Larry david penlee was arrested last night after allegedly walking in to a neighborhoods West Asheville yard and attacking her chickens. Ashlea surles joins us live from the police department. Ashlea, his bond is set at more than 5,000, right . Ashlea thats right. He remains behind bars tonight but some say that bond is too low. They say this is a repeat offender and a very dangerous, serious sign. Hi, girl. Had a bad night. Ashlea jill installed expensive fencing thinking the enemy was possums or raccoons. But now she says, the enemy is two doors down. Its not just a chicken, it was a life. And it was all on purpose. Ashlea she heard screaming and looked out to see her neighbor, david penlee, digging in her chicken coop. She said she ran out and screamed at him to stop. Struggling to get away from him because he had her by the neck. Ashlea prescott said he shoved her. Pumpkin is dead. The other chicken, phillis is barely alive. He just came to kill. Ashlea david penlee was charged twice for murder after stabbing a man at a party in 2010. He eventually pleaded to Involuntary Manslaughter. He moved back home to melbourne hills. Hes been convicted of assault four times and w ws charged with it again last night. Id like to see him held at a dangerous and violent. Hes going to explode and hurt somebody really bad. Ashlea now Jill Prescott says last week another one of her chickens was stolen from her coop. We knocked on david penlees door, his dad said he wasnt sure if he son did it or not. Larry a Jackson County man has died in a house fire at a home on Enchanted Forest drive. Its at the end of a steep narrow road. And water had to be hauled up to fight. The home was engulfed in flames, seen in some video we had by maconmedia. Com. The chief says the home belongs to larry holland. An autopsy will determine the victims identity. He was known to smoke. He was a heavy smoker. So were not ruling out that it could have been a cigarette or Something Like that. Larry the chief says there what caused the fire is under investigation. Darcel the defendant in a murder trial takes the jury back to its tragic shooting in rosemund five years ago. Richard oshields is charged with first degree murder in the killing of toby mathis. Prosecutors say he did it to avenge his sons death f fe years earlier. John, oshields says he just happened to be at the Dollar General store. John its interesting, he testified hed never been in that store until that night. In fact, he also testified that he has no idea why he was at that store in the first place. Oshields told jurors he remembers seeing toby mathis face but doesnt recall much else. Later he told his sister, i months before, toby mathis was charged with Involuntary Manslaughter for the death of Joey Oshields when he fell out of tobys truck bed. When oshields was shown a picture of his son, joey, emotions were raw. John so emotional indeed today. Oshields said he could care less if he lived or died. Cognitive issues which relate to a stroke and possibly ptsd and alcohol issues as well. John le, news 13. Darcel a buncombe county mans tiny home is destroyed by a suspected drunk driver. Milton cables neighbor caught driver losing control saturday evening. The driver slammed right in to the house, wrecking it so badly it cant be repaired. Cable was near the home when he crashed and ran to help the driver. On his side straight in to that tiny house we were building. And so we had to rush up there and help to get him out of there. He was stuck. He couldnt get out. Darcel the driver is charged with dwi, driving without a license and failure to maintain control. He was taken to the hospital with minor injuries. Larry protestors showed up at the first meeting since schoolbased review teams were created to discuss district restructuring among asheville city schools. And parents say now theyre not only protesting one of the options on the table. Jerrika insco joins us live. Jerrika, whats going on there right now . Jerrika right now that meeting is going on until 7 oclock right inside this and there are nine teams representing nine schools discussing pros and cons. Outside thats where parents and their kids are protesting not only option four that calls for Hall Fletcher elementary to become a four through eighth grade middle school. These parents say theyre also upset because they feel their opinions have not been included in this process. They also say the timeline is not too short. That the vote would need to vote on march 7th. Parents first want that date moved back. We all know something needs to be done but we want to be a part of that process. Were stakeholders. Karen all right, we have a very active pattern with plenty of rain and eventually high winds, severe thunderstorms coming our way. Right now, though, it is pretty much all rain. We do see some areas of heavier rain mainly in the upstate and foothills. But we add a little bit of lightning in parts of the mountains to very isolated. Right now nothing showing up on radar for that. Coming down in asheville. Light rain 54 degrees. A breeze out of the southwest at 7 miles per hour. Heavy rain in greenville. 54 degrees with winds out of the north at 7. We have this area of low pressure moving through. This is bringing our first wave of significant rain to our region. Then were going to get a break. We have system number two, which right now is back over texas. That is going to be coming in here, too. Well time it all out for you. We can see by midnight that wave of low pressure is going to be right over our region. Heavy rain as we go through overnight. But then this pulls north and east. Much of tuesday, after a wet earlier morning commute is just going to feature light spotty showers, plenty of cover. 6 oclock tomorrow night, we begin to see rain return to our mountain counties and the western part of the upstate. Overall, the bulk of it holding then well see it pick up on in to the afternoon with this front coming through. Out ahead of the front, very gusty winds. And the high winds are going to begin tuesday night on through wednesday. The system moves in, cooler air wraps around behind it. And we could see a light rain snow mix on thursday early in the morning before drying out. Hour by hour future cast. 8 oclock that rain should be in full force over the mountains and much of the upstate, too. By 7 oclock, morning commute time tomorrow, we do see some breaks in the rain. However, roads overall are going to be very wet. You may want to give yourself a little extra time. The rain does taper off quite a bit. It is on the move by wednesday morning. We can see that area, real heavy rain featuring strong to severe storms and those should come through on wednesday afternoon. Over an inch in parts of the foothills and western mountains. But the heaviest rain is going to fall on wednesday. This could push some of our totals over two inches before its all said and done. Lows tonight, lower 40 ns the mountains. Upper 40s in the upstate. Cooler tomorrow with highs only in the 40s in many mountain locations. We take a look at the week ahead and we can see how unsettled we remain on through the middle of the week. However, later on in the week, looking ahead to the weekend, the suns going to come back ouou chilly mornings, but overall looking good on saturday and sunday.
