an 11-year-old takes measures into his own hands after an intruder enters his home killing a 16-year-old. that st you're watching "news4 today." >> i came out and found out. but he was -- like just laying there and not breathing. >> an investigation continues this morning into t death of a 5-month-old baby boy and why the nearest ambulance was so far away. a woman who was told -- who told news4 she was his aunt says the boy's name was trequan. we know it was a d.c. fire truck that started taking him to the hospital. the first ambulance dispatch was seven miles away from the home on hillside road in southeast. d.c. fire officials say paramedics on fire engine 30 arrived in about four minutes. they asked for an ambulance from neighboring prince george's county but after finding out there wasn't one available chose to drive the baby to the hospital themselves. the child's aunt said he had asthma and lived in a hot apartment. >> the house is hot, it's hot in there. >> a closer d.c. ambulance eventually met up with the fire engine 15 minutes after the call went out. about halfway to children's hospital, but then the baby was in critical condition and did not survive. an official cause of death has not been released. d.c. fire and ems are promising to get to the bottom of the response. this death comes after two recent high profile incidents. a 77-year-old man collapsed across the street from the firehouse and no one inside helped him. he later died. the firefighters on duty were disciplined but the lieutenant in charge was allowed to retire with her full position. pension, rather. earlier this year a 1-year-old boy choked on a grape and the closest ambulance was not sent and a fire lieutenant was charged with neglect of duty. prince george's county is look for ways to cut costs in its fire department. that includes reassigning a dozen firefighters. four of them will come from the riverdale heights station, making that entirely volunteer staff. bowie and accokeek will have also have firefighters reassigned. this morning, a community will gather to remember a police officer who was gunned down. shannon miles who police say shot goforth 15 times has been charged with capital murder in the shooting. a developing story now at 5:17. a county clerk is behind bars after refusing to issue marriage licenses to same-sex couples. the federal judge in kentucky said enough is enough and sent kim davis to jail for contempt of court. in june, the u.s. supreme court made same-sex marriage legal. davis said her conscience wouldn't allow her to issue the licenses to same-sex couples. in fact, davis stopped issuing licenses to any couples back in june. her deputies now, five out of six of them, will start issuing marriage licenses today. davis -- the couple that's suing davis because she wouldn't issue the license is set to tie the knot today. virginia lawmakers are once again up against a deadline in a battle that affects every voter in the state. "the washington post" reports democrats and republicans have until today to suggest names for an expert who will help redraw congressional districts. last year, a court found the twisting boundaries -- existing boundaries concentrated black residents in one district. you may notice a pretty big first, the university of maryland is allowing beer sales in the stadium. anyone who looks like they're under the age of 40 will be asked for i.d. you can only buy one beer at a time. if everything goes well, fans can see wine sales down the road. tough decisions lie ahead for the redskins. the team has 20 marines were participating in that training that requires them to exit through the back of the helicopter using suspended ropes. 5:24 now. police in missouri say an 11-year-old shot and killed a teenager who was trying to break into their house. st. louis police say the 11-year-old was home alone with a 4-year-old when the teen and another person tried to get inside. once the two made it inside, police say the 11-year-old shot the 16-year-old intruder in the head. the mother of the shooter says she bought the gun for protection. >> it doesn't matter the age. children have access to guns all too often and all too often they end in tragic circumstances. >> he's a kid. a kid killing another kid, that's just -- it's unexplainable. >> the person who broke into that house with the teenager is now in jail. police are not saying whether they plan to charge the 11-year-old in that shooting. prosecutors in south carolina plan to seek the death penalty against the accused charleston church shooter. police say that dylann roof shot and killed nine people during a bible study inside emmanuel methodist church. heal a sew faces -- he also faces federal hate crime charges. and a painting of j.e.b. stuart has been taken down. the judge decided to take it down because the courtroom should be a neutral place and can't be -- can't be that if it has a symbol of the confederacy. there's still a memorial of stuart standing outside the courthouse. in "news4 your health" this morning, new numbers show the use of smokeless tobacco is on the rise among athletes. the smoking among high school students has dropped by more than 20% since 2001, but over that same amount of time the number of high school students using smokeless tobacco has grown to 11%. and the more sports the student plays the more likely they're to use it. the pew asked what people what they taught of their generation and it wasn't so great. 59% of the millennials said theirs was self-absorbed. and 39% day today. what do you say? >> i say it's going to be a pretty good day to be outside early this morning. kind of cloudy and dry. later on this afternoon, that's when we start to worry about a chance for some rain showers interrupting your plans. wake-up weather first thing this morning, temperatures upper 60s to low and mid 70s. there are areas of fog once again like we had the last couple of mornings. this area of showers across parts of eastern ohio is drifting down into west virginia and southwestern pennsylvania. our rain chances will be increasing, but as you can see on storm team 4 radar, nothing out there right now. hour by hour with the skycast 4, the clouds will come back in this afternoon, along with a chance for rain showers. 70s this morning. mid 80s by noontime. flirting with 90 degrees later on this afternoon. nothing wrong with a little harmless flirting, isn't that right, melissa? >> absolutely. taking a look right now at our first problem here this morning. we're talking about that issue on metro right now. otherwise, volume looking pretty good at this point. orange, silver line no service from clarendon over to mcpherson square. because of the late clearing with summer. since we're talking about flirting this morning. so when is the best time to head out to beat the big rush? news4's megan mcgrath on the bay bridge, looking at things. megan, how is it looking? >> reporter: it looks terrific if you're an early bird, if you can get out of to house soon, now is a terrific time to leave. we are not seeing any delays at the bay bridge. many people consider labor day to be summer's last hurrah. that means they will be headed off to the beach, to the maryland and the delaware beaches which means they're going to be crossing the bay bridge. which you see live behind me. traffic right now, running at speed. i came across about an hour ago had no problems at all. i had an e-zpass, there was no line. i cruised on through. that'll be the case for a while this morning, but of course the traffic is going to continue to build as we wear into the afternoon. an estimated 354,000 vehicles are expected to go over this bridge. over the long holiday weekend. if you can leave before 10:00 a.m., that's your best bet. if you can't leave by then, and you don't want to sit in traffic the advice here is to leave after 10:00 tonight. really around 11:00 in the afternoon, that's when we start to see the traffic building. especially at the receive ran river, an area where we go from four lanes down the three. that is really in recent years become a big bottleneck, almost as bad as the bay bridge and that builds very, very early. keep that in mind as you're planning your trip this morning. also something to keep in mind, that gas prices are cheap. you will get a break on that this year. also the toll here at the bay bridge has gone down. a couple of months ago from $6 to $4 so that'll save you a buck as well. but expect a lot of people out there on the road with you. keep in mind that you have to use your head lights at all times on the bridge even in the daylight. and just take it easy out there. leave plenty of room between yourself and the vehicle in front of you. police have extra patrols out there and tow trucks at the ready should anyone break down. they'll move them out of the way as quickly as possible to keep things going. independent. republicans were concerned that trump would run against them and split the vote. but now it looks like that is not going to happen. and so jeb bush says trump is too pessimistic and republicans will lose if trump is the nominee. bush is now third in the national poll behind trump and former neurosurgeon ben carson. and my family understood take what is -- undertake what is an arduous commitment that would be proud to take under ordinary circumstances. but the honest to god answer is i don't know. >> some pretty candid commends from vice president joe biden about whether or not he thinks his family has the stamina for another presidential run. the biden family is still grieving the loss of his son beau who died of cancer. biden was asked about his interest when he spoke at an atlanta synagogue yesterday. there are reports that biden has met with potential donors and advisers in recent weeks. alexandria mayor bill euille announced on sunday whether he'll launch a write in campaign to keep his job. he was defeated by alison silver burg. arlington police are examining new evidence in a murder case. bonnie black was killed in april. yesterday, officers searched the home of her estranged husband david black. they seized two bicycle, documents and other items. neighbors who knew bonnie black say they're happy to see movement in the case. >> i'm glad that it's not that they -- that obviously the police still have leads. >> we have all been waiting impatiently to see results. >> this isn't the first time police have searched david black's home. police describe him as a person of interest in the murder, but he has not been charged with any crime. black says he's innocent. a group of northern virginia lawmakers pushing to expand background checks for gun buyers. this comes more than a week after two journalists were shot and killed on live television. a group of democrats has a petition with 2,800 signatures asking for stricter laws. the local chamber of commerce in roanoke raising money for a tribute to the woman who survived the on air ambush. they want to build a new community center in honor of vicki gardner. she is doing better as she recovering from being shot in the back. gardner has had this vision for a long time and they're hoping to make sure it happens. breaking news out of bangkok. turns out a man in custody there is unlikely the shrine bomber. police just announced the actual bomber is still on the run. dna ruled out the man thai police arrested near cambodia, thought to be the yellow shirted bomber, but they say he definitely played a role and he faces explosives charges. that's the latest, aaron? >> thank you. your complaints have prompted d.c. water to significantly reduce a new fee that could have more than doubled some water bills. now, we broke this story earlier this week, that d.c. water would charge 2,000 people between $40 and $80 extra a month. the board of directors voted to cap that rate at under $10. >> the consequence did not seem fair relative to the water use statistics that we were able to delineate. that only came out because our customers came forward. >> the higher fee primarily targeted newer homes where the size of the water lines is bigger to support required sprinkler systems. the new fee will start showing up on bills in november. hours after a decision on deflategate, outside, we have fog first thing this morning. we'll be left with a mix of clouds and sunshine through the late morning into the afternoon. but then clouds thicken and rain chances going up. highs mid to upper 80s. some spots might touch 90 but ever so briefly. >> thank you, chuck. 5:47. the officials will visit the intersection at m street and wisconsin avenue. ward 3 council member mary cheh and ddot will visit the site at 9:00 a.m., but many of you say they need to see the traffic earlier at the height of rush hour. news4's derrick ward has more. good morning. >> reporter: good morning. well, it's relatively calm and orderly here at this intersection, but as the day progresses things will progress as well. so will the pedestrians, the cars, and the bicyclists and so will your chances of getting into some kind of accident. you know, back in 2010, this was deemed the second most dangerous intersection in washington. second only to 14th and "u." a break in the traffic, and the tesfai mesghi temptation is to dash across. but the sign says there is turning traffic. what they have done is blocked so pedestrians can cross diagonally. now, the city has invested in the program called vision zero. that means by 2024, they aim to have no pedestrian fatalities in the district of columbia. this is an import from sweden. it is data driven and critics have said that there's not enough data to make it effective here in the district. later on, mary cheh and other groups will bring light on that. they say this is a cross roads to pedestrian safety. that will happen at 9:00 and they will see some pretty busy traffic here and probably get some data to help with that vision zero project. that happens at 9:00 this morning. we're live in georgetown. derrick ward, news4. >> 5:49. we warn our kids not to walk along in wooded areas, but for some loudoun county middle schoolers that's how they get to school. it take as mile to walk to the trail side middle school using the trail. now a group of parents are asking for their bus stop back, but the school board denied their appeal. >> i do not walk on the trail by myself. there have been too many incidents that happened and it's a very secluded, wooded area. i felt like if something happened, if somebody screamed nobody would hear. >> loudoun county school board doesn't feel it's unsafe to walk the route. the parents can petition the transportation department in hopes for a change. we hope to learn what went wrong at a texas hospital that treated an ebola patient. an independent review now says the hospital wasn't prepared. duncan's travel to liberia wasn't verbally communicated to the doctors and the guidance was unclear. right now, police are asking for your help finding the man who robbed this pharmacy at gun point. take a look at this video here. he's at the drugstore on stringtown road in clarksburg yesterday morning. the robber forced two women to the ground while he grabbed prescription pain killers. several nearby schools were told to shelter in place for nearly two hours as police searched for the gunman. happening today, a 20-year-old who police say tweeted that he would purge all the white people in la plata, maryland, will face a judge. hollins is accused of making a threat of mass violence. a friend of hollins says that the suspect may have been playing around. >> i have seen the crowd he hangs out with. he has, you know, a lot of white friends. >> now, police say some people didn't go out shopping that night as the threat spread online. the account that posted the message on wednesday looks to have been deleted. breaking news on the roads right now. sorry on the rails i should say right now. blue, orange and silver lines single-tracking between eastern market and between foggy bottom. we have this problem, orange and silver, no service from clarendon to mcpherson square and no service on the blue line from arlington cemetery to mcpherson square. very slow this morning. outer loop between colesville and georgia. brand-new crash sending chopper to that one. not there quite yet. 66 into town, out of town, just fine. 95 northbound, southbound, no issues. and looking at the bay bridge, you are in the clear right now. megan mcgrath out there for us live. we'll hear from her again coming up in the 6:00 hour. but right now you're looking good if you're headed out any time soon. chuck? yes, was should always have a backup plan. clouds increasing this afternoon and chances for rain coming in by mid to late afternoon. temperature right now 70 in gaithersburg. runners forecast still feeling like summer today. temperatures upper per 60s to mid 70s now. near 80 by 9:00. you don't like to be -- at least i don't like to be running that much. highs today 88 frederick, maryland. 88 in hagerstown. near 90 in washington. that's before the rain chances start to move on in. there it is on radar. couple of showers across parts of ohio. back door cold front. so the showers are coming off the bay and towards the i-95 corridor. there's the showers budging up along the chesapeake bay and on to i-95 here. between 1:00 and 5:00. hit and miss showers likely through much of the saturday evening as well. tomorrow looking good. plenty of clouds in the morning chg at great news for terrapins fans. richmond and maryland in the college football forecast. game time temperatures with increasing amounts of temperature in the 70s. mid 80s tomorrow and sunday. back into the 90's next week >> thank you. chuck. congress is launcng investigation into major problems that some army moms are having with day care and they're doing it because of the news4 report. last month we revealed that dozens filed former complaints about the u.s. general services administration. it's the federal agency that helps to pay for child care for military families. so the i-team's scott macfarlane dug a little deeper. >> now, one army mom said it's a nightmare. a program called the army fee assistance program backlogs, unreturned calls and late payments there. it's for army parents who can't find child care on their military post. those parents are instead allowed to find a private day care at full price in the community. >> general services administration which oversees that program then cuts those parents a check to help pay for it. now, we tracked down two of the dozens of parents who complained. carmen dikes and kayla hemsley and the u.s. house oversight committee saw our story and called on the two to testify next week. they called on a high ranking official. >> and a report confirms what the moms toll us. the program is suffering a backlog of 11,000 unreturned calls and it might have grown even longer. the agency has taken steps to fix that backlog. congress will hold a formal hearing next thursday to figure out what's going wrong. it's a rocky few weeks on wall street for a whole heck of a lot of reasons, but will today be any different? cnbc's landon dowdy has that. i hope things are looking up. >> hey, eun, well, we'll see. investors are taking a cautious approach ahead of the jobs report. futures are lower this morning and while asian and european markets are in the red. stocks ended mixed on thursday. analysts expect 220,000 jobs were added to the economy last month. although, august tends to be quirry. the jobs numbers can be inaccurate as many people are on vacation. the unemployment rate is expected to jump to 5.2%. a new report shows 44 million people tried out apple's new streaming music service in the first month in july. that makes it one of the top 15 u.s. smartphone apps just behind twitter and ahead of snapchat. the question remains though how many people will stick around when apple music -- once the three month free trial ends this month?
