martinez morales told police he was just driving around the speed limit when he simply lost control of the car. his bail was set at $5000. reporting live, andy hershberger, wmur news 9. jennifer: the union cemetery in laconia was hit hard by your recent rainstorm. -- by a recent rainstorm. water taking a bite out of a road heading through it, and as wmur' s heather hamel explains, it puts the remains of those laid to rest there at risk. >> the south side of the cemetery really got the brunt of the damage. a culvert collapsed and it opened up this gapping sinkhole. and now, they are scrambling to get it fixed before the next rain storm. >> it certainly was a surprise to us and the extent of the problem also meant it was going to be extremely expensive. heather: john perley says worst case scenario, a repair bill upwards of $100,000. but he says while that is a hard pill to swallow, they are fortunate no graves were affected. water and erosion have come extremely close to the stones. >> the pipe' s been in there 65 years, and with that water coming through, it caused the pipe to burst. and the next thing we knew, probably thursday afternoon, there was a big hole. heather: with so much at risk, perley says fixing it before the next heavy rain is essential. they already have an emergency wetlands permit, and tuesday, an engineer was preparing to take a kayak through the six-foot pipe and get a closer look. the tentative plan was to put a replacement pipe in place as a temporary fix. on the north end, the banks of for years. >> this rain, again, just went to work on the banking and cut into it even further. we are getting dangerously close to graves at that point. so, the state has given us an emergency permit to put rip wrap down and try to get that shored up so it won' t go any further. heather: because as it stands right now, the water is carving a path straight toward a mausoleum. >> it was an unusual storm and an unusual result. heather: the fix they put in place here will buy them some time, maybe a year or two. during that time, they will be able to do more testing to see if other parts of the pipe are compromised. reporting in laconia, heather hamel, wmur news 9. josh: we do have some rain in this week' s forecast, but it' s not enough to cause any floods and it won' t stick around long. let' s have a look at the mostly sunny week ahead from chief meteorologist mike haddad. mike: temperatures jumping up a little above the average. clear sailing across all of the northeast. we have the minor issue along the coast for mariners. some rough surf. with sunshine for part of tomorrow, we will warm up even more than today. it dries out even more to the northern plains. you have to go all the way back into the pacific northwest to find our next system that will affect us. that really does not come in until the end of this week. we will break down the timeline, where temperatures land for thursday and friday and a peek into the holiday weekend in a few minutes. jennifer: the coast guard is warning people in new england to watch out for continuing rip currents generated by hurricane joaquin. even though the storm has passed well out to sea as expected, it has churned up the water to potentially dangerous levels. more evacuations could be ordered in the carolinas as the floodwaters created by record rain move toward the ocean. take a look at this road giving way just moments after a truck drives across. the flooding has already caused s elizabeth hur is in charleston tonight. elizabeth: the potential for rising rivers to crest and flood is the new concern for authorities in south carolina, still not out of danger. >> the next 36 to 48 hours are continue to be careful. elizabeth: from charleston to columbia, the flash flooding -- rainfall toppled several dam, the waters reaching rooftops. >> i went from water four inches below my knees, to having water at waist level. elizabeth: stranding hundreds of drivers and homeowners, some still in shelters. >> i' m worried. elizabeth: nearly 500 buckled state remain closed, but additional help is on the ground to start the rebuilding process following a major disaster declaration from president obama, providing federal money and aid for south carolina residents. >> we have fema people in the air doing assessments, trying to see aerial views. we will have fema people on the ground tomorrow doing assessments. elizabeth: you are now looking floodwaters. just one example of what those damage assessment teams will be finding once on the ground. elizabeth hur, abc news. josh: new hampshire residents still favor getting a casino in the state, that' s according to the latest wmur granite state poll. 51% of people say they support bringing casino gambling to new hampshire, 37% oppose it, 12% are neutral or unsure. support is dropping since october of 2013, when 59% there are also some new numbers when it comes to the race to be new hampshire' s next governor. coming up on news 9 at 6:00, we' ll look at voters' opinions of candidates who have declared or might declare for the corner office. a day after the governor announced she will seek a u.s. senate seat, state senator jeannie forrester is taking aim at her record. at a news conference today, forrester said hassan is claiming credit for expanding medicaid in new hampshire and freezing tuition. while her democratic colleagues disagree, she says it was bipartisan work done in the senate not by the governor. >> if governor hassan goes to washington as a senator, she is not going to have a new hampshire senate to do her work for her. who is going to tell her what to do? >> at some point, you have to stop fighting and come together. jeannie forrester has never done that. that. maggie hassan does. josh: senator forrester confirmed she is also strongly considering a run for governor as well. as for the presidential race, two republicans are campaigning in the granite state tonight. these are live pictures from a house party in bedford for marco rubio. and in just a little while, a house party for george pataki will get underway in rye. jennifer: the military has admitted the bombing of a hospital in afghanistan was a mistake. the journal in charge to questions in capitol hill. sally kidd has that tonight from washington. sally: how and why it happened is the focus of several investigations, but we did learn more today about the involvement of u.s. forces. >> the hospital was mistakenly struck. sally: after contradictions, clarifications. >> our afghan partners called for fire and the u.s. aircraft >> striking a hospital killing at least 22. initially, the military said the attack was order to protect u.s. forces then later said afghan troops work -- requested the airstrike. now the top general says u.s. forces were near the hospital and communicating with the aircraft that launched the attack. >> to be clear, the decision to provide aerial fire was a u.s. decision made within the u.s. chain of command. sally: the white house calls it a tragedy and says the president wants answers. >> he certainly feels a responsibility to get the facts, this full accounting and to make sure whatever changes are necessary are properly implemented. sally: doctors without borders says the airstrike is a war crime. it says the hospital was operating in that location since 2011 and the military knew it was there. laws of war, and international humanitarian law. this attack was a grave violation. sally: the organization says it wants an independent investigation. the administration says three separate probes are underway by the defense department, nato and a u.s.-afghan team. in washington, sally kidd, wmur news 9. jennifer: getting near manchester, things are moving pretty well on 293 both north and southbound at this hour. have a lot of company approaching the tolls but no major slowdowns. towards the bow junction, it is moving well through 89 and 93 north. there are two accidents out that between exits 11 and 12. you also have heavy volume northbound as well. on 101, you are heading towards milton and amherst, you get busy survivors and the start of an investigation. i will tell you what the ntsb is hoping to recover and why it will not be easy. >> there is outrage among many parents and teachers tonight over toy pens looking like hypodermic needles and they are being sold at a local store. what actions many of them are jennifer: attorneys for aaron hernandez have asked a judge to drop charges against the former patriot in connection with a double murder in 2012. josh: prosecutors say hernandez shot two men after an encounter in a boston nightclub. but, defense attorneys say there isn' t enough evidence for probable cause. and they say the search warrant used by police was based on information from a man who failed a lie detector test. no ruling has been made yet. hernandez' s trial is scheduled to start in december. jennifer: a pennsylvania woman locked yourself in the bathroom when a man broke into her house, but because her phone was in another room, she didn' t know how to call for help. then she hit on a low-tech solution -- using lipstick to write the word "help" on the window and waving the bright white toilet paper until she got someone' s attention. >> had the toilet paper like out like this and this is what i was doing. i was going like this like -- help. finally, a neighbor across diagonal saw me with my arms jennifer: turned out that man had fallen asleep on gresock' s couch. police think he was intoxicated and just went into the wrong house by mistake. record rain turned the las vegas strip into a small river. the heavy downpours prompted dangerous runoff and knocked out electricity to hundreds of customers. one woman had to be rescued from the high water, but she is ok. destination but so is new hampshire. josh: it attracts more than 600,000 visitors, just this weekend alone to enjoy the foliage. how are the colors this year? jennifer: josh judge is here with a closer look to check out the best spots. josh: it is looking really good in a lot more spots. every day, we have been noticing big changes. let' s take a look at some specifics. the latest state report just came out. we will take a look at where the as you might expect, it is hampshire. but the northern parts of the state from the white mountains north and west, 75% to 90% peak. getting closer to the lake region, 50% to 75% of color. as you get closer to the seacoast, the numbers decrease but we are hearing about a lot of color in places like the seacoast. back north, routes 3, 16 -- 110 is beautiful, 112. route 10 and 12a along the connecticut river. 103 and 103a, we are hearing great things. as well as route three in holderness. it is looking good. a plethora more locations to check out as well. we are in really good shape and only getting better as the days go along. the warm days and cool nights has been forcing the colors much faster. let' s check out how things are looking for the rest of the week to maybe do some leaf peeping. mike: today, temperatures jumping above the average. here is a live shot of mount mandnock. we will get there within the next seven to 10 days. it is certainly below the norm in terms of the peak color right now due to the fact september was so warm. it put a little bit of a halt and gap between the normal time we see peak foliage and what is happening now. from mount washington, low clouds just below the summit. they will see an under cast in some spots in the presidential range. beautiful up north despite patchy clouds. temperatures little above the average at 64. we had 67 in concord. the normal low is 59. sundown time at 6:19 p.m., getting earlier and earlier. a weak system is on the map moving out of the eastern part of the great lakes. as that arise during the day tomorrow, a few clouds up north and a slight chance of a sprinkle. outside of that, it turns out driver wednesday. pleasant lake -- dry for wednesday. it turns even warmer tomorrow. tonight, we will be chilly. low clouds, patchy fog after midnight. s elsewhere. notice the edge of spring warm has been squashed to the south, but it moves in for tomorrow and temperatures cool down a little as we go into thursday. a bit more by friday and the start of the weekend. one very weak system arrives tomorrow which will dictate a change in the temperatures come thursday but produce very little if any rain. only a chance of sprinkles or late shower will be in the great a little bit breezy and cooler. s s in southern new hampshire. our one shot of rain showers is on friday mainly during the should clear up by early saturday morning. most of this upcoming holiday weekend looks great. chilly to start and a little breezy on saturday. nice and mild to finish overall. hopefully, not too many complaints as long as it holds true. jennifer: you will not get any from us. thank you. up next, a nursing mother says a flight attendant publicly humiliated her in the middle of a flight. how the flight attendant defended her actions. josh: and one new england district has pulled the plug on school dances. we' 5:30. if you work hard, and you do your part, you should be able to get ahead and stay ahead. but the republicans... v they want to go back to letting v the super wealthy call the shots. they don't stand up for equal pay for women. they don't support paid family leave. they don't even really support approve this message. josh: welcome back. an arizona mother says she was publicly humiliated by a flight attendant for using a breast pump in the plane' s bathroom. jennifer: she says she explained the situation before going into the restroom. abc' s brandi hitt has the story. >> i was in there breast feeding. >> you know what, you needed to tell us. brandi: an airplane argument over using a breast pump. >> if i don' t pump regularly, my breast milk supply goes down. brandi: mariana hannaman was on a recent american airlines flight heading home to phoenix to see her four-month-old daughter. >> she' s so proud she' s walking. brandi: when she started feeling the need to pump. so she went to the airplane bathroom and says she warned passengers waiting in line she would be pumping. >> a flight attendant comes and knocks on the door and she' s like -- are you ok? i said, "yes, i breast feed so i' m pumping. brandi: hannaman says the flight attendant then ordered her to open the door while exposed. the other passengers watching. >> i had the pump connected to me. she diminished me. you were so rude. >> go sit down. >> i need your name and information. >> i' m not giving you my name. brandi: it' s not the first time a new mother felt shamed while flying. in 2006, this mom says a delta flight attendant ordered her to cover up while breast-feeding. >> all of a sudden, there' s a ticket agent standing there saying, i' m sorry, but there' s a flight attendant saying you have to be removed from this flight. brandi: american airlines says it has apologized to hannaman. our policy is that women can breastfeed or express milk at any of our facilities, seats, and in lavatories on the plane. american airlines says its flight attendants' number one priority is safety. they will check on anyone in a bathroom for a long period of time and recommend new moms who need to pump just give them a heads up. brandi hitt, abc news, los angeles. jennifer: straight everyone injured in this derailment is out of the hospital. mike: very pleasant today and it looks like the nice stretch continues for a while with one system to watch when showers will move in. announcer: no one covers new hampshire like we do. now, wmur news 9 at 5:30 p.m. josh: the ntsb has officially launched an investigation into the disappearance of this ship last heard from as it sailed into the same area as hurricane joaquin. welcome back. i' m josh mcelveen. jennifer: i' m jennifer vaughn. search and rescue crews are combing more than 160,000 square miles. so far, the only clue to the el faro is one unidentified body. josh: we know that seven of the crew members have ties to new england. katie thompson from our sister station wmtw is in jacksonville, florida where the ntsb is staging its investigation. katie: pieces of el faro. the coast guard tweeting these three pictures showing the last questions shifting to how it happened to wide. officials from the company say that is not their focus yet. >> our number one priority has been -- i' ve said it every time i' ve come out here and i will continue to say it -- has been the hopeful return, safe return of those that were on board. katie: but hope is quickly fading. six new england natives remain among the missing crew members -- four of them graduates of maine maritime and two massachusetts maritime. family members still waiting in jacksonville, doing everything they can to stay strong. >> spending a lot of time together, talking with other families, talking about our children, waiting for updates. making sure that we don' t lose hope. katie: a company president confirming that the captain, longtime mariner mike davidson of windham, tried to plan his route around the storm and was tracking joaquin as it moved closer. >> what he communicated was he knew its position. he was comfortable with its track. he indicated what was his plan, that the crew was prepared or had been briefed. katie: officials also saying they received an e-mail from the captain on september 30, already planning and anticipating the trip back home. jennifer: that was katie thompson reporting. the ship had reported to the coast guard thursday that they had an electrical malfunction after taking on water that caused them to lose power. investigators will be looking closely at that and other maintenance records as the search for crew members continues. tonight, we' re getting a new look at the situation in rockland, maine after the captain of this lobster boat died. a marine patrolman jumped onto that moving boat to bring it under control before anyone else got hurt. emt' s tried to revive the captain, but it was too late. josh: ntsb investigators are in vermont right now investigating the amtrak derailment that injured seven people. the vermonter was headed to washington, d.c. when it hit a rockslide in northfield. the locomotive and one passenger car fell into a ravine. the damaged cars will be moved to roxbury during the investigation. vermont' s governor says fixing the tracks will take a few days. he hopes the route will resume service by the weekend. jennifer: scammers appear to be targeting eversource customers. the company says customers have reported several fraud attempts, including threats to shut off electricity unless they make a payment immediately. eversource says its representatives will never demand instant payments over the phone and they don' t require customers to use pre-paid debit cards. it' s also reminding people not to give our their personal information if they get unsolicited phone calls. heating bills for most americans should drop this winter thanks in part to lower energy prices. today' s forecast from the energy department says people who heat with oil should see the biggest drop -- up to 25%. propane prices should fall about 18%. natural gas prices are expected to drop about 10% and electricity is forecasted to fall 3%. the report didn' t include firewood costs. josh: concord' s shaker road school has released a statement about a former employee who has been charged with sexually assaulting a student several years ago. the head of shaker road school says donald levesque was an assistant teacher, but was ordered off school property in early 2014 and that the school ended all affiliation with him, quote, "due to his personal, written communications with a former student outside of his work hours, not on the srs premises, and with his personal equipment and technology." the school also said, quote, "at no time did shaker road school have any knowledge of any criminal conduct described in the criminal complaints against levesque." jennifer: a maine high school has canceled all of its dances except for the prom, saying modern dances are too suggestive and inappropriate for school gorham high school says the school will offer different kinds of activities to take the place of dances. it says recent years have seen more grinding, despite chaperones' warning to avoid that kind of dancing. the suggested alternatives include things like bonfires. josh: we' re pleased to announce that wmur and our "new hampshire -- requiring the store to record every gun sale on video and submit weekly reports of ammunition sales. jennifer: new rules designed to reduce mortgage paperwork are now in effect. instead of four forms, lenders are now required to give buyers just two forms detailing the terms of their loan. those documents have also been simplified. the goal is to make it easier for borrowers to compare loans from different lenders. josh: facebook may have to stop sharing information on its european customers with its own offices in the u.s. europe' s highest court ruled today that the law that allows companies to freely transfer data to the u.s. doesn' t do enough to protect consumers. the decision doesn' t ban the transfer of information, but it does allow individual countries to review what kind of data is being sent outside its borders. the ruling comes from a case filed by an austrian law student after former nsa contractor edward snowden revealed details about u.s. surveillance programs. jennifer: if you' re traveling for the holidays, you may want to book your ticket right now. orbitz says today should have the best prices for thanksgiving fares. friday is when you' ll likely find the sole winner of last wednesday' s powerball jackpot for $310 million bought her ticket at this gas station in three rivers, michigan on her way to work the overnight shift at a fiberglass factory. >> oh i quit, automatically. i was done. bazi: but, leach didn' t quit as soon as she could have. she waited until her lunch break to check her numbers. >> i was having a really bad night at work. thought, well i might as well check my numbers while i' m sitting here waiting for my lunch. i didn' t believe it. i had to go back to work and get verified from a couple other co-workers and just a pretty scene. same story in dublin. the fall foliage continues to build in. splashes of color in many spots. close to peak in northern areas. the northern country -- if you clouds right now which will move out. partly cloudy, no precipitation for tonight. that could change a little bit tomorrow afternoon in the mountains. outside of that, dry and cool tonight. bright and warmer on wednesday. low 70' s in many parts of southern new hampshire. it cools back down on thursday with one shot of showers on friday. that means it clears out in time for the weekend. cool to start and nice and mild to finish later sunday and in columbus day. lower to mid 60' s towards the coast. around 60 and the good part of the region. a little bit cooler in the upper valley. on average, 55 to 60 in the lakes region and a bit cooler to the north. good part of the white mountains in the 50' s but great north woods dipping into the upper 40' s. many spots up north back into the mid to upper 30' s. the temperatures do fall back into the 30' s, lower 30' s north. near 50 by midnight tonight. they did more -- dip more, but by 8:00 in the morning, upper 40' s and lower 50' s as you are going out tomorrow morning. you will want a light jacket. by the afternoon, clearly you can shed it. west to southwesterly winds and warmer air for one day tomorrow. mid-to-upper 60' s north, upper 60' s lakes
