood forecast, let's talk about the high country, i'll have more detail on the high country as far as those windchill values coming up at 5:30, but this is dangerous chill. snow showers early on. about 10 degrees. windchill values much lower than that. we'll be stuck in the teens all day. saturday night, we're a okay. future cast by sunday morning, now we're starting to see some clouds. and then we start to look to the west. and here comes that next batch of snow over kentucky, moving sunday afternoon, that leads to the wintery mess on monday, for more, let's head to vicki graf. >> we've been watching this storm closely. the timing of it and the track of the storm. and the models are starting to agree more on both. so before dawn, coming in on monday, we are tracking the potential for snow. this is as kids would be heading to the bus stop and as you would head out for the morning drive. we're tracking the threat for snow that could stick to the ground. as we head towards mid-morning by 7:00, 8:00, 9:00, this will start to switch over to a wintery mix. we'll see a little bit of snow mixed in with that freezing rain. maybe rain in the charlotte area. northward, snow. and then as we head through the afternoon, that warmer air will filter in, and that's when we are tracking the threat for rain here in the charlotte area. could be heavy at times and still a little wintery mix in the mountains. for more on what we can expect through the weekend, we'll send it back over to steve. >> we have the chill over the weekend. highs in the 30s. we warm up as the storm comes in. it's important to note, while charlotte area monday, the bulk of this storm comes in monday night. that will be in form of rain. how about the best news of all. mid 50s tuesday and wednesday and it goes up from there. that's the best thing i could get my valentine. some warm weather. >> that's all i can do. flames and smoke pouring out of the charlotte home just seconds after a family escaped. >> she lost the house. it's a blessing. she's alive. >> how the freezing temperatures might have played a role in what started it. wall street's roller coaster is not hurting the housing market here in charlotte. the factors putting it on top and more money in your pocket. a new cell phone app's the plan to protect you and the an to protect you and the it only takes a few taps to download just about anything on your phone. but new tonight, lawmakers say they're worried that some of those apps are putting you at risk. every time you open an app, you're actually sharing information. sometimes very personal information. a georgia congressman is proposing the apps act now. it would require app developers information they're collecting and to set standards for how they keep it secure. >> you have to have rules. and you have to have protections for consumers. >> he proposed the bill back in 2013. but now he's expecting more support this time around because of increased concerns about identity theft. it was just this week that action 9 showed you another sneaky way thieves are trying to steal your information by targeting your children. there's a recent study that found 10% of children are victims of identity theft. action 9 suggests freezing your child's credit. and for you, getting a credit report every four months and then keeping a close eye on your finances to spot unusual activity. today lawmakers voted to kill a plan to make restaurants show you how many calories are in your meal. next year chain restaurants and fast food places will have to list calorie counts on menus or menu boards. to only require take-out and delivery places to tell you about calories on websites and mobile apps. critics say that will let restaurants mislead customers. >> you could order a platter of chicken wings. and it could say it's 100- calories. and that's 100-calories for one wing and not the whole platter. >> the white house opposes the bill. they say it leaves americans with less information to make a healthy choice. we're working on all new stories important to you next at 5:00,
