Prosecutors say the man accused of raping and killing a woman at an apartment complex will face murder charges. This is news 6 at 5 00, getting results. Im matt austin. Im lisa bell. That indictment was announced just moments ago at the state Attorneys Office in downtown orlando. Eric sandoval was in the grand jury room and tweeted this as breaking news when it happened. What did the state attorney have to say about this indictment . The state attorney jeff ashton wanted to say something. He really didnt have time. Room really quickly. His staff says he had to go pick up his son from school. This is a giant step forward in a horrific case. We were in the grand jury room as this was announced. It took a few hours for the grand jury to hear each case. There were four presented today. This was just one of them. This was an allday session for the grand jury. They heard how the 27yearold sasha samsudeans body was doused in bleach, she was strangled inside her apartment. They also saw the Surveillance Video that showed Stephen Duxbury walking through the hallways with samsudean the very last time she was seen. They also heard about the d. N. A. Evidence that possibly linked him to this. We talked to stephen kramer, a legal analyst with us to get his take on this indictment. He says an indictment was almost person, but this was a good test this is an opportunity to see what evidence is out there to kind of organize it to get a grasp of what the case is going to become, maybe get a read for how jurors react to it. There was one change to this case. The grand jury decided that the Sexual Battery charge wasnt good for this. They, instead, decided that attempted Sexual Battery was more appropriate for this case against duxbury. Hes being held in the Orange County jail tonight. The next step on this is his arraignment. A date on that hasnt been scheduled yet. Coming up at 6 00, were going to see what part his past may have in the prosecution of this really terrible case thats been filed against him this afternoon. Yeah, at 4 00, we told you Orlando Police say the students started the fight on their way to school. Trouble those teens could face from all this. Were told it happened this morning near jackson middle school, near cimarron boulevard and la costa drive in orlando. Thats where we find news 6s live. Police got a much different story from all the different people involved in this, right . And thats why right now theyre trying to find the homeless man to see if hes okay and to try and get his side of him. They got two different sides of the story, like you said, from two kids who go to school here. Thats awful. It is awful. Parents of stone wall jackson middle schoolers went from scared to sad when they found out the truth that police say it was the students here who attacked the homeless man. On this sidewalk this morning, not the other way around. At first, the students said the man tried to steal their cell phone and bit them when they so that started a Chain Reaction of panic, starting with this voice mail from the principal. Law enforcement is investigating an encounter two students had with a stranger on their way to school this morning, near 436 and la costa. While Law Enforcement looks into this incident, please remind your children about stranger danger. Right away, parents pointed to the many homeless in the area. Theyre walking up and down. Theyre up in the woods here. Theres a gate. Even bringing up past transients. One guy passed on a bike not too long ago and tried to snatch a phone from a girl that was texting. But by early afternoon, police said the homeless man did nothing wrong. It was the students they say who went after him. I asked police if the kids are going to face any charges. They say not at this point. I also asked the school if they plan to punish these kids. Checking to see if they have jurisdiction because this incident, of course, happened off campus. Right now, crews are working to figure out what caused a big fire at a mobile home in volusia county. You can see the home is a total loss. Were told smoke could be seen for miles before firefighters were able to put out the flames. Everyone was able to get out safely. Some dramatic new video of a chase in Seminole County. The Sheriffs Office released this helicopter video this afternoon. It shows rashad smith, you can see him running there in the middle of the screen, Sanford Police say he fired shots at drivers and then shot at an officer. This all happened friday night near 1792 and the 417. You can see smith trying to get away. The chopper found him, right electrical box. He was arrested. No one was hurt. Smith is now charged with attempted murder and resisting arrest. Breaking news on wall street. Another bad day for stocks. The dow fell nearly 300 points, erasing almost all of fridays big gains. The scheduled execution of a florida man is now on hold. A man on death row for more than 30 years was set to die next week. The states highest court says its all because of floridas Death Penalty law. It was struck down weeks ago. Lawyers for the man asked to delay his execution after the u. S. Supreme court ruled the states Death Penalty law is unconstitutional. Hes accused of killing two people in south florida. The jurys recommendation of the Death Penalty was not unanimous.
