not be decided by a jury. last night ... the judge granted ashley white a change of venue ... after a jury couldn't be seated. white's son .. noah thomas .. was found dead in a septic tank last march. wsls 10's bethany teague breaks down this means for the case. pulaski county circuit court judge bradley finch granted the change of venue motion for ashley white.. something that has only happened in pulaski county twice in 50 years. out of 66 potential jurors.. 41 were disqualified. finch explained that 20 jurors had fixed opinions already.. or knew they couldn't be impartial. 11 had been active on social media regarding the case. six personally knew noah.. or had helped search for him last year. eight felt that white should be charged with murder.. not just child abuse.. or that she should be required to prove her innocence. however.. after this decision.. the prosecution asked for a rather than a jury trial elsewhere. in a move that surprised some.. the defense agreed to this. we spoke to a criminal justice expert at radford university who says judge finch's initial decision to change the venue could have influenced the defense's choice to let him ultimately decide white's fate. jack call, radford university - "one of the reasons the defense might be willing to dispense with the jury is because the defense attorney perceives judge finch as a very fair-minded person. if she had a different judge, she might not perceive it that way and may not be willing to give up the jury right." white's bench trial will start thursday morning at nine. in pulaski bethany teague wsls 10. nicole lovell's father speaks to a natiowide audience as he talks to talk show host dr. phil mcgraw in an episode that aired earlier today. david lovell talked a lot about his daughter's use of social media, about being bullied, and about the last time he saw his daughter nicole was december 19th. she disappeared nearly six weeks later on january 27th. lovell told dr. phil he puts a lot of blame on himself and speculated on any possible motives suspects david eisenhauer and natalie keepers could have. he also described how nicole was bullied. david lovell, nicole lovell's father - "a girl with self- esteem issues anyway somebody told her some good things about her of course it would be easy to seduce a bullied little girl." meanwhile... many of you have been asking about nicole's mother.. tammy weeks. she spoke out at the community vigil for nicole earlier this week but we've also been talking. tammy tells me she wants to raise awareness about social media and online dangers but right now... she just wants to grieve the loss of her daughter. police in our area are offering tips to make sure children are safe while online. here are some of the warning signs first ... they're spending a lot time online ... especially at night. most children who fall victim are usually in chat rooms and spend time online after dinner or on the weekends. also ... they may be using an online account belonging to someone else. investigators say ... parents should routinely check a child's computer or cell phone. lt. andy wilburn/radfor d police - "when something tragic happens in your community or you see something online and your kid talks about it, sit down and have a conversation with them, do you know how this happens lets talk about this do you have anybody on your social networking site that you don't know why are you friends with them?" christiansburg police plan to host an internet safety course for parents. the free training is set for tuesday, february 23-rd from seven to nine p-m at the christiansburg recreation center. the course will teach parents about popular social media sites and apps that kids use. turning now to your forecast ... and the wind only made it feel colder. storm team ten chief meteorologist jeff haniewich joins us now. jeff ... with wind and cold air in place, wind chills were below zero in the highlands and in the single digits in the nrv. and tonight looks to bitterly cold with wind chills 15 below zero in the highlands.it will also feel below zero in the nrv. please bundle up and take good care of yourself and your pets tonight. tonight: any mountain snow showers end, blustery with lows in the middle teens.but with the wind, it will feel much colder than that. thursday: partly to mostly sunny blustery with highs around 30. another weak disturbance may ... the james river association plans to legally challenge a state permit allowing millions of gallons of coal ash wastewater into the james river. dominion virginia power plans to dump 350-million gallons of wastewater into the river. this comes as the company moves to close coal ash impoundments at power plants. crews in botetourt county now have one of two historic slave quarters on the back of a flat-bed truck ready to be moved. protestors were on the site of the greenfield plantation this morning scared the county might be moving the building to a new location without letting them know. when it happens to show the county people oppose the decision. roblyn brand, protester: "for the last week or two i've actually had my hat, my gloves, and my boots in my car so i could just take off whenever i'm told they're moving them, and that's what i've done today." the man organizing the protest says he submitted new information to the court yesterday highlighting the structures on the state and national historic registers. liniel gregory, protest organizer: "these things are just like monuments or tombstones if you will to those slaves who lived, worked, played, raised families, and died right here." the county says it will not move the buildings until next week. the exact date depends on weather conditions. in news making national headlines ... the justice department files a civil rights lawsuit against the city of ferguson. this comes a day after city council voted to re-work an agreement aimed at improving how police and courts treat the poor and minorities. attorney general loretta lynch - "today the department of justice district court against the city of ferguson missouri. alleging a pattern and practice of law enforcement conduct that violates the first ... fourth and fourteenth amendments of the constitution and federal civil right laws." attorney general loretta lynch said ferguson's decision to reject the deal left the department no choice but to file a civil-rights lawsuit. two republican presidential candidates end their run for the white house. this ... just a day after the new hampshire primary. today ... former technology executive carly fiorina announced she's dropping out of the presidential race. she announced the decision on twitter. meanwhile ... new jersey governor chris christie also announced he's ending his campaign ... after placing sixth in yesterdays primary. as for the rest of the candidates ... here's how they finished in new hampshire ... on the republican side ... donald trump came in first ... followed by john kasich ... ted cruz finished third ... and marco rubio finished behind him in fifth. meanwhile on the democratic side ... bernie sanders came out on top ... trailing behind him was hillary clinton. roanoke may select its next mayor this weekend. the democratic "firehouse primary" features the only two candidates for the position, vice mayor david trinkle and 12 year city council veteran sherman lea. no republican candidates have yet stepped forward. both candidates say to win the voters, economic development will be the most important issue. but each of them have different ideas of how to get there. sherman lea, mayoral candidate -"i think if we're going to be successful in a lot of areas, especially in the area of economic development, we have to sell our area as one locality, and my background and history reveals that i've done that and will continue to do that." david trinkle, mayoral candidate - "i've heard from businesses that have considered coming to roanoke and they're fearful that there's not a workforce here, and so we need to make sure our workforce is motivated, healthy, trained, certificate with that i really do think businesses will start to locate here." you can hear the candidates talk about those issues publicly tomorrow night at a forum in center in the square hosted by the regional chamber of commerce. big changes are coming to the iconic hotel roanoke as its being added to the hilton's curio collection. wsls 10's rachel lucas breaks down what that means. "the grand old lady, hotel roanoke is being recognized for it's unique, iconic history in the star city by being added to hilton's curio collection. so far - there are only 22 other hotels that have earned the distinction virginia native and ceo of hilton worldwide chris nassetta says hotel roanoke being named a curio has been in the works for about eight months. :22-:31 chris nassetta/ceo hilton worldwide - "it's a perfect match because hotel roanoke is such a unique hotel. you walk in and it has an iconic history. well over a hundred years. he says prices will remain competitive, and the name also travelers benefits. at the same time - it allows the hotel more freedom to use local vendors, food and even contractors that are currently working to complete a six million dollar renovation to the hotel. hotel roanoke will finish parting ways with double tree and officially take on the curio brand on february 28th. for more information on the story and what's going to happen to the double tree cookie, visit us online at wsls dot com. in roanoke i'm rachel lucas wsls10. dinosaur kingdom in natural bridge will reopen this summer. the theme park closed after a fire in 20-12. creator mark cline says now it's time to build a new and improved dinosaur kingdom two. he's making 30 new dinosaurs for the park ... which will be five times larger than the original. it'll also have a civil war theme set in 18-64. mark cline/dinosaur kingdom ii - "in this world stonewall jackson here to help the south as the yankees are using these dinosaurs as weapons of mass destruction against the south." cline makes sculptures displayed around the globe and his work gets a lot of attention. lexington and the rockbridge area tourism's director of marketing says it'll give this area a needed boost. a danville company is helping improve the internet at the boys and girls club in the city. rod lyman/cirruswo rks, inc. - "it plays robin hood on the internet, essentially." still ahead ... how this is expected i'm zach bacon with appalachian power. i'm an energy efficiency coordinator here in virginia. to me, it's all about being able to help our customers learn energy efficiency. this partnership with appalachian power allows us to touch more families in this region that really need it. (woman) when we first moved in, the house wasn't very livable. it had holes in the ceilings. it was very cold. they saved our house. (announcer) we may be a power company, but the true power in our communities new tonight at 7 ... employees and kids at the danville boys and girls club are now able to be more productive when working on computers at the club. entrepreneurial tech company. wsls 10's colter anstaett explains. up until about three months ago, all of the kids on the computers at the boys and girls club in the afternoon would cause the employees' computers to slow down so much that it was difficult for them to get work done. "after 2 o' clock when the kids come in, we noticed that the internet would slow down." enter cirrusworks, inc., an entrepreneuria l tech company in danville, originally started by a company called "the launch place", which is also based in danville and works to bring technology based companies to the city. faith stamps/boys and girls club exec. director - "there was nothing really built in to the early design of the internet to play a traffic cop role." but, that's exactly what cirrusworks, inc.'s technology does. rod lyman/cirruswo rks, inc. - "it plays 'robin hood' on the internet essentially, stealing bandwidth from the guys that are hogging it all and giving it to guys that aren't getting enough." in other words, the equipment ensures that everyone on a computer at the boys and girls club gets the same amount of internet speed instead of one or two people taking up all of the speed. maya gary/8th grader - "i think in the late afternoon it's productivity by maybe 20 percent." the kids have noticed the increase, too.
