A triple a travel estimates that nearly 47 Million People across the country will be traveling 50 miles or more this weekend. And 42 million will be on the roads. Thats 300,000 more travelers than the u. S. Had last year. Here at the hooksett tolls rest stop on 93 north, many people are headed to the white mountains, North Country and vermont to spend thanksgiving with family. We just spoke to bill boynton of New Hampshire d. O. T. And he says one of the reasons he thinks a lot more people are on the roads this year is because gas prices are so low. Tom now onto the other news of this day, lawyers for the graduate of an elite prep school convicted of sexually assaulting a 15yearold class mate are appealing that verdict. Wmurs Shelley Walcott joins us live with details. Shelley todays filing comes one day after labries name was added to the sex offender rent industry in his home state of vermont. Part of his appeal includes having his name we moved from that list. Today owen labrie told the states highest court that he will appeal his conviction on charges including the Sexual Assault of a 15yearold classmate. Labrie was 18 years old at the time of the 2014 en count we are the girl at st. Pauls school in concord. He was also convicted of a felony count of using a computer to lure the girl, which means hell have to register for life as a sex offender. In the notice of appeal filed wednesday, labries lawyers say the trial judge should not have allowed the felony count, insisting the computer charge was meant to apply to adults preying on children. Labries attorneys also cited issues with thed apissibility of evidence and the crossexamination of a key prosecution witness. The appeal also raised a question about the prosecutions closing arguments. Todays appeal comes one day after labrie registered as a sex offender in his home state of vermont. Labrie was sentenced to one year in jail. He will remain free pending the outcome of his appeal. Shelley walcott, wmur news 9. Tom a nursing assistant is permanently lost his license to practice in New Hampshire after he allegedly sexually assaulted an 80yearold woman in his care. Wmurs Heather Hamel live now with what investigators say a witness told them about the incident. Reporter according to an assistant attorney general, another employee walked into the patients room and found Timothy Morrissey allegedly assaulting when she asked what he was doing he made some unusual statements. The assault allegedly took place at the bel air nursing and rehab center in goffstown. The a. G. s office says the elderly victim has alzheimers and dementia. According to testimony from a nursing board hearing, another assistant found morrissey doing something inappropriate with the woman and told him to stop and when questioned morrissey said you know what you saw and this is the most embarrassing thing in my life. Initially the board temporarily suspended his license but nows that decided to permanently revoke it. They typically, if they were going to revoke someones license, the opportunity, the door remains open at some point in the future for someone to get their license back. Heather hamel, wmur news 9. And a drivers ed instructor were threatened by a man with a gun as one of the students was learning how to Parallel Park. Wmurs andy Herb Hershberger explains. Reporter joseph duven of manchester faces self charges after allegedly threatening four people taking part in a drivers ed class tuesday evening. Authorities say one of three teenage students in the car was trying to Parallel Park on Chestnut Street when a man approached the vehicle and allegedly threatened to shoot them if they hit his car. There was some words exchanged and alleged threat made and when they turned around and saw the male that had allegedly threatened them, they saw the hand gun strapped to his hip, so the instructor did the right thing, immediately told them to leave. Reporter police say they spoke with several people in the area and were able to identify duven as a possible suspect and then located him at a restaurant on south willow street, finding the gun outside the building. Duven faces four counts of criminal threatening and one count of falsifying physical evidence. Police say the instructor did a good job protecting the teenagers. I think based on what i read in the reports that she absolutely did the proper thing, immediately fled the area. Theres no reason to engage in a physical. Reporter tom, police say the suspect walks right into the cart with the product and walked right out without any trouble. Police say he allegedly stole 100s can of enfamil worth around 1600. The same man stole from another Walmart Store the tilton where he made off with 2500 worth of formula during two separate trips. Surveillance photos are being used to help identify the suspect, the pictures are very clear. Police say the formula could be sold on the black market or as a drug cutting at. If the suspect is caught he will face felony charges. We look at these as organized retail crime cases, anything that gets into the thousands of dollars, theyre basically going store to store and in some cases state to state. We freeze the video here, but prosecutors say even after mcdonald collapsed, van dyke kept shooting, 16 bullets in 15 seconds. It is unfathomable and unacceptable that it would take a year, when all of the facts in this case were known the night that it happened. Reporter the shooting occurred more than a year ago. It began with Police Responding to a report of a suspect with a knife breaking into cars. After van dyke began shooting, the video shows another officer kicking a knife away from mcdonalds body. But investigators say mcdonald never threatened the officers. At the end of the day, id rather take my time and get it right than rush to judgment and get it wrong. Reporter calling the investigation complex, on tuesday prosecutors announced murder charges against van dyke, the same day a court order led to the release of the video.
