in all. including an suv that ended up on its roof. there was a mini van with several people involved, five kids and two adults. now, all the kids were taken to the hospital but they all survived. all had non-life-threatening injuries, all the people involved were wearing seat bes or all the children were in their safety seats and miraculously everybody survived. >> my family was okay, my little nephew, i put him on my back, just running through the whole street because it was all blocked off. there was a refuse lea to see s was okay. >> the first reaction was to slam on the brakes, the air bags were deployed. i turned around and saw that they were okay. >> now, that woman was driving and the man that you saw there, that was her brother. you can imagine the fear he was feeling. he had to come all the way from wheaton, walking up on the scene. you can imagine how happy he was had he saw everybody in his family was okay. some were taken to the hospital. two children taken to the hospital were medevaced. but again, they have non-life-threatening injuries, we can thank all of them for the restraint systems that were involved and the fact everybody involved were using the restraint systems. an investigation is under way to figure out what caused the second space disaster in a week. virgin galactic space tourism vehicle, spaceship ii, exploded over the mohave desert this afternoon. one pilot is dead, another seriously ended. the richard branson funded ship was designed to take tourists up in the atmosphere, and was designed for paying customers next year. that comes after the unmanned rocket exploded just after liftoff on wallops island. it was on a mission to re-supply the international space station. we still don't know the cause of the crash. and an attack on a d.c. officer, pat collins learned how the suspect carrying an axe just learned how some suspects worried. >> rep it had some in brooklyn talking, some looking over their shoulder. a man with an axe aftmbushes a police officer with an axe like this. now, you don't have to ask people what they think. just show them the picture. it is a picture not easily forgotten, a large axe impaled reporter: this happened around 3:00 this afternoon as a police officer went to check out a suspicious man in an alley here. he thought the guy had a baseball bat. it turned out to be an axe. >> from new york, that is what it looked like to me. >> reporter: the officer ambushed. his car window smashed. police say the officer tried to arrest the suspect, that there was a fight and the suspect ran away. >> it is a part of the world we live in now. >> i do not feel safe. probably should not be walking around here by myself. >> reporter: now, this vicious attack comes on halloween. chief lanier has this to say about that. >> on halloween night you have to be a little extra cautious because think of the costumes people will be wearing. especially the young adults and adults out in costumes. so yes, we're going to have to be extra cautious tonight. i don't think there is a threat at this point to members of the community. it appears that this person specifically targeted the police officer. >> i'm still going out. we're taking our daughter here. it could happen at any time. we're all aware of that. >> reporter: now, you are likely to see increased police patrols here in brooklyn tonight. live in northeast, pat collins, news 4. thanks, pat, that attack now has police here in d.c. working with police up in new york city. they experienced a hatchet attack there last week. we're trying to figure out if these types of attacks have a common motive. >> are there any similarities, do they have the idea of motive as the investigation continues, we'll continue to coordinate with them with them if necessary. and stay on the same page. >> the nypd says so far they have not linked their suspect to any terrorist organizations. now to a big clue about the mindset of the man linked to three attacks on young women in virginia, a lawyer for jesse matthew set the stage in court today for a potential insanity defense. matthew will come to fairfax county in a couple of weeks to face charges of attempted murder and rape. we'll hear why matthews two lawyers had a public disagreement and why prosecutors may need to fly in a woman from out of the country, coming up in the next half hour. there is a major development in the ebola quarantine controversy up in maine. today, a judge rejected the state's bid to force kaci hickox to stay home. she is the nurse who returned recently from west africa. the judge agreed that because kaci hickox does not have any symptoms of infection she is not a danger to the public. in the meantime, the united nations now reports there have been more than 13,000 cases of ebola in eight cou. and there have been nearly 5,000 people who have died from that disease. some local nurses are planning to walk off the job in protest, saying their hospital has not prepared them enough to respond to the ebola crisis. we'll have more on the timing of the strike and why the nurses are so worried, coming up in 15 minutes. we're j four days away from polls opening up in the mid-term elections, the "meet the press" moderator chuck todd is on the road. >> chuck, we just learned the cook report is calling the maryland governor's race too close to call. >> it is actually part of a trend that i saw on this road trip, 3,000 miles, by the way -- no sleep, no sleep until election day. there is an anti-incumbent atmosphere here when you look at what hogan has been doing, larry hogan is trying to make anthony brown the incumbent by running against the o'malley/brown, it doesn't matter if it is a democratic or republican incumbent, there is anti-incumbent out there. we have seen there are more races within five points right now in the polls in senate and gubernatorial battles than i have seen in my lifetime. it is unbelievable, really because you have a group of voters fed up with leadership. >> it sounds like it will be key to get the voters out -- >> this this case, you have -- the campaigns are treating it as a base election. but there is a voter, i found them everywhere, with arkansas voters, charlotte mothers, georgia businessmen who said they're fed up with the polarization, they don't think either party really provides much leadership. and they haven't figured out which nostril to hold. the left or right. and i think that in the end will sway things. it feels like there is a tilt toward the republicans that everything is sort of breezing their direction. but not an avalanche yet. >> do you get the sense all of those states that you have been visiting, do you get the sense at all this talk and fear about ebola and the white house reaction to it, is playing a factor at all? >> can i tell you, not to burst the bubble here between my friends in washington and new york, ebola has not been an issue at all. isis is an issue, the issue of terrorism, sort of heard a lack of leadership from washington. the ebola thing really doesn't feel real to them. it is -- >> but you get a case -- >> in your state, so. in georgia there is a little more acute because hartsfield-jackson intt in atla not coming up. we're going to have a bunch of new polls. we know people don't get enough numbers, right? i did interviews with eight different candidates so i'm going to have excerpts of these, mid-term means, 96 hours from mid-terms which means we're five days away from the presidential race. and it does and leaflets containing isis propaganda found in quantico, virginia, the fliers include an isis flag and arabic writings that say, we are here from mexico and came by train. authorities are looking into this matter. there are indications the material may not be authentic. for example, the isis flag is printed upsidedown and back wards. and a warning for kids as they head out to trick-or-treat. boxes of candy have turned up laced with marijuana. police seized the candy earlier this week before it got to its destination in laurel. it was shipped from colorado where marijuana was legal. investigators don't believe that candy was meant for children. but they put it on display today so parent s can make sure it doesn't end up in their child's halloween bag. charges could be filed. 24 hours after police captured a suspected cop killer in pennsylvania they're still searching the area where he was found. plus details on eric frein's first court appearance. justice for a mother who in an abandoned air field last night. residents on edge for weeks jeered at m as he left court today. jay gray has more outside the courthouse. >> rep hey, there, good to talk to you, for almost seven weeks throughout the intense manhunt, officers carried the cuffs of their slain colleague, corporal dixon, after the search they finally got to use them yesterday. after 48 days on edge, there is now a sense of gratitude and relief in northeastern pennsylvania. that spilled out as heavily armed state police escorted accused cop killer eric frein into the courthouse this week where he was formally charged in the attack that killed brian dixon and seriously injured his co-worker. prosecutors say they will seek the death penalty. officers continue to search an abandoned air strip and hangar where frein surrendered to u.s. marshals yesterday. >> there was no struggle with law enforcement, he has talked to us about things that occurred to him as he made his way through the woods. >> reporter: like the scratches on his face and head police say were gathered during his time on the run, officers gather evidence through the woods as they try to put together how the sharpshooter evaded the teams for nearly seven weeks. >> we gained some insight without going into a lot of specific detail i would characterize it, much as i said all along that he was able to get into cabins and other unoccupied structures. >> reporte but in the end, with more than a thousand officers joining in the manhunt, the pressure and conditions in the woods apparently took their toll. >> he knew the end was coming, a matter of time before he was captured. >> repor an accused assasin with nowhere to hide, facing the community he terrorized for nearly two months. and trick-or-treat in this community had been cancelled tonight. parents didn't want their kids out with frein still on the loose, but now that he is behind bars they will enjoy the holiday tradition. i'm jay gray, news 4. >> thank you, jay, like we did around here when the sniper was caught. right before halloween as i recall and people here got to be trick-or-treating, as a result. so -- sounds pretty good for the trick-or-treaters tonight. not bad, this time of year we expect things to be a little bit cooler. probably a little cooler than we expect this time of year. still nice, one thing we're not expecting, rain. winds out of the northeast at night, you will need a jacket as you head out in the region. 56 in the d.c. metro area, 48 in gaithersburg, again, we'll see cold numbers, not quite as cold as it was last night. last night even a frost advisory, no rain in the region, as you get back to northwest virginia, the shower activity is coming through ahead of the storm system. you s the showers down here tow the roanoke area. the deep trough going through the north, through canada to the north. there are freeze warnings almost down to the gulf coast. that is how coldr mass is, a very early cold shot. we'll see the colder air coming in tomorrow. saturday, 8:00 a.m. rain showers making their way through the atlantic, across the area, around the noon hour. if you have plans around noon you want to take the umbrella with you just in case. we'll see shower activity, not going to see a lot of rain, maybe a tenth of an in, maybe 2/10, take the umbrella anyway, one thing we'll see for sure, windy conditions develop during the afternoon, winds gusting 20 to 25 on saturday. sunday morning we can see winds gusting to 30, maybe even 40 miles an hour through the 11 or 12:00 hour, so sunday morning, very cold. wind chill could be in the 20s for most of us. high temperatures tomorrow in the 40s, 48 in gaithersburg, 47 martinsburg, 52 in fredericksburg, and scattered showers, a little more than isolated. we'll call them scattered. the impact forecast for saturday, not on the low side, i think for sure on the moderate side if not the higher side of this because of the wind and cold and because of the shower activity we have. and the fact this is a saturday. the weekend, i know a lot of us want to get out and enjoy activities. this weekend it will be a cold one, 49 degrees on sunday, sunday, a very cold start to the day. and with that, we're talking about temperatures that will start off in the 40 degree range, look at monday, low temperature of 34. in the city, putting most of us in the 20s, monday morning, the first time we see a freeze across the region, we could see freeze and frost advisories or warnings come up into monday, we get up to 66. by the way, tuesday of course. the day we get out to vote, looking good for that day. just fine if you go through the polling place. next chance of rain on thursdays as another system drops in, bringing colder air, guess what, as we head into next weekend, especially on friday. get ready for the cold air coming up this weekend. and enjoy the weekend if you can. >> okay, y too, doug, new at 6:00. we're learning more about a planned strike for nurses at a d.c. hospital. their concerns about ebola and what money has to do with it all. and we'll tell but a new tool designed to help the d.c. police track cri concerns about ebola in our country are hitting home with local nurses, hundreds planning to strike because they say their hospital has not prepared them to handle fully the possible patients. news 4's kristen wright has more on what they need to face the ebola threat. >> we don't feel adequately d epared. nurse will go on strike with the providence hospitals 400 other are negotiating a contract, and proper ebola preparedness is at the top of the list. >> we want adequate gear. that is impermeable, and covers appropriately the skin area. >> reporter: he is the chief negotiator at the providence hospital. >> if the nurse is taking care of a patient and they're exposed and they have to be quarantined are they paid for that time? not paid for that time? so our proposal says if they're exposed at the hospital they should be paid for the time they're out. >> reporter: provie released a statement that did not address ebola preparedness, but did say in part we are hopeful we can achieve a contract in the best interest of our patients, and mission. and that it ensures the future viability of our hospital. she says during an ebola training demonstration at the hospital last week nurses were shown protective gear that left the neck exposed. today, a providence spokesperson said the hospital has since received hooded equipment. the d.c. department of health did evaluations on ebola preparedness at hosps across the district including providence. the hospital says they found that providence has a good program in place for both patients and nurses. they add it is an ongoing process. the union and providence head back to the bargaining table november 7th, five days before they could strike. in the district, kristen wright, news 4. two high school athletes got into a struggle at a high school in stafford county. and now, the entire school is going to pay the price. the high school will not play its football game tonight. last week a football player choked one of his teammates, it happened in the locker room. the guy being choked passed out, hit his head, suffered a concussion. school officials cancelled the game tonight. and the students involved were disciplined. coming up next, from movie maker to neighborhood hero, first on four, how a maryland man stepped up to help his neighborhood after burglars broke into her house. >> i feel like i could just break down. new at 6:00. a grieving mother gets justice for her teenage son's tonight, she opened up to news 4 as the man who killed her son while walking to school receives his sentence. sentence. > and new, doug has the up to after filling out their hogan iquestionaire, aight. hogan was awarded an a- from the nra. but now he refuses to release his responses. the nra opposes comprehensive background checks. they want to weaken maryland's gun safety laws. even support letting suspects on the fbi terror watch list buy guns. on gun safety and terror, the nra is wrong. hogan gets an a- from the nra. on protecting maryland, we at 6:00 tonight, a measure of justice for a who says she is still grieving two years after her son was shot and killed on his way to school. >> travon bennett was convicted of the crime but says he didn't do it. >> was it hard being in there today? >> yes, i feel like i could break down. >> reporter: elizabeth ross has waited for two years for justice, and today she got it. >> justice was def ed. i believe that from the bottom of my heart. >> reporter: her son's killer, tvavon bennett, accused of killi marckel ross. >> as a father i send my kids to school every day. i expect them to come home every day. it is unfortunate for ms. ross on september 11 she lost her son. >> reporter: bennett said to the family, i pray for your peace every day more than i pray for myself. >> and he did get up and say he prayed for my family. and his family was speaking very highly of him. but i really wish his family was there that day when he decided to pull the trigger and kill my son. >> i wanted to tell travon he doesn't know what it feels like to have rip by your brother. >> reporter: bennett is facing another trial for a separate shooting and robbery. >> now that it is over it leaves me with a sense of peace. it doesn't bring marckel back. >> reporter: the judge could have sentenced him to life without the possibility of parole. he did not do that. but prosecutors say given the sentence, it is hardly likely he will see the outside again. >> and people across the district are asking for more cameras in their neighborhoods. they will get them thanks to a new program launched. called capital shield, a video-sharing element. the program allows businesses to link their security cameras with the d.c. police department's existing network. the chief says this will give them an extra set of eyes on the street. >> the ability for us to be able to have situational witnesses or extra sets of eyes in thousands of places we may need to access right away. >> capital systems is ad 300w c existing network and will donate a thousand cameras to the businesses existing in the capital shield program. somebody stole a woman's priceless heirlooms from her house. but the neighbors have a surveillance video next to the house. shomari stone has video that could help solve the case. >> reporter: larry steinburger hates crime, so much so he helped the police install videos that would help. his video is being helped in the investigation montgomery can police say you're watching a burglary in germantown. seconds late here, a dark colored suv pulls up nearby, two men get out of the car and walk to a town house, moments later, one of the suspects walks away with what appears to be a bag, the other man right behind him. you might ask yourself, what did they allegedly steal? >> my great-grandmother's jewelry. >> rep kye is angry the thieves broke into her house, she talked to me only on 4. >> it is definitely uncomfortable, not knowing who came into my house and why. >> little do the suspects know the next door neighbor's surveillance video captured them coming and going. and if they looked at the door they would see the sticker, and the noise detection as they walked by. police hope this video helps them catch the suspect. >> just not right, if you look at the video you see it is their first rodeo. >> reporter: in germantown, shomari stone, news 4. the republican challenger for a virginia senate race is narrowing the gap. but the democratic incumbent still lose in that race. coming from a report from newport university. finding that 51% of the voters plan to vote for warner. ed gillespie pulling in 41%, 3% say they're undecided. for 33 years, people who live in northern virginia's tenth congressional district been represented by the same man, frank wolf, so now he is retiring, they will decide between the democrat and three other candidates. northern virginia chief sat down with the leading candidates. republican barbara comstock is a delegate to the assembly. t they each give the same reason for wanting to serve in congress, thinking they can break up the grid lock. >> terry mcauliffe just signed the research and development contract praising it as a job creating good bill. >> reporter: he says his experience in tackling the fairfax county budget each year proves he can work across the aisle. >> more often than not we come up with a bipartisan resolution with the budget issues. >> reporter: one sharp contrast between the two, their view on the affordable care act. foust defends it, but says it can be improved. >> obviously you have to make sure it is not hurting us in terms of job creation and growth. but we can't let the republicans hand it back over to the insurance companies. >> reporte comstock wants obama care gone. >> i think we need to repeal and replace it. i emphasize replace. >> reporter: the candidates make a very different pitch about which one is fit for a district that stretches from the heavy mclean area kansas yesterday. thick, black smoke filled the air after the plane hit the building at the wichita airport. the recovery efforts are being hurt because the structure is unsafe. pilots were inside practicing flight simulations when the plane crashed through the roof. four people were killee hurt. the national transportation safety board said one of the plane's engines failed just after takeoff. and in the area of delray, the area could be named after one of the community's biggest advocates. the city is taking votes on naming a park nancy gardner. it could be near the business district that dunning helped to build. she was murdered back in 2003. charles severance was charged her death. jesse matthew making his first court appearance in fairfax today. the woman he is accused of raping no longer is in the country. we'll report what that means for the at. a revelation tonight in a local rape case against a man named jesse matthew, and that is that the victim no longer lives in this country. matthew is the man also charged in the disappearance of the university of virginia student hannah graham. today he appeared in the fairfax courtroom by video to be arraigned on charges in the 2005 case of rape and attempted murder. our mark seagraves has more on the story. >> reporter: fairfax prosecutors say jesse matthew abducted the 26-year-old victim as she walked down rock garden drive in fairfax, dragged her into the nearby woods and then raped her. today, the man prosecuting to case says the victim is ready to return to the united states and testify. >> yes, she is coming. and she is relieved, i think. i don't want to say happy because there is no joy in any of this for any of us. >> reporter: matthew appeared in today's hearing by video in a jail in albemarle county where he is being held on charges related to hannah graham's disappearance. indicated the fairfax case could be tried before the hannah grah case. >> my intent is to have this trial relatively soon, we're not going to be slow about this. we'll get to trial relatively soon. >> reporte the just postponed the trial for a later court date. as for the trial, jesse could claim an insanity defense, prosecutors say they're ready for anything. >> that is what i get paid to do is deal with things like that. whatever they feel is necessary they will do. same holds for me. >> reporter: in fairfax,
