main breaks in that exact location. however they have not been on these same water mains. so we'll have to figure out which water main is broken. that could take some time to figure out which ones is shut down. i know we're in the process of valve operations working to reduce the water flow and that's the primary goal right now make sure that we get this water main turned off. >> let's go back now live to the scene. luckily no injuries have been reported. the fire department is trying to get a handle on this, get the water department to turn that main off completely. we think it is still -- clearly it is subsiding. the parking lot isn't nearly as deep as it was and there is no longer gushing water coming out of the ground so the situation is clearly improving and we are happy to say there we do not have any reports of any injuries and we will continue to bring you the details of this story and any developments as they occur tonight here on "action news" at 6:00 and clearly on 6abc.com. a difficult situation tonight in east falls in philadelphia. as you just heard, this is the third major water break at this location in as many years. this is video from the same parking lot in june of last year. very much a similar situation to today. firefighters helped to bring people to high are ground. -- higher ground. it took days for businesses to clean everything up. the parking lot flooded in january of 2014 as well. the water department says there's several mains in this area. it's not certain if this is there same one that broke before. there has been a major development tonight in the septa strike. with thousands of commuters again relying on the commuter rail lines tonight, septa and the union are in court as septa tries to get a judge to halt this strike. john rawlins is lie at city hall. john what's the latest on this? >> reporter: well, jim, the hearing started shortly before 5 o'clock. it is still going on. septa asking a judge to order the workers back to work requesting an emergency injunction in an effort -- it is an effort i should say that is not just focused on election day and possible difficulties voters might have in getting to the poll. septa says there are other harms as well. >> septa is asking the court for an injunction ordering twu local 234 employees to return to work immediately. to alleviate the devastation caused by the strike. >> reporter: septa's argument the strike has created a clear and present danger to the health safety and welfare of riders and citizens. the authority has never used such an argument before but is citing a pittsburgh case as presidents. septa says there's five groups particularly harmed school districts, school kids, 52,000 of them use septa as a school bus service and now they must cross busy intersections, the poor those who cannot afford a car or taxi to get around, the disabled who cannot get to work voters who septa says are in jepp he dee of losing their right to vote on election day and finally, medical patients septa says some are at serious risk due to the strike. again septa is asking for an injunction to order the strikers back to work as soon as possible. the union has responded saying it will fight the effort "tooth and nail" saying that collective bargaining is the answer, that only a handful of issues separate the two sides at this point. right now a judge is considering the request by septa listening to their witnesses and also the union responses. this would seem to be one of those cases of stay tuned. live in city hall, john rawlins channel6 "action news." >> thank you john. is where police found the body of 23-year-old justin dubois yesterday buried in a backyard. it happened on the unit block of spencer court in lumberton and two brothers ages 24 and 27 are under arrest tonight for murder. new jersey correspondent nora muchanic is live at superior court in mount holly. nora, you got the full story. >> reporter: jim, the costello brothers of lumberton are behind bars tonight held on first degree murder charges. they made a first appearance in court via video this afternoon where their substantial bail was continued in this bizarre murder case. 27-year-old christopher costello of lumberton and his younger brother 24-year-old brian appeared via video in superior court today. the costellos are facing first degree murder charges accused of killing a man who lived with them at their spencer court home and burying his body in the backyard. >> i -- shocked. i don't know what to say. never think they would do something like that. speechless. >> reporter: prosecutors say the victim is 23-year-old justin dubois. he was reported missing by a family member october 31st. >> i'm a little scared. i have a seven-year-old. you know, i try to keep him -- try to keep him, you know, safe and stuff like this, it's really hits home. >> reporter: piles of dirt could be seen in the costellos backyard. this is where investigators armed with a search warrant yesterday located dubois' body after noticing some dirt that had been recently disturbed. neighbors say they'd been complaining to police for years about drug activity in the house but they say they never imagined anything going on here could lead to murder. >> all of the neighbors knew about it. you live here you see cars in and out. the different activity out on the street here and this i guess is the ends result. >> i he noticed that there were more kind of people that i didn't recognize walking around the neighborhood. >> no, no, not going to expect to find a body. bail for the brothers has been continued at half a million dollars cash each. now an autopsy was to be conducted today on the victim but the prosecutor's office has not yet released how he was killed or a moat. >> counts. bridget kelly christie's former deputy chief of staff governor christie and bill baroni a christie appointee to the port authority of new york and new jersey were convicted of creating traffic jams on the bridge. prosecutors say the scheme was political revenge to get back at fort lee's mayor for not endorsing governor christie for reelection. the most serious charges against baroni and "action news" reporter dann cuellar has arrived on the scene of that huge water main break in the east falls section of philadelphia. dann what are you seeing, what can you tell us. >> reporter: jim there's good news to report tonight and they've made significant progress now. they've shut off the water supply to the broken 48-inch main. the other good news is that the shopping center here sits on a slope so it goes down the water all flowed down below to -- there's a ravine below the shopping center and so now you barely see any water in the shopping center. the bad news is that the damage has already been done. there is water inside these stores. the fine wine and good spirits store, the got the look store, the ross dress for less. there's water inside those stores. they're heavily damaged by this. the good news is nobody was injured in this thing. the fire department did a fabulous job in rescuing people. they had to use rafts to get them out of there. this is the -- what i'm being told the third water main break here in the last three years, they have several 48-inch mains here, four of them. they're not sure if this is the same water main that broke or another one. needless -- suffice to say that some business owners here are getting tired of all of these breaks here affecting this shopping center but again the good news now is they've shut off that water supply, people have gotten out safely and everybody's fine. now they're working on the problem and trying to get it fixd. jim, back to you. >> dann cuellar thank you. a man who claims that he was victim number two who was seen being abused by jerry sandusky in a locker room shower testified for the first time today. sandusky is trying to get his conviction overturned. action news reporter chad pradelli has the story from belfont, pennsylvania. >> reporter: appellate attorneys for jerry sandusky called victim number two to the stand this afternoon. during a contentious exchange the man testified he was the boy whom former penn state coach mike mcquery claims he saw being sexually abused in a football facility in 2001. victim number two testified initially he told prosecutors and then defense attorney joe amendola that he had never been abused by the iconic coach. during the criminal trial victim number two was a defense witness that's until he changed his story and said he too was a victim. he eventually received a settlement from penn state. and appellate attorneys believe prosecutors hid information that didn't help their case. prosecutors have said they didn't believe the man was credible and definitively victim number two so he was never called to testify during the criminal trial. >> it's important that we get out what he has said mainly that he was not abused and that mr. mcqueary's statements were incorrect. >> reporter: jennifer storm is a victim advocate who spoke on behalf of victim number two who doesn't want to be identified. >> it's incredibly common for victims of sexual violence to not be forthcoming initially. there was so much pressure on this young monday. >> reporter: over the course of the appeal hearing sandusky's attorneys argued he didn't get an adequate defense because his attorneys didn't have enough time to prepare then believe grand jury leaks hindered their defense. judge john cle lands told both sides to provide briefs outlining their argument in the appeals hearing by next friday. then he'll decide whether there will be oral arguments before he makes a ruling inform belfont chad pradelli channel6 to new york from harrisburg. this, be this is the harrisburg keystone service. this track is also shared by septa and the accident has interrupted service from trenton to philadelphia on septa's trenton line. so, it was tragedy on the tracks and a disruption of service at the same time. pass injury on the striking amtrak train are being put onto another train and that's what's happening here.
